The amendment reorganizes parking to provide 21 spaces and stacking for at least 6 vehicles (single lane) or 12 (double lane). Access from Acoma Boulevard S is not permitted by Public Works due to traffic congestion; the new plan provides access from Sweetwater Avenue only. The amendment does not withdraw from PIC but rearranges parking to allow a drive‑through.
- Applicant (Paul Lehr, Lehr Architecture): Confirmed discussions with UniSource Electric regarding paving within the Public Utility Easement (PUE). Provided a 10‑foot landscape buffer along Sweetwater and Acoma. Emphasized the design is early‑stage and will comply with city codes on lighting, trash enclosures, and screening. Commissioner Stevenson confirmed the layout is conceptual and subject to civil engineering and UniSource approval. No further concerns were raised.

Morning, ladies and gentlemen, and welcome to the Wednesday, January twenty-first, two thousand and twenty-six meeting of the Lake Havasu City Planning and Zoning Commission. If you please rise and join me for the pledge. Second by Mr. Thornton. Is there any additional comments? All right, let's call for the question. The motion to approve the minutes passes 7-0. All right. Let me start by saying that this is a public hearing and there is a structured order to this proceeding. The city staff will present each item. There will then be time for the commission to ask questions of the staff, and then the applicant will have the opportunity to present their case to the commission. That being done, we will then open the proceedings to the public for their questions and input. And to stay on point and not discuss subject matter that is not pertinent to the decision being considered here today. After public testimony is taken, I will then close the public hearing and bring the motion back to the table for the city staff's exceptions and conditions of approval and uh discussion amongst the commission and eventually a motion to approve or disapprove. And I thank you in advance for your cooperation. The first item on today's agenda is item number ID 265080. This is a request to approve resolution number 26-01, amending track 2287 and 2289 parking and common master plan for 1060 Acoma Boulevard South. Track 2287 block 3 lot 4 to reorganize the parking and accommodate a drive-through. Mr. Gilbert, your presentation. Thank you, Mr. Chairman. Uh good morning, members of the Planning Commission. The applicant for this item is in attendance here today. The subject property is 0.69 acres of vacant land addressed as 1060 Acoma Boulevard South and located at the southeast corner of Ocoma Boulevard South and Sweetwater Avenue. The project proposes to place a new approximately 3,000 square foot retail store slash restaurant on the property with a drive-thru feature and is a permitted use in this district. The parcel is zoned commercial Southgate District with similar zoning to the east, general commercial zoning to the west, and residential Southgate District to the South. Parking is shown at 90 degrees on both sides of this drive aisle with an additional strip along the south side of the alley. Off the alley. So roughly uh 30 spaces total on the original plan. The applicant proposes to amend the parking and common plan, not withdraw from it to arrange rearrange the parking at the north side of the property in a manner that permits a drive-through operation for the restaurant retail store that also includes 21 parking spaces and see those up here. And stacking for at least six vehicles if single and twelve if a double drive-through lane. Uh they show the window right there. This layout also recognizes that due to the traffic situation at the intersection of a coma and sweetwater with highway 95. That public works will not grant an access point from a coma as shown on the original pick plan. So if we go back to original PIC plan, this driveway access, which partially drives this layout, is not going to be feasible due to public works stating they will not grant an access right here. If the property owner to the east ever redevelops their property, we would require them to bring concrete over to meet that. Um actually Mr. feasible due to public works uh stating they will not grant an access right here uh there is intention to connect this uh northeast corner over to the property line so that the parking and common can be extended if the property owner to the east ever redevelops their property we would require them to bring concrete over to meet that um actually mr chairman i'll get to the co-compliance conditions following hearing from the public and the applicant all right does that complete your presentation uh yes sir okay all right are there any questions of staff by the commissioners anybody at all hearing none is the applicant present please state your name for the record my name is Paul Lair I'm the architect for this project um honorable chair and commission members mr gilbert did a great job describing the project I would just like to add that we've also been in touch with with unisource um the electric provider who has a utility easement that runs along the easterly property line and and we we have a an agreement with not a formal agreement but we have an understanding with them that we can pave uh concrete and curbing within their uh PUE um as long as we address some issues at the alley as far as transformer location and trash enclosure to keep those items out of it and we've also provided the required 10 foot landscape buffer along sweet water and a coma for this project we're looking forward to moving ahead any questions of the applicant Mr. Thornton there's another there's another building on that one big dirt lot and then there's one small building sitting in the back looks like like in the middle between that where the whole dirt area is that where's that at on this this is the whole there's gonna be a whole new build right yeah I'm not familiar with the yeah yeah it's a whole new build right because there's a there's like a right next to that one isn't there a like a building in the set set back on yeah that's on the adjacent parcel. Okay so that's not affected as far as the parking where the where the park is going to come in or no right the parking and commons all along the front sweetwater uh front edge and that ultimately will have a connection okay okay because that's I mean that's just like pretty much all it there so it's not going to affect even the buildings to the right of that. Uh no sir okay any other questions of Mr. Lair right thank you Mr. Lair all right this is a public hearing if there's anybody that wishes to speak on this item I've got a few applications here or people that have filled out speaking requests we don't have to adhere to those if somebody would like to speak just come forward and state your name for the record morning we're Brian and Darlene Doherty we own and occupy the home directly south of this property um so we're just past the alley in the south side um we just have a few questions and we're largely in favor of it actually looking forward to it but we do have a few questions. We'd like to know looking at that it's very hard for us to decipher what is the term there's this portion on it that says accessible route we don't know what that means we will get a definition for that for you. Pardon me said we'll get a definition from the from the applicant. Okay we also would like to find out um about a retaining wall whether it'll be at grade or whether it's going to be at the alley level as the people right behind them you can imagine we're a little concerned about noise light um number of factors we were also gonna wonder whether um the order we're trying to understand the order window because it seems to say there's two parts but the picture shows one so we'd like them to address the order window and where exactly that's located how that flow goes the picture shows it right behind or in front of our property we really would ask that they consider relocating it so that we don't have the noise and we don't have people looking straight into our yard and I would like to bring up the location of the dumpster um that they are adjacent very close to us um one is rodents because this is going to be a food restaurant so smell and rodents and stuff trying to get in the dumpster within feet of our property that's a concern for us. And also the other businesses in the alley we see constant people trying to use those dumpsters as personal dumps. So if that location of the dumpster would possibly move away from our right next to our backyard where our pool is and stuff, so we don't have smell and rodents and things like that. That would be appreciated if they would consider relocating the where they're showing the dumpster.
