1:12

Present.

1:13

We have four present.

1:15

Let the record reflect we have a quorum quorum and I am on speaker management, or I can certainly see it if you want to raise your flags instead.

1:22

Let's start with our consent agenda, which I'll read for the record.

1:26

Item number one is the resolution for election judge and deputy city clerk appointments for the November 3rd upcoming general election.

1:34

Item number two is a contract with Clearwater in Analytics for investment accounting aggregation analytics and reporting systems.

1:43

Item three is a contract amendment with terminal four for maintenance of our city's website.

1:49

Item number four is a contract amendment with Met Council for housing opportunities for persons with HIV and AIDS programming.

1:59

Item five is a legal settlement with the MDH Pardon me about an MDHR charge.

2:05

Item number six is a workers' comp claim of Eugene Danielson.

2:10

Item seven is a workers' comp claim of John Levins.

2:13

Item number eight is a settlement agreement and resolution related to the demolition of city-owned property at 4140 through 4146 Fremont Avenue North.

2:24

That is a commercial space, and this is sort of a memorandum of understanding and what parties will be responsible for what about a shared building that goes over both sites.

2:38

Thank you, Chair Palmasano.

2:39

If I can pull out number three and five for separate discussion and vote.

2:45

Certainly.

2:47

So this is a consent vote on items one through eight with the removal of items number three and five.

2:55

You said thank you.

3:10

All those in favor, please signify by saying aye.

3:13

Aye.

3:14

Are there any opposed?

3:16

That motion carries.

3:20

Go ahead, Councilmember.

3:22

Uh, thank you, Chair Pomonsana.

3:24

Wondering if we can get more of a thorough feedback or information on number three regarding the contract amendment with terminal four for support and maintenance of the city's website.

3:35

I think it's over a million dollar contract, so I just want to get more information.

3:41

Yeah, just to clarify, it's it's a over one million dollar increase to an existing contract.

3:47

Okay.

3:47

Um and we did have some conversation about this at agenda setting.

3:51

Um I also spoke fairly extensively about my and other people's experiences of the city's website and how it could be made better.

4:03

Um I don't feel like I'm equipped to answer any specific questions you might have, but um I also don't know that we're gonna have anybody from IT to be able to answer them today.

4:15

So is there anything that you'd like to note for follow-up and we can get those questions answered for you and we can just forward it without recommendation today?

4:26

Uh I would like to know if there would be any implications of delaying it a cycle to get our answers, our questions answered.

4:34

Well, um, council member, I do know from the casual conversation we had about the set agenda setting that they're on a pretty tight timeline.

4:42

Um the project management aspect.

4:46

Um I'm not sure that they allow for that, but it does say an additional three years, so it looks as though the current contract goes at least through October 21st.

5:00

So perhaps um clerks, you were part of this agenda setting, but you're part of all agenda settings.

5:06

So are there is there any recollection from your um Madam Chair?

5:11

I'm not aware of uh I don't believe that this was an item for that the terms were the contract was going to be expiring soon.

5:21

However, uh I don't remember any specifics beyond that.

5:26

Okay.

5:27

Um yeah, I I guess chair I know that it was about making the website accessible per the law, right?

5:36

So some of the a lot of this increase to the contract is about compliance with accessibility.

Enterprise and Labor Relations Committee Meeting - September 22, 2026

The Enterprise and Labor Relations Committee, chaired by Councilmember Linne Palmasano, met on September 22, 2026, to consider a consent agenda, discuss two pulled items, and address a workers' compensation claim referred back from the City Council. The meeting included roll call, discussion of contract amendments, legal settlements, and the city's obligations under state workers' compensation law.

Consent Calendar

  • The committee approved Items 1 through 8 on the consent agenda, with Items 3 and 5 pulled for separate discussion and vote. Items included election judge appointments, a contract with Clearwater Analytics, a contract amendment with Terminal Four for website maintenance, a contract amendment with Met Council for housing programming, a legal settlement with the Minnesota Department of Human Rights (MDHR), and workers' compensation claims.

Discussion Items

  • Item 3: Contract Amendment with Terminal Four for Website Maintenance – Councilmember Chavez expressed concern about the lack of detail in the Request for Council Action (RCA) for a $1.2 million increase to an existing contract, noting that much of the cost was for accessibility compliance. Councilmember Chugtai echoed the need for more information and noted the absence of staff to answer questions. Chair Palmasano proposed forwarding the item without recommendation, with a commitment to delay it at the full council if questions remained unanswered. The motion carried.
  • Item 5: Legal Settlement with MDHR – This settlement resolved a charge filed by a former employee and required a $10,000 payment. Councilmembers Schaefer and Chugtai requested more information but acknowledged that most details were confidential under personnel and data practices laws. Councilmember Chugtai expressed concern that the administration did not brief committee members beforehand. The item was forwarded without recommendation, with follow-up directed to the City Attorney's office.
  • Workers' Compensation Claim of Jason Anderson – Deputy City Attorney Abelson explained workers' compensation law, including the statutory presumption that PTSD for first responders is work-related unless the employee had a prior diagnosis. Councilmember Stevenson shared community frustrations about officers with misconduct histories receiving settlements, and noted plans to work with Chair Palmasano on state-level advocacy. Councilmember Chugtai asked whether the city had ever challenged a claim based on an officer's history of untruthfulness. Director of Risk and Claims Andrew Lathrop described the claim review process, including expert witnesses and surveillance. Chair Palmasano offered to follow up on the question about the city's litigation history. The item was forwarded without recommendation, subject to further discussion if answers were not provided.

Key Outcomes

  • Items 3 and 5 were forwarded without recommendation to the full City Council, with the understanding that they could be delayed if information requests were not met.
  • The workers' compensation claim of Jason Anderson was forwarded without recommendation, with a commitment to follow up on the city's history of challenging claims based on untruthfulness.
  • The committee acted on all business and adjourned.
