Okay.

0:04

All

Speaker 1

0:05

right.

0:05

I'm gonna call the North Salem Planning Board work session to order.

0:09

Um I'm gonna switch the order of the agenda because we have people here for number two, and nobody's expected for number one.

0:17

Right, the CAC is

Unassigned speaker

0:18

not

Speaker 1

0:18

coming tonight.

0:19

Yeah, okay.

0:21

So we're gonna discuss the special permits land conservation.

0:25

Um I don't have too much to add since the last meeting.

0:30

I just wanted to give everybody time to absorb the new um idea of we're only going to make this work for pre-existing structures for any land conservation group that uh inherits or purchases uh or is given um land over 50 acres in our town.

0:55

Um as I had mentioned previous meetings, there's

Unassigned speaker

0:58

two

Speaker 1

0:58

three, four, five, probably seven or eight parcels that could qualify for this um new thing that we're writing.

1:05

Um we certainly have a case of a pre-existing condition that we're trying to work through for the open land foundation.

1:14

So um and I think that we covered most of the concerns of the uh land the the open land foundation.

1:25

Um want to delve into any part of the last draft.

1:33

If not, I would like to give Will final instructions to um incorporate the pre-existing condition part to this draft.

Speaker 2

1:49

Um yeah, I like the pre-existing conditions because um there are parcels where things could grow if we don't do this, especially on Lake View, et cetera.

2:05

Um so I think it's it's worth doing.

2:09

Okay.

Speaker 3

2:10

Is there already is there already a conservation easement or whatever status protected space has?

Speaker 1

2:16

So conservation easements are different.

Speaker 3

2:18

Okay.

Speaker 1

2:19

Conservation easements the um, let's say I owned a hundred acres and I wanted to protect the back 50 of my property.

2:28

I would um offer a conservation easement either to the town of North Salem or to a qualifying land conservancy.

2:36

They would run it through their um criteria to make sure it meets their um, they have to follow certain rules on accepting conservation easements.

2:45

That conservation easement can be different for every parcel in town.

2:50

Some conservation easements we've seen would allow one or two farming structures.

2:55

Some say absolutely no development, some say we can have public walking trails, some say absolutely no public walking trails, supposed to stay in its natural state.

3:05

So the two parties that are involved with the conservation easement, they work out the particulars and the terms of that conservation easement.

3:14

We are not talking about those lands here necessarily.

3:17

We are talking about lands that are owned by the um conservation group.

3:24

It could possibly be that there is a conservation easement, and it's said

Unassigned speaker

3:29

that

Speaker 1

3:29

you can do whatever you want, but it's I don't think it's gonna meet the requirements of the person of the entity accepting the conservation easement, that you can start putting structures on it.

3:40

But

Unassigned speaker

3:40

you

Speaker 1

3:40

know, I'm not a conservation easement attorney, you know.

Speaker 3

3:43

It it it occurred to me that as we're we're trying to avoid setting precedents that one might regret with unforeseen, you know.

3:51

Um

Speaker 1

3:53

if it's a pre-existing structure on a conservation easement, then it's well didn't it might it what if if that conservation easement allowed a use that they are contemplating, um then it might qualify because it's land that is under the control of a land conservation group.

Speaker 3

4:12

It it and if I could ask, I don't know if anyone has the answer.

4:15

Was the intent that this uh gifted plot uh be in any way designated as you know uh the uh wild space was conservation easement ever brought into that in the first place?

Speaker 1

4:29

In in the case of the piece of property that triggered this, um it's my understanding there were no uh restrictions.

Unassigned speaker

4:37

It

Speaker 1

4:37

was gifted to the open land, it had structures on

Unassigned speaker

4:40

it,

Speaker 1

4:41

um, and they're allowed to use it in the I think there were expectations, but oh good.

4:47

Joyce is gonna give a more accurate explanation.

4:50

We can go through that.

Unassigned speaker

4:53

Hi,

Speaker 4

4:54

and just for the record, Joyce Light's executive director of Open Land Foundation.

Unassigned speaker

5:00

Um, yeah, the donor the property that um the wild preserve was donated with no restrictions to us, um, and so there's no conservation easement on it, and there are no restrictions for the use of that property.

Speaker 4

5:12

Um so that that doesn't take that into account.

5:16

I know last week we were talking about uh the Franklin Fells property as a potential other property that does have a conservation easement on it that does restrict structures being constructed on it, um and where secondary responsible for um for that conservation easement.

5:35

Um and I have I think I have only the an older draft of the language.

5:41

I just have one question on if we're working off of April 22, a pretty old draft.

5:47

Okay, you are working off the same draft item then, yeah.

Summary of Proceedings

North Salem Planning Board Work Session - July 15, 2026

The North Salem Planning Board held a work session on July 15, 2026, beginning at 7:00 PM. The agenda was reordered to first discuss the proposed Special Permits for Land Conservation, as no one was present for the AT&T Mobility Corp. item. The second major item was Chapter 189 (Tree Ordinance) amendments, clearance form, and FAQ.

Discussion Items

Special Permits – Land Conservation

  • The board continued drafting a new zoning provision allowing land conservation organizations (e.g., Open Land Foundation) to use pre-existing structures on parcels of 50 acres or more for administrative offices, caretaker apartments, and meeting spaces.
  • Key points of discussion included:
    • Pre-existing structures only: New fully enclosed buildings would not be permitted; only existing structures on parcels 50+ acres could be adapted for non-residential uses.
    • Minor new structures: Small accessory structures such as gazebos, pavilions, animal turnout shelters, pedestrian bridges, walkways, and kiosks could be allowed on parcels of any size, subject to underlying bulk requirements.
    • 50-acre threshold debated: Parcels under 50 acres with existing houses could only continue residential use; no new non-residential uses except the minor structures listed above.
    • Agricultural uses and animal keeping were discussed; the board noted that existing town codes on animal limits and special permits still apply.
    • Events and parking: The board considered limiting the frequency and size of public events, requiring on-site parking (with special event parking on fields permissible a few times per year), and neighbor notification.
    • Joyce Light (Executive Director, Open Land Foundation) and John Baker (former Executive Director, North Salem Open Land) participated in the discussion, providing context on existing properties and operations.
  • The board directed Will (code consultant) and Dawn to prepare a revised draft incorporating the board’s guidance, including specific allowances for minor structures and controls on events and parking.

Chapter 189 – Tree Ordinance

  • The board reviewed the draft Tree Removal Clearance Form and FAQ document.
  • Suggested edits included adding "sheet, lot, and block" space, clarifying that removal of more than 10 trees (dead or live) requires a Planning Board permit, and improving language clarity (e.g., defining DBH, making full sentences in FAQ answers).
  • The board discussed whether the clearance form should require a fee; the consensus was that no fee should be charged to encourage voluntary compliance.
  • The board agreed to refer the three documents (proposed amendments, FAQ, clearance form) to the Town Board for consideration.

Key Outcomes

  • Motion passed unanimously: To refer the Tree Ordinance amendments, FAQ, and clearance form (as amended per board comments) to the Town Board. No opposition.
  • Next steps for Land Conservation: Will and Dawn will produce a revised draft based on the board’s discussion, to be reviewed at a future work session.
  • Next meetings: The board discussed scheduling a regular meeting on August 5 or 12, and a work session on August 19, with final dates to be confirmed based on availability.
