Great.

9:31

Thank you.

10:04

And I'd like a 30-second heads up, please.

10:06

Perfect.

10:07

Uh ladies and gentlemen.

10:08

I own the my name is James Maxwell.

10:10

I live at 2601th Avenue Southeast.

10:13

Uh my property borders this uh potential project for Dollar General.

10:19

Um the sprinkler system as currently uh put into the plat that I was I was mailed, is approximately 15 to 20 feet from my property line.

10:30

As they clear this area, I also have a clearing along the fence line, it's about eight foot, ten foot wide.

10:36

I go through there, it's area that I keep uh mulch that I use to compost for my gardens, it's an area where I harvest wood, it's the area where I pull walnuts from, it's area where I pull acorns from.

10:48

It's an area that I utilize on my property.

10:52

Utilizing these sprinkler systems at that point is gonna have blowback, spray back, and it's gonna have watershed onto my property.

11:01

Now I understand the last meeting that I was here at uh a couple weeks ago.

11:07

The gentleman said it was engineered correctly, and I I have no doubt it's engineered correctly.

11:13

I do have questions on the ability to trust employees at the Dollar General to chemically treat the water correctly.

11:20

One.

11:21

Two, I have questions in regard to the actual uh spray back.

11:26

Am I gonna be out there whether it's the middle of the night on my property or midday on my property and these sprinklers go off, blowing on to me and my grandkids as we're out there picking wood and and uh nuts and cutting trees down?

11:40

I mean, I I don't know about you, but I wouldn't want to be sprayed by any waste.

11:43

I don't want to be stepping in the waste.

11:46

And I don't think it's uh really responsible uh to put that kind of uh uh aerobic system so close to someone else's property that they're utilizing.

11:58

I have an agricultural property.

12:00

I don't want that waste on my property.

12:02

They have talked about moving this uh exchanging because they have to have a 300, according to the engineer, they have to have to 300 foot spacing between a public well, which would be I'm assuming the dollar generals, and the aerobic system.

12:16

They talked about flipping it still downhill to my property from that from any angle.

12:21

Additionally, it's it's uphill going downhill into Thunderbird watershed area.

12:27

I don't know if you've looked at the plates, but there is a extensive area that covers both my property and that property that is part of the protected Lake Thunderbird watershed area.

12:37

Have we talked about the additional necessities for that?

Norman Planning Commission Meeting - September 10, 2026

The Norman Planning Commission met on September 10, 2026 at 5:30 PM. The meeting included a consent docket, public comment on a preliminary plat, discussion and votes on zoning and plat items, and a postponement request. The commission also received a staff update on the upcoming code assessment release.

Consent Calendar

  • Item 1: Approval of the planning commission meeting minutes from August 13, 2026. Motion to approve, seconded, and passed unanimously.
  • Item 2 (PP-2627-4): Preliminary plat for 108th Avenue Business Edition was pulled from the consent docket for separate discussion.

Public Comments & Testimony

  • James Maxwell (property owner at 2601 120th Avenue SE, adjacent to the proposed Dollar General project): Expressed opposition to the preliminary plat due to concerns about the proposed aerobic sprinkler system (15–20 feet from his property line), potential sprayback and watershed onto his agricultural property, potential chemical treatment mishandling by Dollar General employees, impact on his use of the land (mulch, compost, wood, walnuts, acorns), and proximity to the Lake Thunderbird watershed (WQPZ). He also cited increased crime associated with Dollar General stores and noted that other jurisdictions require produce sections to mitigate crime. He requested the commission consider these issues.

Discussion Items

  • Item 2 (PP-2627-4): Commissioners discussed the distance from the proposed wastewater discharge to the WQPZ and a private well. Staff noted a 300-foot requirement from DEQ and a possible 200-foot requirement from city ordinance (section on water pollution hazard). The exact distance on the site plan was unclear regarding the adjacent property lines. Commissioner Steve raised the need to verify compliance. A motion was made to postpone the item to obtain accurate measurements and ensure all guidelines are met. Motion seconded and passed 6-0.
  • Items 3 & 4: Consideration of ordinance 0-2526-65 (rezoning from A2, PL, PUD to R1) and preliminary plat PP-2627-3 for Cedar Lane Edition. Staff and applicant presented. The project would add approximately 129 homes on one portion and 23 on another, with a total of 412 single-family homes and one commercial lot on 116.55 acres. A lift station would serve the area. Discussion included a commissioner questioning why the development is at lower density despite the AIM Norman plan designating the area as urban high (due to anticipated commuter rail stop). The commissioner voted no, citing the need for higher density to meet housing goals. The motion to approve passed 5-1.
  • Item 5 (0-2627-1): Rezoning for 201 West Apache Ward 4. Applicant requested postponement to the October 8, 2026 planning commission meeting. Motion passed 6-0.

Key Outcomes

  • Item 2: Postponed to a future meeting pending verification of WQPZ and well setback distances (motion carried 6-0).
  • Items 3 & 4: Approved (5-1) with recommendation to city council, noting that preliminary plats do go to council (clarified by staff later).
  • Item 5: Postponed to October 8, 2026 (6-0).
  • Staff Announcements: The upcoming code assessment (90-page document) will be released within the next week on NormanDevCode.com for public comment. A joint council and planning commission meeting is scheduled for October 6, 2026 at 5:30 PM in the executive conference room to review the assessment.

Note: The meeting adjourned without further discussion.
