0:50

All right, let's start out with announcements.

0:52

Construction project updates.

0:58

Construction is season is slowly winding down, so we're kind of getting to the end on some of these.

1:29

We're done.

1:30

People notice that they're completed once again on the map here.

1:33

It's 46th.

1:34

There was some more work done on 40th and on 19th.

1:39

For Memorial Highway West, we are getting prepared to uh pour concrete in the westbound lanes in this picture shown uh kind of in the uh removal phase, but that's all nice and graded out now.

1:54

Um and then we are also uh preparing to put the temporary winter pavement on the westbound side, and that would give us our winter temporary section of asphalt um on Memorial Highway West.

2:07

And then on Third Street, people will notice that um the storm sewer work is continuing and will uh continue to be worked on over the next uh few weeks to to the month to the end of the year.

2:22

Uh reminder, uh there is dewatering happening on the uh Memorial Highway project.

2:28

This picture is down by midway lanes, but this might be there people might see similar setups at different parts of the corridor.

2:34

Uh this is uh groundwater that is being pumped out of the ground to create dry working conditions for contractors, and it is nothing to be too worried about.

2:44

First street reconstruction project, uh phases one and two are substantially complete, and through phases three and five shown in orange and purple here, are currently active construction.

2:56

Um did keep that picture here of uh fifth.

3:00

Um this week we're expecting uh phase three to get curb and gutter or curb and gutter and then a roadway preparation done.

3:07

Phase one, we will have the uh concrete contractor mobilized over there to complete some small um concrete installations like ped ramps and uh I think some of that colored concrete work will get done this week.

3:20

Upcoming, we're expecting uh water and storm sewer to get to wrap up on phase five, and then phase five will get prepared for roadways.

3:29

And um at the same time, landscaping is going to be done on phase one.

3:36

Lewis and water and sewer district sixty five up by Lewis and Clark Elementary.

3:39

That one is substantially completed.

3:41

Punch list items have been developed, and the contractor is going to be slowly working on those through this through end of the end of this year.

3:49

Um Street Improvement District 241 up by Red Trail Elementary, asphalt paving is paving is complete.

3:55

The chip and fog seal work is complete, and we are currently working on landscape restoration.

4:01

Um next would be uh uh signs, traffic control signs, and pavement markings to be completed, and then we're expecting to do a walkthrough in the next two weeks where we would identify um deficiencies with the contractor with the consultant engineer with uh public works who will be taking over maintenance of the work and uh put together a checklist for the contractor to address before final acceptance.

4:29

Um and then last week I did touch on the uh a couple of neighborhood projects, another project that I'd like to touch on that is still active kind of behind the scenes is our 8th Avenue Northwest and 27th Street project.

4:40

Design is complete on this, and we're expecting um bid opening to happen this winter with construction next summer, and uh we do expect, even though we're calling this our 8th North Avenue Northwest and 27th Street project.

4:54

We're expecting a much larger work area where we are going to be addressing some of the rehabilitation needs in the roadways around this major corridor.

5:04

And so we it will include an urbanized uh section on 8th and 27th, similar to the one to the road just west of the new high school, and then um district wide rehabilitation, probably valley gutter rehabilitation, patches, chip seal, um, some of that just kind of um patchwork in the surrounding area.

5:26

Um and then we do have a lot of other active projects, and uh those are all posted on our website and have individual project websites, and I can try and answer any questions if you have anything else for me.

5:36

Just a reminder, 8th and 27th.

5:38

When is that slated to be rebuilt?

5:41

Um we're expecting reconstruction to happen next next year.

5:45

Okay.

5:47

Any other questions for Jarek?

5:49

I have a question.

5:50

Um not any of these projects that you talked about, but what about the Sunset Corridor uh interstate exit there?

5:58

What is the status on that project?

6:01

Um Mayor Commissioner.

6:02

The uh North Dakota Department of Transportation just went through a value and engineering study on the design of that interchange where the where they had a I think a third-party consultant identify a few uh changes that could be made in the interest of bringing the cost down on that project.

6:20

So they are very much still in the design phase of that.

6:23

Um I don't think that we would be able to pin down the DOT on exactly when they would say that project would occur because I don't think that they have funding explicitly allocated to the project quite yet, though they are expecting it.

6:37

So I would expect 2028 would be a good guess at this point in time.

Summary of Proceedings

Mandan City Commission Meeting – September 15, 2026

The Mandan City Commission met on Tuesday, September 15, 2026, at 5:30 PM in the Ed Bosch Fer Electric Meeting Room at Mandan City Hall. Key topics included construction project updates, a public hearing on the 2027 budget, approval of a construction manager at risk (CMAR) solicitation for the wastewater treatment plant, a retail incentive for Forever Treasures, a driveway variance, and discussion of a vacant commission seat following petitions for a special election.

Consent Calendar

  • Approved the agenda and the September 1, 2026, meeting minutes unanimously.
  • Approved items 1–4 of the consent agenda (routine approvals).
  • Item 5 (authorizing staff to advertise a CMAR request for qualifications for the wastewater treatment project) was pulled for discussion and later approved by roll call (all yes).

Public Comments & Testimony

  • Susan Bieler, a Mandan resident since 1992, commented on the 2027 budget and the vacant commission seat. She noted that property tax makes up only 15% of city funding and expressed concern about rising water bills for residents on fixed incomes. Regarding the commission vacancy, she submitted petitions (176 valid signatures, exceeding the required 162) requesting a special election to fill the seat of the late Commissioner Craig Solberg. She also criticized the city for not responding to public emails about a prior planning and zoning meeting, stating that hundreds of comments received no reply.

Construction Project Updates

  • Memorial Highway West: Concrete pouring in westbound lanes and temporary winter pavement preparation underway.
  • Third Street: Storm sewer work continuing through the end of the year; dewatering occurring on the Memorial Highway corridor.
  • First Street Reconstruction: Phases 1–2 substantially complete; phases 3–5 active. Curb and gutter, pedestrian ramps, colored concrete, and landscaping scheduled.
  • Lewis & Clark Elementary Water/Sewer District 65: Substantially complete; punch list items being addressed.
  • Red Trail Elementary (Street Improvement District 241): Asphalt paving and chip/fog seal complete; landscape restoration and a walkthrough for deficiencies planned within two weeks.
  • 8th Avenue NW and 27th Street Project: Design complete; bid opening this winter with construction in 2027, including urbanized sections and area-wide rehabilitation.
  • Sunset Corridor Interstate Exit (NDDOT project): Value engineering study completed; design ongoing; funding not yet allocated; tentative construction estimated in 2028.

Discussion Items

  • Wastewater Treatment Plant CMAR: City Engineer Jarek presented the need for a CMAR delivery method for a project estimated at $114 million (2023 dollars), likely above $114 million and possibly $120 million. The plant, built in 1997, lacks redundancy and has reliability issues. The city has a $20 million SRF loan for design; future funding may lock at 2% over 30 years, financed through utility rate adjustments phased over five years. Staff recommended early contractor involvement to control risk and cost. Commissioners voted to authorize advertising for CMAR qualifications.
  • Forever Treasures Retail Incentive: The Mandan Growth Fund recommended a $12,937.50 incentive ($3.75 per square foot) paid over 12 months for a consignment store at 1311 1st Street NE. The building was vacant for years. Average committee rating: 3.7 out of 5. Growth fund cash balance: $105,810.50. Commission approved the incentive unanimously.
  • Driveway Variance at 602 6th Avenue NW: Applicant requested 18 additional feet for a driveway to serve a detached garage. Staff recommended approval despite a light pole concern (setback ~22 feet from property line). Commissioner Blavic raised concerns about the light pole and stormwater runoff; staff noted the applicant may adjust width or relocate the pole at his own cost. Approved unanimously (Commissioner Heinshan motion).
  • Open City Commission Seat: Following petitions with 176 valid signatures, the commission discussed options. City Attorney Neubauer explained that the earliest special election could be held is 95 days after the call, likely December 19, 2026, or early 2027. Cost depends on polling locations. No decision made tonight; further discussion scheduled for the first week of October.
  • Ordinance 1492 (Amendment to Maximum Tax): Second consideration passed unanimously with no public comments received.

Key Outcomes

  • Approved consent agenda items 1–4 (unanimous).
  • Approved item 5: Authorizing staff to advertise for CMAR for the wastewater treatment plant (unanimous).
  • Approved the Mandan Growth Fund recommendation for Forever Treasures retail incentive ($12,937.50) (unanimous).
  • Approved the driveway variance at 602 6th Avenue NW (unanimous).
  • Approved second consideration of Ordinance 1492 (amending maximum tax) (unanimous).
  • Public hearing on the 2027 budget (Ordinance 1488) was opened, suspended, then closed after 6:00 PM; no action taken until October 6, 2026.
  • Continued discussion on the special election for the vacant commission seat; no decision made, next update in early October.
  • Future meetings: October 6, 2026; October 20, 2026; November 3, 2026 (all at 5:30 PM).
