First on the agenda are the approval of the minutes.

0:17

Go ahead.

0:18

0:19

Yeah, I'll make a motion and approve the minutes, please.

0:21

Second.

0:22

0:27

And we have a public hearing this evening pursuant to the provisions of Article 2, Section 5, Conditional Uses.

0:35

A request has been filed under the provisions of section 110 544.

0:40

Uses permitted by conditional use in the SC1 shopping center zoning district by reference to Section 110 514 22.

0:51

Uses permitted by conditional use in the L C One Local Commercial Zoning District that the Mayor and City Council may approve a use not specifically named in these regulations, provided, however, that such use shall be in keeping with uses specifically permitted in the LC1 district to permit the operation of a water taxi business, ticketing and sales office, and docking of water taxi boats at the head of the east end of the lagoon leading to Asawoman Bay.

2:23

21842.

2:25

Thank you.

2:26

Thank you.

2:27

Um, I'm the zoning administrator, and quickly I just want to start out with this planning commission meeting to talk about.

2:35

We're still in public hearing, but I wanted to talk about the history of land use and why we're here today.

2:41

And if you can see, this is from land use in a nutshell, and it talks about in the Roman period around 450 BC that there was the 12 tables, and whoever sets a hedge around land shall not exceed the boundary.

2:55

In the case of the wall, he shall leave one foot.

2:58

In the case of the house, two feet, but well, a path, an oliver fig tree, nine feet.

3:04

So that was important 400 like 2,000 years ago.

3:07

So what we're doing today and what you all do on a regular basis helps protect our land and our people.

3:14

So we'll get right back into this.

3:16

And um, we did the minutes, and I also um I had emailed everybody, the planning commission members, and um put on to our public forum the agenda for today.

3:35

So everybody got a copy of it, and then the public out in the community can be able to follow along with us, so you'll be able to see it on your screen today.

3:44

So here is our um the staff report and myself again.

3:50

I'm Sabrina Hecht of the Zoning Administrator, and we have George Venler, he is the planning and zoning commission, planning and zoning director, and Chase Phillips is our senior zoning analyst.

4:05

So the Department of Planning Community Development has reviewed the conditional use application submitted by Stephen Butz for the OC Bay Hopper Blue Binemy Incorporated, which proposes to continue the conditional use as a water taxi service upon submission of the application on September 3rd.

4:24

And we have Stephen Butts here today, and uh the property description is OC Bay Hopper 11703 Ocean's Coastal Highway, Ocean City, Maryland 21842.

4:36

The subject property is described as a water taxi service.

4:41

The zoning classification is shopping center SC1 and local commercial LC1.

4:47

And the lot area is land building and a floating pier.

5:00

The request is to renew the conditional use permit 119-1210001 and number 20-1210001 for the purpose of operating a water taxi business, ticketing and sales office, and the docking of water taxi boats at the head of the east of the lagoon heading to Asawomen Bay in its current location 11703 Coastal Highway Ocean OC Hopper operates two pontoon boats 28 by 2.

5:25

So the project history received port warden approval on January 10th, 2019, planning and zoning conditional use approval on February 20, 2019, Mayor and City Council approval on March 18, 2019, conditional use approval was signed on April 11th, 2019, conditional use approval update at two years to renew every five years on October 19th, 2020.

5:56

Business license is valid through May 31st, 2026, and the insurance is valued valid through May 1st, 2026.

6:07

So here we are at our five-year renewal.

6:11

The following uses are permitted by conditional use in accordance with Article 2, Division 5 of the chapter.

6:16

Any use permitted by conditional use in the LC1 commercial district shall be permitted by conditional use within the SC shopping center district, except those which appear either as a permitted use or accessory use within the SC shopping center district.

6:32

So the proposed use consists of a ticket office in an existing kiosk building and Coast Guard approved passenger boats that will dock at the privately owned bulkhead in a large canal basin.

6:45

The office kiosk is compatible with uses permitted in the shopping center SE1 district.

6:50

The passenger boats will operate in the tidal waters of the canal and bay with other privately owned vessels.

6:56

The planning commission believes the conditions listed below will help ensure that the passenger boats are operated safely and appropriately as they navigate the canal near the residential communities.

7:08

So this is consistent with the comprehensive plan, both in 2017 and our 2025 draft, which you will hear next week.

7:16

The waterways will continue to provide recreational benefits and possibly limited amount of transit.

7:23

A baside water taxi faring tourists from the north to a location near the inlet could serve as a useful due purpose.

7:30

This service would provide relatively rapid transit and a guided tour of the baside at the same time.

7:38

The water taxi concept could also be used from Ocean City to the mainland, possibly Ocean Pines.

7:44

The water taxi's impact on the overall transportation situation may be small, but it would provide an interesting addition to Ocean City's recreational opportunities and could become its own attraction.

7:55

Opportunities to promote such a water taxi service and link in such services to land-based transit alternatives should be explored.

8:04

Any private sector interest in developing a water taxi service should be encouraged.

8:09

So again, that was in 2017.

8:11

We're here in 2025.

8:12

That's going to be updated until it's updated.

Ocean City Planning and Zoning Commission Meeting – October 7, 2025

The Planning and Zoning Commission met on October 7, 2025, at 6:00 p.m. in City Hall. Commissioners Joe Wilson, Pam Robertson, and Palmer Gillis were absent, so Secretary Janet Hough acted as Chair. The meeting included approval of previous minutes, a public hearing on a conditional use renewal for OC Bay Hopper, and a discussion of potential changes to off‑street parking regulations.

Consent Calendar

  • Approval of September 3, 2025 Minutes – Motion by Gordon Kretser, second by Tony Butta, passed unanimously (4‑0‑3 with three members absent).

Public Comments & Testimony

  • Public Hearing – Conditional Use Renewal for OC Bay Hopper – No members of the public offered comments during the public portion. The applicant, Stephen Butz (owner/operator of OC Bay Hopper), testified under oath. He stated that the business has operated continuously since 2019, transported over 12,000 passengers in the past year with no accidents or incidents, and has received only three complaints in five years (all related to speed, which were addressed). He expressed willingness to install a life ring and a bike rack as additional safety and transportation improvements. The Commission noted that the business is compatible with the Comprehensive Plan and the surrounding neighborhood.

Discussion Items

  • Conditional Use Renewal for OC Bay Hopper (PZ File #25‑12100002) – Staff presented a summary of the request to renew the water taxi conditional use at 11703 Coastal Highway. The Commission discussed the need for a life ring near the dock and a bike rack on site. Commissioners emphasized that the use reduces traffic and parking demand, aligns with the Comprehensive Plan, and has ample parking. The Commission added two conditions to the staff‑recommended list: (1) installation of a life ring, and (2) provision of a bike rack at a location to be approved by the Zoning Administrator. A motion by Tony Butta, second by Kevin Rohe, to recommend approval to the Mayor and City Council with all conditions passed unanimously (4‑0‑3).
  • Off‑Street Parking Regulations (Sec. 110‑932) – Planning Director George Bendler opened a discussion about revising minimum parking requirements for commercial properties, particularly restaurants. He noted that the current code counts all square footage (including kitchens, dish rooms, and walk‑ins) for parking calculations, which can hinder small businesses. The Commission explored alternatives such as basing parking on public seating area rather than total square footage, and considering location‑specific standards (e.g., downtown vs. north Ocean City). No action was taken; the discussion was a precursor to a winter work session on the topic.

Key Outcomes

  • Conditional Use Recommendation – The Commission voted 4‑0‑3 to recommend that the Mayor and City Council approve the renewal of the conditional use for OC Bay Hopper, subject to the following conditions (including two new conditions):
    1. Docking limited to private commercial properties unless approved for public facilities by Mayor and City Council.
    2. No amplified noise (music or crew announcements) in residential areas adjacent to the canal or at the ticket kiosk.
    3. Boats must operate at posted speed and comply with Coast Guard regulations.
    4. Boats must be appropriately sized for narrow canals.
    5. Floating dock posted for OC Bay Hopper only.
    6. Only two passenger boats may be docked at the floating pier.
    7. Conditional use must be renewed every five years from the date of the signed agreement.
    8. Life rings shall be readily available within the docking area.
    9. Bike racks shall be provided on site, with location approved by the Zoning Administrator.
  • Parking Regulation Discussion – The Commission will continue to study potential changes to commercial parking standards, with a goal of bringing incremental recommendations to the Mayor and City Council later in the year.
  • Next Meeting – Scheduled for October 21, 2025, at 6:00 p.m. to hold a public hearing on the Comprehensive Plan update and a driveway apron ordinance amendment.
