Resolution 26-110 – Timeshares, Leaseholds, and Single-Ownership Properties

- Leasehold criteria debate: Member Rollins Fernandez moved to limit the leasehold properties to those 100% leasehold. An amendment to set the threshold at 75% was withdrawn. The motion for 100% failed 4–5 (4 ayes, 5 noes).
- Removal of Hale Onoloa: A motion to remove Hale Onoloa from the leasehold list passed unanimously (9–0) after testimony indicated it no longer had leasehold units.
- Member Paulton’s amendment (ASF) added properties with a single owner, variances, and 100% timeshares (as of a date to be determined). The amendment passed 8–1 (Chair Lee, Sugimura, Paulton, Rollins Fernandez, Cook, Sinansi, Batangan, Uu Hodgins in favor; Johnson opposed).
- Member Cook’s amendment added three leasehold properties (Kana‘i ā Nalu, Kahana Village, Maui Sands 1). Passed 6–2–1 (Paulton excused; Johnson and Rollins Fernandez opposed).
- Planning corrections (correcting Halama Street properties and including all of Milowai Ma‘alaya) were adopted 6–2–1 (excused: Paulton; opposed: Rollins Fernandez and Johnson).
Resolution 26-111 – Hotel-Like Properties
- Chair Uu Hodgins described the resolution as covering properties that operate like hotels (centralized services, front desk, etc.). The initial list included Wailea Ekahi 1–3, Wailea Ekolu, The Palms at Wailea 1, Papakea, and Maui El Dorado.
- Member Cook’s amendment added three properties: Kamā‘ole Sands, Luana Kai, and Mahina Surf. Member Cook detailed their hotel-like features (front desk, linen service, round-the-clock staff, etc.). The amendment passed 6–2–1 (excused: Paulton; opposed: Johnson, Rollins Fernandez).
- Member Sinansi’s amendment added Hanakai Maui in Hāna, described as a boutique hotel serving both visitors and residents. Passed 6–2–1 (same lineup).
Key Outcomes
- Resolution 26-110 (as amended) was approved 6–2–1 (Chair Lee, Sugimura, Cook, Sinansi, Batangan, Uu Hodgins aye; Johnson, Rollins Fernandez no; Paulton excused). The resolution will now be transmitted to the Maui Planning Commission for a 120-day review, with the list expanded to include timeshares, leaseholds (all percentages), single-ownership properties, and planning corrections.
