Newport Zoning Board of Review Meeting – July 28, 2025
The Newport Zoning Board of Review met on Monday, July 28, 2025, at 6:00 PM in the Council Chambers at 43 Broadway. Board members present included the Chair, Vice Chair Dave Riley, Acting Secretary Bark Grimes, Nicole Chevry, and new member Richard Berlinski (voting in place of absent members). The meeting covered two withdrawal requests, two extension requests, three summary calendar petitions, and one abbreviated summary petition.
Communications
- Withdrawal Requests: Two petitions were withdrawn without prejudice: 9 County Street (Lee Divittis) and 118 Prospect Hill Street (Salvatore Carrabba). Both motions passed unanimously.
- Extension Requests:
- 7 Cottage Street: Granted a second 12-month extension unanimously.
- 435 Broadway (Newport Contemporary Ballet): After discussion and public comment, the board voted to grant a 24-month extension (instead of the requested 36 months) to allow time for funding. Consent Calendar – Summary Petitions

- 14 Tews Court (Will Deines): Special use permit and dimensional variance to construct a second-floor addition 5 feet from the front property line (7 feet required). Approved 4-0 after member Richard Berlinski recused himself.
- 34 Poplar Street (William Smiley): Dimensional variance for lot coverage increase from 35.74% to 37.02% (34.94% allowed) for a 32 sq. ft. accessory shed addition. The originally advertised side setback variance was deemed unnecessary. Approved 5-0.
- 300 Broadway (Eduoard and Lyndsey Kachelmann): Dimensional variance to install an HVAC condenser 2 feet from the north property line (5 feet required). Approved 5-0.
- 62-64 Bridge Street (Patrick Kilroy): Dimensional variance to permit two driveways without the requisite 100 feet of lot frontage. Approved 5-0 with an additional condition to obtain driveway curb cut and physical alteration permits from the city engineering department.

And um we've got a very busy schedule today, so uh I want to get going uh so we can get everything in. Just kidding. Um so uh we are gonna do the roll call of officers today. Uh Nicole Chevry is here. Uh we've got Mr. Uh Riley, Dave Riley is our vice chairman. Uh Bark Grimes will be acting secretary today. And um for the first time, uh we've got um Richard Berlinski, uh, who is a new member of the zoning board. He actually is a second alternate, uh, but one of our voting members, Russ Johnson, isn't here, and our first alternate, Melissa Padavine, isn't here. So you're getting called to service in your first meeting. Congratulations. Um we don't have any minutes to uh approve tonight. Um we do have some communications. I don't believe we have any appeals, so there are no appeals. And there are also no full hearings tonight, which is pretty unusual. So we've got some summary hearings and we've got an abbreviated hearing uh summary to go over. We do have some communications. Um we've got two withdrawal requests. Uh the first one is nine county street, and it's a request of withdrawal without prejudice. Um I'd like to uh entertain from one of the board members a motion to do so. Does anybody have a motion? Uh yeah, Mr. Chan. Yeah, Mr. Chairman. Uh I move that we uh um uh vote to uh withdraw without prejudice um the petition for nine county street. Is there a second? Second. All in favor, please signify by saying aye. Aye. Any opposed? Passes unanimously. Moving on to 118 prospect hill. It's also a request to withdraw without prejudice. Love to entertain a motion on that one. Yeah, Mr. Chairman, I move that we um uh vote uh to withdraw um the petition of 118. Um 118 prospect Hill uh without prejudice. Without prejudice indeed.
