Summary of Proceedings

Hudson Planning Commission Meeting – March 11, 2019

The Hudson Planning Commission met on Monday, March 11, 2019, at 7:31 PM in Town Hall. Vice-Chair Thomas Harvie presided in the absence of Chair Robert Kagler. The meeting included the swearing-in of continuing member Ron Stolle, a continued public hearing on administrative revisions to the Land Development Code (LDC), approval of previous meeting minutes, and a request to transfer a city-owned parcel in exchange for a construction easement. All motions passed unanimously with some abstentions on minutes. The meeting adjourned at 8:22 PM.

Oath of Office

  • Ron Stolle was sworn into office as a Planning Commission member by City Solicitor Matthew Vazzana.

Discussion Items

  • PC 2018-4526 – Continued Review of Proposed Administrative Revisions to the Land Development Code (LDC)
    • City Planner Kris McMaster presented a revised redline draft incorporating comments from the February 25 meeting. Changes included formatting corrections, clarifications on accessory structures (e.g., utility trailers), seasonal sales, performance standards, sign variances, and hours of operation tables. Staff recommended removing proposed amendments for wetland setbacks in Districts 6 and 8, and for water/wastewater requirements in District 2, to be studied further later in 2019.
    • Commissioners discussed the proposed uniform hours for truck and rail loading/unloading (7:00 AM–9:00 PM vs. current 6:00 AM–10:00 PM). Concerns were raised about potential impacts on existing businesses, but no specific complaints had been received. A condition was added requesting further study of Section 1207.10 Performance Standards regarding conflicts with other city ordinances.
    • Staff noted a meeting scheduled with the business community on March 14, 2019, to discuss sign code amendments, including A-frame signs. Commissioner Stolle volunteered to attend.
    • No public comments were received during the public hearing.
  • PC 2019-97 – Property Transfer and Easement at 1556 W. Prospect Street
    • Assistant City Manager Thom Sheridan presented a request from the City to transfer a narrow sliver of city-owned land (Parcel #30-09248) to adjacent property owner Prospect Road, LLC, in return for a temporary 20-year staging easement for future construction of a trail bridge over the Ohio Turnpike as part of the Veterans Trail Phase II.
    • The property is currently encumbered by a restrictive covenant requiring Planning Commission and City Council approval for any transfer. Staff recommended approval with conditions.
    • Mike Haritakis (184 Brentwood Drive) and Daniel Bestic (1749 Saphire Drive), representatives of the purchasing entity, were present and confirmed their intent to consolidate the transferred land with their existing parcel.
    • Discussion clarified that the easement would be temporary and used for staging during bridge construction, with access via Prospect Street. The city agreed to take all necessary steps to extinguish the restrictive covenant after transfer.
    • No public comments were offered.

Key Outcomes

  • LDC Revisions Motion: A motion by Commissioner Stolle, seconded by Commissioner Chuparkoff, to recommend the final revised Redline Draft LDC to City Council for adoption, with two amendments:
    1. Remove the proposed A-frame sign text amendment to allow staff to meet with city merchants on all signage requirements and amend later.
    2. Request further study of Section 1207.10 Performance Standards regarding potential conflicts with existing ordinances and business operations. The motion passed 5–0 (Anglewicz, Chuparkoff, Harvie, Stolle, Vitale aye; Kagler and Lehman absent).
  • Minutes Approval:
    • February 11, 2019 minutes: Approved 3–0 (Chuparkoff, Harvie, Vitale aye; Anglewicz and Stolle abstained).

    2. Recording of the plat and easement agreement within 30 days of receiving documents from the City. The motion passed 5–0.
  • Future Meeting Update: The public hearing for Downtown Phase II is rescheduled from April 1 to the regular May meeting date. The April 11 meeting may be canceled if no additional agenda items are received by week's end.
