The New Braunfels City Council convened for an executive session regular meeting on Monday, December 8, 2025, at 5:01 p.m. Mayor Neal Linnartz called the meeting to order with a quorum present (Councilmembers D. Lee Edwards, Lawrence Spradley, April Ryan, Michael Capizzi, Toni Carter, and Mary Ann Labowski). The council immediately entered closed session at 5:02 p.m. to deliberate two items: (1) the appointment, evaluation, duties, discipline, or removal of the City Manager, in accordance with Section 551.074 of the Texas Government Code; and (2) pending and contemplated litigation, including City of New Braunfels v. Stoddard Construction Management, Inc. and Swiss Re Corporate Solutions America Insurance Corp. (Case No. C2024-1777D). The council reconvened into open session at 6:02 p.m., announced that not all executive session items were completed, and indicated they would reconvene into executive session following the regular meeting. No action was taken during this open session.

Tonight, in accordance with the Open Meetings Act, Texas Government Code, Chapter 551.071. The City Council may convene in a closed session to discuss any of the items listed on this agenda. Any final action or vote on any executive session item will be taken in open session. Tonight we plan to deliberate the appointment, evaluation, duties, discipline, or removal of the city manager in accordance with section 551.074 of Texas Government Code, and deliberate pending contemplated litigation, settlement offers, and matters concerning privileged and unprivileged clan information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071 of Texas Government Code, including but not limited to City of New Bromfels versus Stoddard Construction Management Inc. and Swiss Re Corporate Solutions America Insurance Corp. Clause number C2024 1777D. It is 5 02 p.m. on Monday, December 8th, 2025, and we are leaving open session going into closed session.
