Hello,

Speaker 1

0:04

hello, hello.

0:05

Ah, we can hear you loud and clear.

0:07

Thank you.

0:07

I assume you can hear us.

0:10

Okay, thank you.

Speaker 3

0:10

Thank you.

Speaker 1

0:11

All right.

0:12

Um, you're all set?

0:13

Yeah.

0:14

Ah, here's Emily.

Speaker 4

0:19

How are

Unassigned speaker

0:20

you?

Speaker 4

0:28

Good evening.

Speaker 1

0:30

Okay, I'm going to open the May 6th meeting of the North Southern Planning Board.

0:34

Um, first item on the agenda, the Grant Road LLC preliminary subdivision will be carried over to the June meeting.

0:43

We will uh next here a continuation of the Hollywoods preliminary subdivision.

0:50

And uh we have Jerry Alan, we have Alan in the audience.

0:57

All right, Alan Pilch.

0:59

Um in since the last meeting we received two emails.

1:04

Um the first one sent over the DEC information on the wetlands determination, and the second attachment was a DEC letter of no jurisdiction.

1:15

And then Alan sent another email today with uh resending the Han memo of January and the responses that were given to some of the points in that memo.

1:25

So perhaps with that, since we had an open question, if you'd like to summarize thank you, Alan.

Unassigned speaker

1:32

Hi, good

Speaker 5

1:33

evening.

1:33

I'm uh Alan Pilch from ALT Engineering.

Speaker 1

1:36

Can you raise that microphone a little bit?

Speaker 5

1:38

Thank you.

1:39

How's that?

1:41

Um so there were a few responses that we um provided uh today.

1:46

I'm sorry we missed that the last time, but um we were responding to comments from um from uh consulting and um basically the uh the questions were related to four of the structures which would be either within the town right-of-way or in the uh Holly Road dedicated conveyance strip.

2:10

And um I'll just say that we're presuming that for structures that are within the right-of-way that the town will be the agency to maintain those structures for whatever it is.

2:23

I mean, usually manholes are catch basins don't require a lot of maintenance, usually catch basins are just periodic cleaning, and that's about it.

2:31

But I presuming that would happen.

2:33

So in this way you won't have me going out there with a probar and pickaxe or whatever and shovel cleaning it out.

2:40

Um so I presume that would be the um uh that the town would assume responsibility for it.

2:46

One of the questions dealt with a discrepancy in the plat map of the limited disturbance area.

2:55

And when um Peter uh Gregory and I looked at it, we noted that there was a discrepancy in the um the meets and bounds in and two of the um of the uh portions of the boundary that were incorrect.

3:13

Um we you know we measured them and looked at them, and and so we had um uh Welsh uh Bill Welsh, the uh surveyor corrected, and in the current plat, that's before that was submitted and before the uh planning board, it is correct.

3:29

So I'll say the previous one, which was dated um February 28, 2025 was incorrect.

3:37

Apologize my letter said 2002.

3:40

I'm not quite that old.

3:42

Um, but the the 616 2025 plat map, which is the current one, is correct.

3:48

Um we also um corrected the revision dates on the plans.

3:54

All the plans that were been submitted have a revision date of um of March 10th, 2025, and uh that has been corrected as well.

4:04

Um would you like me to also just respond to the other?

4:07

Yes, please.

4:08

I could uh there was a comment regarding the proximity of the septic system uh to the property at 299 post road.

4:18

Um 299 post road is somewhat south west.

4:22

It's is to the southwest of that septic system.

4:25

It's adjacent to lot number one, which is the lot closest to Holly Road, and in reviewing it, and I'll just say what and I'll just hold this up because I actually Peter had sent Peter Gregory, who's a septic engineer.

4:40

He did send me, I know it's hard to read on this, but I can point it out maybe even with this.

4:48

We'll see if this works.

4:49

Well, nope, not on this.

Speaker 1

4:51

All right, we're talking about this septic system here.

Speaker 5

4:54

I'm talking

Unassigned speaker

4:55

about

Speaker 5

4:56

this septic system here.

Summary of Proceedings

North Salem Planning Board Meeting - May 6, 2026

The Town of North Salem Planning Board met on May 6, 2026, at 7:00 PM to discuss multiple subdivision applications, a tree ordinance amendment, and special permit provisions for land conservation nonprofits. The meeting included public hearings, final approval of a subdivision, a grant of extension, and work session items.

Consent Calendar

  • Grant Road LLC preliminary subdivision carried over to the June meeting.
  • Little Mountain – Second 90-day extension of amended freshwater wetland permit and stormwater management permit granted, extending from April 20, 2026 to July 20, 2026.
  • Financial Report for March 2026 approved.
  • Minutes of April 1, 2026 and April 15, 2026 approved.

Public Comments & Testimony

  • Hawley Woods Public Hearing: Alan Pilch (ALT Engineering) presented responses to previous comments, including correcting plat map discrepancies and addressing septic system proximity to 299 Post Road. Mark Sallas (299 Post Road) expressed concern about well contamination from the proposed septic system uphill and requested consideration of relocating the system. Wayne Fazinger (301 Post Road) also voiced concern about his well being 75–100 feet from the proposed septic area. Pilch noted all setbacks comply with Westchester County Department of Health regulations (100 ft down-gradient, 200 ft up-gradient). The board closed the public hearing and left the comment period open for 10 days.

Discussion Items

  • APC Group (4 Hardscrabble Rd) – Final Subdivision Approval: Tim Allen (Bivo Associates) presented the final plat. Board discussed outstanding items from MDRA and Han memos, including removing DEP references, filing NOI at time of building permit, and engineering inspection fees. Board approved the three-lot subdivision with minor amendments.
  • Bossi (2 Brookside Ln) – Landscape Plan: Jerry Barrett (landscape architect) detailed updates to the restoration planting plan based on MDRA memo, including deer fencing, removal of dock, and adjustment of plant quantities. Debate arose over monitoring period (3 vs. 5 years) and survival rates (100% vs. 85% for trees). Board directed staff to prepare a resolution with 5-year monitoring, 100% survival for red maples, and 85% for other plantings.
  • Tree Ordinance (Chapter 189): Board reviewed draft amendments including administrative permits for removal of 1 tree ≥36" DBH and up to 10 trees per 12-month period, exemptions for hazardous trees (with arborist certification), and tree fund concept (not carried forward). Items for further review: definition of hedgerow, invasive species removal, penalties, and fees. Draft to be reviewed by CAC and town attorney before town board.
  • Special Permits – Land Conservation Nonprofits: Discussion focused on parameters for structures (size, number), accessory caretaker apartments, events/fundraisers, and site access. Board expressed caution about housing for employees and large events. Consensus to present draft to town board for guidance before proceeding.

Key Outcomes

  • Hawley Woods: Public hearing closed; comment period open until May 16, 2026.
  • APC Group: Final subdivision approved (motion by Chair Curtis, seconded, all in favor) with three minor amendments (remove DEP references, NOI filed later, inspection fee at construction).
  • Little Mountain: Extension granted unanimously.
  • Bossi: Board directed Will to draft resolution of approval with 5-year monitoring and specific survival rates; resolution to be considered at June meeting.
  • Tree Ordinance: Draft to be reviewed by CAC and town attorney; board to later schedule town board appearance.
  • Nonprofit Special Permits: Board plans to present draft to town board for initial feedback.
