The New Braunfels City Council met in executive session on Monday, February 9, 2026, at 5:01 p.m. to discuss pending litigation and real property matters as permitted under Texas Government Code Chapters 551.071 and 551.072. Seven council members were present, with Councilmembers Carter and Capizzi arriving after the meeting was called to order. The council did not reconvene into open session and took no action.

Councilmember Ryan. Here. And Mayor Leonards. Here. We have a quorum. Tonight in accordance with the Open Meetings Act, Texas Government Code, Chapter 551.071. The City Council may convene in a closed session to discuss any of the items listed listed below. Any final action or vote on any executive session item will be taken in open session. Tonight we don't anticipate taking action on any of the items on executive session. So if we if there's no action to take, we will adjourn directly from our closed session. However, if there is any action to be taken, we will come back into open session to take that action. Tonight we plan to deliberate pending or contemplated litigation settlement offers and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with section 551.071 of Texas Government Code specifically regarding discussing legal options related to the status of real estate negotiations to secure necessary right-of-way for Colenberg Road Improvement Project, which includes a 1.034 acre or 45,040 square foot tract of land and a.581 acre or 25,301 square foot temporary construction easement in the AM Esnerauzer Survey number 98 of Comile County, Texas, and being out of the remainder of the called 92.49 acre tract recorded in document number 200306025956 of the official public records of Comau County, Texas, also known as Comal County Parcel Number 71705, and a.576 acre or 25,077 square foot tract of land in the AM Esnerhauser survey number 98 of Comile County, Texas, and being out of the remainder of the called 92.49 acre tract recorded in document number 200306025956 of the official public records of Comal County, Texas, also known as Comal County Parcel Number 428468. And we also intend to deliberate and consider the purchase, exchange, lease, contract terms, due diligence, or value of real property in accordance with section 551.072 of Texas Government Code, specifically regarding connections lease.
