The Board of Zoning Appeals met on August 28, 2025, at 6:00 p.m. in City Hall. The meeting included the election of a secretary, approval of prior meeting minutes and findings of fact, a one-year extension request for a downtown hotel project, and a public hearing for a mobile home replacement. - Public Hearing – BZA 2727 (Clayton Homes): The applicant requested two special yard exceptions for a new manufactured home at 41 Canal Overlook Lane (Lot 8A, Warren’s Park Mobile Home Park): 0.3 feet from the front lot line and 0.4 feet from the side lot line. Note: The staff report initially misstated the first request as “side lot line”; the applicant corrected the record, confirming the front yard request. The property is in the MH (Mobile Home) Zoning District, and the existing home was legally nonconforming. The proposed home would not encroach further than existing nonconforming homes on adjacent lots and would maintain the required 10-foot separation. The applicant testified that the placement was the best possible design given the small lot dimensions. No public testimony was offered. The board approved both exceptions by a vote of 4-0-1 (John Moran abstained).

28th, 2025. Our first item on the agenda tonight. We have a quick election. I just want to very briefly uh thank Brian Shane for his service to the people of Ocean City by serving on the Board of Zoning Appeals. He's going to be missed up here. And you know, we wish Brian well in all his future endeavors. So with that, I'd like to open the floor for a discussion and a motion or a nomination rather amongst the membership up here to determine who's gonna fill the secretary position on the board. Um so I'm I'll just I'll just go right ahead and begin. Um I'd like to nominate uh Miss Emily Nock for the position. Um so if there's any further nominations or discussion, uh the floor is open. No discussion. The discussion. No discussion. And uh Miss Knock, uh, do you accept the nomination? I will accept the nomination. All right. Um yes, yeah. So um Miss Knock has accepted nomination. Um so do we need to take a second on that, Maureen? Or since you're the president, have someone else make the motion and second and then vote. Okay, all right. So my nomination has been made clear, and Miss Knock has accepted the nomination. So we need a motion in favor of Miss Nock's nomination and a second for the nomination to carry. Say I'll move that uh Ms. Nock Nock be the uh secretary of the board. Okay, we have an affirmative motion by Mr. Moran. Is there a second or further discussion? I'll second it. All right, second by Mr. Stevens. Um we'll third that. Okay. So noted. Um all in favor of Miss Nock being uh secretary of the board signify by saying aye. Aye. Aye. All opposed, seeing none. Uh Ms. Nock is unanimously elected as secretary of the Board of Zoning Appeals. So congratulations. All right. Okay. Um to our second item, uh, administrative matters. We have the uh minutes from the July 24th meeting. All of these are uh can be found in your packets up here. Um I re I've reviewed these and I have didn't see any issues. So um the floor is open for discussion and a motion. I have no comment on them. I move that the findings of fact for the meeting of July 24th, 2025 and BZA 2724 be accept approved.
