The Planning Commission held a special meeting on Monday, August 31, 2026, at 8:00 PM in Town Hall, with the sole stated purpose of convening an executive session to discuss pending litigation pertaining to Commission business. The meeting was called to order with a quorum of six members. Vice Chair Jessie Obert raised a recusal question regarding her previous representation of the applicant, which had since ended; counsel advised her to recuse out of caution due to the ongoing case, and she abstained from the vote to enter executive session. The Commission voted 5–0 (with Obert abstaining) to enter executive session, inviting City Solicitor Marshall Pitchford. After the closed session, the Commission promptly adjourned.
The time is now eight o'clock on Monday, August 31st, 2026, and I would like to call the special meeting of the Planning Commission to order. This meeting has been duly noticed under the Ohio Revised Code, uh statutes for open meetings. And having called the meeting to order, Mr. Sugar, would you please call the roll? Yes. Ms. Obert? Here. Mr. Enamorado? Here. Ms. McCoy. Here. Mr. Nystrom? Here. Mr. Romano? Here. Ms. Norman. Here. We have a quorum of six out of seven members. Um, just for the record. Um, Ms. Smith is supposed to be here tonight. She may be arriving late or not at all, so it will be a surprise. Before we go to the items of business on our agenda, I wanted to uh give uh Ms. Obert the floor. She had a question for counsel related to recusal issues. Ms. Obert. Um I believe the previous time the applicant had come here. I had a contract in place with them and I had to recuse myself from that meeting. That contract has since terminated. Do I need to recuse for this meeting? Meaning I have no long no current act of representation of that client. It would have been, yeah, it was October 27 of 2025. We had a meeting. Um, and Ms. Obert was on the planning commission at that time. So it strikes me that because the case is still ongoing. Um we'd rather do it right. So that's just being safe.
