17th, put that on your calendar if you forget Saturday to come.

0:06

Um I'd like to change hats.

0:08

I forgot to put that on the sheet, Deanna.

0:11

I apologize.

0:12

Um it's spring, and spring always is a season of hope for people who are thinking about buying a house in Lennox.

0:19

And one thing I wanted to remind, I have my affordable housing hat on Affordable Housing Trust, and we want to remind people that we have a first-time home buyer assistance program, which allows a potential homeowner who income qualifies, so you have to meet the income qualifications, but you are um perfectly welcome to take out what is essentially a grant from us by applying to with your lender and with the town for up to 20,000 dollars in assistance for that first-time home buyer.

0:55

So I'm not describing this very well, but we do have a brochure that's around in town, so pick these up and take a look.

1:01

It may help you get into a house here.

1:04

So thank you.

Speaker 2

1:05

Thank

Unassigned speaker

1:05

you.

Speaker 2

1:07

Anyone else?

1:08

Uh yeah,

Speaker 3

1:09

Karen.

1:09

I'm gonna end this on tomorrow.

1:12

Yep.

1:16

Hi, I'm here for a follow-up to last month's meeting that I attended on behalf of concerned parents and staff of community members regarding the future of Lennox Children's Center.

1:27

I am also looking forward to the replies to my six questions I brought to the select board at last month's meeting.

1:33

Um first I'd like to the clarity on the town's position.

1:36

Is the select board willing, um still willing to assist the directors and parents in relocating the LCC, or has the board decided it's tired of this topic and no longer interested in being part of the solution for our community.

1:48

Since the eviction announcement, parents and staff have organized and stepped up, but we have not seen any outreach or support from the board.

1:56

Um second, the community deserves transparency regarding the future of this building.

2:00

I know it was one of my questions from last month.

2:02

This is a community building, it will continue to be used for the benefit of the community.

2:06

There are growing concerns that this may be sold to a private developer or otherwise used for personal gain.

2:12

We are asking plainly what is the plan.

2:15

Third, I want to address a statement after made that was made at during last month's meeting about the LCC snow removal paid for by the town of Lennox.

2:24

This is an erroneous claim.

Unassigned speaker

2:26

I

Speaker 4

2:26

am asking the board to provide documentation to support the claim that they made.

2:37

Statements like this damage trust and they require proof.

2:41

Additionally, we're hearing a wide range of numbers regarding the cost of the repairs for this building from two million to nine or ten million.

2:49

Please provide us with that with actual estimates.

2:51

Right now the discrepancies raise serious questions about what information is accurate.

2:57

Again, adding to the concern and mistrust.

3:00

Please provide answers to these concerns and questions during the select board meeting, not when the meeting is adjourned and the cameras turned off.

3:07

We're asking for transparency, accountability, and a genuine effort to work with the community.

3:13

I look forward to your responses.

3:14

Thank

Unassigned speaker

3:15

you.

Speaker 2

3:21

Wherever you like it, it doesn't I think it would be easier for us to answer some of these questions.

3:26

So this is the first I've heard of any of these concerns.

3:28

Yeah, you weren't

Speaker 4

3:28

at the last meeting.

Speaker 2

3:29

I

Speaker 4

3:29

wasn't

Speaker 2

3:31

that that's okay.

3:31

And I think, but I in order for me to help facilitate this to get those ahead of time would certainly help.

3:36

It would be easier for me to say, okay, hey, what I know I don't know that we have gone out and gotten bids to find out exactly how much it's gonna cost to fix XYs in that building, because I don't think we've also done a very thorough thorough study of like, okay, what really is wrong with this building.

3:48

We know this is bad, we know this is bad.

3:50

What else?

3:50

Once we start opening walls, what else are we gonna find?

3:52

Because that's where when you say two to nine million, we might think we only have to have to fix a wall.

3:56

We don't know if there's something else in there.

3:58

Hard to really know that.

3:59

But hard for me to answer the all six of those questions.

Speaker 4

4:04

Yeah, so some of these kind of relate to the media the questions I did ask, which I know they are in working.

4:09

Summary of Proceedings

Lennox Select Board Meeting - April 8, 2026

The Lennox Select Board convened on April 8, 2026, to address community concerns, review the Fiscal Year 2027 Annual Town Meeting Warrant, and conduct routine licensing business. The meeting featured extensive public testimony.

Public Comments & Testimony

  • Lennox Children’s Center (LCC): A community member representing concerned parents and staff requested responses to inquiries from the prior month. She asked whether the board remained committed to helping relocate the LCC, demanded transparency regarding the building’s future (specifically whether it could be sold to a private developer), and disputed a prior claim that the town paid for LCC snow removal, stating the center paid for it. She highlighted conflicting repair cost estimates ranging from $2 million to $10 million.

    • Board Response: Board members stated they had worked for over a decade to find new locations for the center and that the LCC made the decision to leave. One member cited a 2016 engineering report (EDM) estimating $6.5 million for code compliance, with current costs expected between $8 and $10 million. They explained that spending over $50,000 would trigger full code compliance, making the project financially infeasible. The board pushed back on the characterization of eviction and stated the building is considered dangerous and not ADA compliant. Regarding the snow removal, a member responded that if the DPW assisted, there was no charge.
  • Pittsfield-Lennox Road Safety and Development: A resident of Links Ford Road presented a petition signed by ~200 residents regarding hazardous conditions on Route 7/20. She cited excessive speeding (45 mph limit frequently exceeded), dangerous heavy truck traffic, multiple accidents and fatalities, and a lack of enforcement. She also complained about light pollution from Berkshire’s Untold and a lack of notification regarding the Penrose affordable housing project access points.

    • Board Response: The board acknowledged speeding issues and highlighted enforcement by Police Chief Smith (unmarked cruiser, speed trailer grant). The resident was directed to the Building Department for light pollution. The board clarified that MassDOT holds full jurisdiction over speed limits, weight limits, and major traffic infrastructure on that state-controlled road.

Consent Calendar

  • Approved a one-day all-alcoholic beverage license for Ollie Berkshire Community College (May 19, 2026, 5-7:30 PM).
  • Approved 2026 seasonal liquor license renewals for VSO Serenic Club, Whistler’s, and Eastgate.

Discussion Items

  • Affordable Housing Trust Program: A board member announced the First-Time Home Buyer Assistance Program, offering qualified buyers a grant of up to $20,000.
  • Public Hearing / Cello LLC Liquor License: The board held a public hearing for the change of ownership of Cello LLC’s liquor license to new principal owner Ryan Boya. No concerns were raised.
  • Fiscal Year 2027 Annual Town Meeting Warrant: Town Manager Jay reviewed the 17-article warrant for the May 7, 2026, Town Meeting.
    • Budget: Employee benefits were separated from department budgets for transparency. School capital received an additional $500,000.
    • State Affordable Housing Law: An extensive discussion followed questions about the Penrose project and Community Preservation Act (CPA) funds. The board explained that towns under the 10% affordable housing threshold (40B law) have limited control over such developments. The developer pays full property taxes despite deed-restricted units. The 3% CPA surcharge is a standing set-aside, not a new tax.
    • Community Engagement: The board announced Town Meeting Preview Workshops (week of April 27) and the use of electronic clickers for all Article votes to ensure voter anonymity.
    • Key Articles: Article 15 authorizes a wireless tower lease; Article 16 amends the Gateway Mixed Use Development Overlay District.

Key Outcomes

  • Liquor Licenses: Unanimously approved the Cello LLC ownership transfer, the Ollie BCC one-day license, and three seasonal renewals.
  • Town Meeting Warrant: Unanimously approved the FY27 Warrant. Town Meeting scheduled for May 7, 2026, at 7:00 PM at Duffin Theater. Annual Town Election is May 11, 2026 (7 AM – 7 PM).
  • Referrals: Light pollution complaints directed to the Building Department. Resident agreed to share contact info for follow-up on MassDOT petition.
  • Next Meeting: Scheduled for April 22, 2026.
