Recording in progress.

Speaker 2

2:00

Yes, good idea.

Speaker 1

2:01

All right.

2:01

So before we take the first one, I'll just say that um because there's only three members of the board uh this evening, the three board members, um the any vote will be required to be unanimous.

2:13

Uh so any um applicant who wishes um to not depend on a unanimous vote uh may um uh put their the application towards next month um with no prejudice, no no extra fees or anything like

Unassigned speaker

2:30

that.

Speaker 2

2:31

Okay,

Speaker 1

2:32

good.

2:32

All right, so BA twenty twenty-six is uh Michelle Benny Harkins three thirty-eight Heart Scrabble Road, uh special permit to allow the keeping of livestock for personal use.

2:57

In an R4 zoning district consisting of approximately eighteen acres per Article 13, section two fifty-seventy-two.

3:05

Uh for good cause shown, the Board of Appeals may reduce the setback requirements to no less than minimum required setback of the principal use.

3:13

BA 0728 was granted to previous owners for keeping of animals in an existing barn less than 150 feet from the property line.

3:23

Okay.

3:24

And for the record, just your name and address.

Speaker 4

3:26

Um Michelle Berkins, 338 Hard Scrabble Road.

3:30

Okay.

Speaker 1

3:32

So just quick synopsis of your application.

Speaker 4

3:36

Well, yes, so the reason that I'm putting the the proposed barn there is so that we would have access to the existing barn that's already there, which will um have the hay and straw and the the non-living things and will be much easier for the people who come and clean and feed them to get to them, including me.

3:57

Um, specially net it would be very useful to have it nearby.

4:03

A so that all the buildings are sort of in one grouping, so it disturbs less of the sort of general beauty of the property.

4:14

And the other reason is that um uh for uh the man Freddie's property next to us, they have their barn sort of grouped pretty close by so that all both of us are gonna have a sort of section with all the barns, all the same color and the same style.

4:30

Um these Amish barns that that that uh so they all they're going to look very harmonious and all be clustered, so not spread all over the place.

4:40

So I think that it's the best place for practicality and for looks.

Speaker 1

4:44

Okay, good.

4:45

Yeah, I think it makes a lot of sense.

4:46

Buildings group together, it's more efficient, makes for a better operation.

4:50

Right.

4:51

It looks better, looks more natural, like a barnyard type of situation.

4:55

Um I'm gonna I had one question.

Unassigned speaker

4:58

What I mean the application is just livestock.

Speaker 1

5:01

What uh what what livestock is planned there?

5:04

Is it horses or is it something else?

Speaker 4

5:06

I don't have horses.

5:07

I have uh I I rescue donkeys, so I've got donkeys and goats.

5:12

Okay, miniature goats.

Speaker 5

5:13

Okay.

Speaker 4

5:14

And uh so that's what we plan.

5:17

I mean if one day there might be a horse, or if my grandchildren would like to ride, or if my daughter decides she's gonna take it up if I get brave enough to go back in the saddle.

5:28

Um I would actually I really would like to.

5:31

So there may be one horse or two horses, but unless my daughter's granddaughters become you know horse mad, and that that could change in the future.

5:39

But at the moment it's just um the the bond that I have is not really adequate for keeping them.

5:45

We've had really rough winters, and um they're all getting on.

5:51

So uh I just want them to be comfortable and I want a properly insulated barn and uh one that would be easy to clean, easy to maintain, give them all

Summary of Proceedings

North Salem Board of Appeals Hearing - August 13, 2026

The Town of North Salem Board of Appeals held a public hearing on August 13, 2026, at 7:30 PM at the Town Meeting Hall, 66 June Road, and via Zoom. Only three board members were present, requiring unanimous votes. The board approved two special permit applications: one for livestock keeping with a setback reduction, and one for renewal of a commercial horse boarding operation, subject to conditions on property tidiness.

Consent Calendar

  • Acceptance of Minutes: The minutes of the July 9, 2026 meeting were approved unanimously.
  • Next Meeting Date: The next Board of Appeals meeting was set for September 10, 2026.

Public Comments & Testimony

  • No members of the public spoke or submitted comments on either agenda item.

Discussion Items

BA26-26 – Michele Beiny Harkins (338 Hardscrabble Road) – Special Permit for Livestock

  • Applicant Michele Harkins requested a special permit to keep livestock for personal use on an 18-acre R-4 zoned property. She proposed a four-stall barn located within 150 feet (but not less than 75 feet) of the property line, seeking a setback reduction for good cause.
  • Harkins explained that the barn would be placed near an existing barn to group buildings for efficiency, aesthetics, and to align with a neighboring property's barn cluster. She stated she rescues donkeys and owns four donkeys and four miniature goats, with the possibility of adding one or two horses in the future.
  • Board members expressed support, noting that grouping buildings improves operation and appearance. The board found good cause for the setback reduction based on proximity, efficiency, and safety.
  • The board determined the project is a Type II action under SEQRA and required referral to the Westchester County Planning Commission (noted as having been sent).

BA26-27 – Ralph Schlosstein & Jane Hartley (15 Turkey Hill Road) – Renewal of Special Permit for Horse Boarding

  • Attorney Ron Bryan from Petensky Law represented the applicants seeking renewal of Special Permit BA15-03, which allows up to 16 horses and commercial boarding on a 43-acre R-4 property. No new construction is proposed.
  • Bryan submitted an affidavit of compliance, a fire inspection approval dated July 14, 2026, and noted that all original conditions have been met. The barn has 16 stalls but currently houses 9 horses. A manure removal vendor collects from a dumpster on site, and the caretaker lives full-time in a cottage.
  • Board member Cindy noted that the caretaker's cottage (gatehouse) at the road had become untidy, with furniture, garbage, and equipment stored outside. She requested that the area be cleaned up and maintained, which the applicants agreed to.
  • The board considered the renewal standards, noting the operation has been continuous since at least 2005 and is harmonious with the area. The renewal is a Type II action under SEQRA; no referral to the county planning commission was required (though notification was sent).

Key Outcomes

  • BA26-26 – Approval: The board voted unanimously (3-0) to find the project a Type II SEQRA action and to approve the special permit with the setback reduction. Motion by Cindy, seconded by Rick.
  • BA26-27 – Approval with Conditions: The board voted unanimously (3-0) to find the renewal a Type II SEQRA action and to approve the renewal of the special permit, conditioned upon the applicants tidying the exterior of the gatehouse/cottage at 15 Turkey Hill Road, including storing equipment and garbage in the garage, removing outdoor furniture, and maintaining a neat appearance. Motion by Cindy, seconded by Rick.
