Corrections?

0:24

Motion from Tony, second from Janet.

0:26

Any discussion?

0:28

All those in favor?

0:29

All right.

0:30

Motion carries unanimously.

0:31

Up next, uh site plan approval.

0:35

Okay.

0:38

Bill, could you go back to the good good evening, Planning Commission members and audience?

0:47

I'm Sabrina Hecht.

0:48

I'm the zoning administrator for the town of Ocean City.

0:51

And the first item on the agenda is let me get down there.

0:56

Should be up on the board for not only our audience members to see, but people online.

1:02

So this is a site plan review for proposed tenant fit out.

1:05

The site of this application is described as part of tax map 110, parcels 2652, 2654, 2655, and 2656 for site plan review for the Jell R Corporation, changing from retail to restaurant at 106 South Atlantic Avenue, Ocean City, Maryland, 21842.

1:25

Off-site parking lot at 5 Caroline Street, Ocean City, Maryland to accommodate the required parking calculations.

2:06

This fit out was previously a restaurant with parking approvals that changed to retail and now is going back to a restaurant.

2:14

Parking for restaurants is higher than retail, and parking was accounted for in previous BZA cases.

2:21

And then as so as we go down this, if you've read it ahead of time, um Bill, who's here, put together uh extensive in information on which beast VA case for number of parking spaces for that lot in the retail, and we can go on and on.

2:39

So if you have any questions, um, I also have uh Joe Moore, the attorney here, and well, you wrote that in, yeah.

2:51

Yeah, okay.

2:51

So if you have any questions, you can stop me or if they he needs to come up and ask.

2:56

Okay, so the zoning classification is the B1 boardwalk commercial district.

3:02

Um, the lot area 30,000 square feet for restaurant, read retail amusements, which is currently there, and parking.

3:09

The 5,000 square foot building fit out for a new restaurant, which was previously retail and previous previously a restaurant.

3:17

Parking off-site 27 spaces on site 16 for a total of 43 spaces.

3:24

And then as you go through this, you're gonna see where it says 42 spaces because that's actually what's required, but they're giving one more space.

3:32

So it's not that I did a typo, it's that what's required and what they're providing.

3:39

Okay, the seating and use for 139 people total, expansion of a dumpster pad, and 42 code compliant parking spaces required total for all uses.

3:50

So that includes the current purple moose saloon, the new restaurant, and then the arcade.

3:57

So following the technical review committee that was held on December 9th, 2025.

4:03

Um, the applicant provided a draft deed of dedication for parking, uh, the screening of a dumpster on three sides, the fire marshal requested to move the fire department connection a few feet to the south, plantings for off-site parking lot for environmental, and replace the chain link fence with a white picket fence along Caroline Street for the off-site parking because that's as you come into Ocean City, and then provide a bike rack on site.

4:32

All of those items have been met with the updated um site plan.

4:37

So those are we reviewed the site plan for one through 15.

4:43

Um, and you know, I went through the uh boardwalk commercial district district and kind of highlighted what is the purpose of it.

4:51

The purpose of this district is to provide an area for commercial uses whose clientele is almost exclusively pedestrians, special design criteria and parking requirements are appropriate for this district.

5:00

Special design criteria and parking requirements are appropriate for this district.

5:03

Residential development is to continue at relatively high intensity.

5:08

So permitted uses, restaurants, cocktail lounges, taverns, outdoor cafe dining.

5:14

Off street parking spaces.

5:16

Off street parking spaces shall be provided in accordance with the provisions contained of this chapter.

5:22

And off-street parking, I'm sorry, I must have double tapped on that one.

5:28

Building height shall be no more than 50 feet and shall be no more than five stories.

5:33

So it's 13 feet for the new restaurant, but the actual whole building itself is at 15 feet where the purple moose saloon is.

5:40

It kind of just steps up, so it meets those requirements.

5:45

The comprehensive plan and the strategic plan of full pulled a few things out of here.

5:52

Orderly real estate development that enhances the town and generates support required services, promote the redevelopment of properties and locations that are underdeveloped or obsolete, support small businesses, encourage and promote quality restaurants with a broad range of cuisines, which I'm still not sure what the restaurant's gonna be, but maybe that's a secret.

6:15

But um we'll we'll know that soon enough.

6:17

And then expand the range of tourist attractions to include entertainment venues, quality restaurants, and boardwalk activities.

6:25

Okay, so then the purpose of off-street parking is to lessen or prevent congestion on public streets and thoroughfares, and to promote the safety welfare of public by establishing minimum requirements for off-street parking of motor vehicles in accordance with the use of the land.

6:43

The number of parking spaces required herein for uses and activities has been varied according to location and intensity of development of the particular district classification.

6:54

So here we are on the boardwalk, and we do have a very large public parking area, a couple of them from the inlet, you know, up to third street.

7:05

So there is places.

7:06

So over the years, the purple moose and the Jell R Corporation has gotten BZA approvals and also nonconformities.

7:17

And then we're gonna talk then, let's see, restaurants, fast food restaurants, cockdown lounges, tavern or nightclubs, or other establishment establishments for the consumption of food or beverages on or off premises, one space per 100 square feet of enclosed gross area, minimum of five spaces with the following modifications, but they're not going to do any outdoor dining, so that does not include that.

7:40

So the parking calculations and requirements.

7:57

Talk about signing, umage, uh, off-site parking lot parcels shall be consolidated.

8:06

This is all conditions for approval.

8:08

The off-site parking lot shall be deed restricted by recorded covenant, that's five.

8:14

Um, standard for providing location of transformers.

Ocean City Planning and Zoning Commission Meeting – January 21, 2026

The Ocean City Planning and Zoning Commission met on Wednesday, January 21, 2026, at 6:00 PM in the Council Chambers to consider several site plan and subdivision applications. The Commission approved a site plan for the Purple Moose Saloon expansion (retail-to-restaurant conversion), granted preliminary subdivision approval for two Atlantic Avenue properties, and approved site plans for duplex developments on both sites. All votes were unanimous except where noted.

Consent Calendar

  • Approval of December 16, 2025 Minutes: The Commission unanimously approved the minutes from the December 16, 2025 meeting (motion by Tony Butta, second by Janet Hough).

Discussion Items

  • Site Plan – Jelar Corporation (Purple Moose Saloon Expansion): Staff presented a proposal to convert a 3,991 sq ft retail space at 106 S. Atlantic Ave into a 139-seat restaurant. The applicant provided 43 parking spaces (16 on-site, 27 off-site at 5 Caroline St) to meet code requirements. Staff noted that prior BZA special parking exceptions (spanning from 1974 to 2023) covered the needed spaces. Conditions included a deed-restricted off-site parking lot, dumpster screening, fire department connection relocation, landscaping, a white picket fence on Caroline Street, and a bike rack. The Commission unanimously approved the site plan with conditions.
  • Preliminary Subdivision – 8303 Atlantic Ave: The applicant, 83rd Street Development of Ocean City, LLC, sought to subdivide the 7,000 sq ft lot (improved with a single-family dwelling) into two parcels for duplex development. Staff found the plat met code requirements. The Commission approved the subdivision (6-0-1, with Tony Butta abstaining due to a conflict of interest as his brokerage represented a party to the transaction).
  • Preliminary Subdivision – 8305 Atlantic Ave: The same applicant requested subdivision of the adjacent 7,000 sq ft vacant lot into two parcels. The Commission approved (6-0-1, Butta again abstaining).
  • Site Plan – 8303 Atlantic Ave Duplexes: The plan proposed two 3-story fee-simple duplexes with habitable attics, each containing 5 bedrooms and 4 tandem parking spaces (8 total). The building height was 40 feet, meeting the 50-foot maximum. Staff conditions included adherence to the building limit line, alley improvements, lighting compliance, and trash service. During discussion, the architect explained that stair clearance over parking spaces exceeded the required 7 feet. Commissioner Gordon Kretser suggested adding a storage area on the ground level, which the architect noted as a potential improvement. The Commission approved the site plan (motion by Tony Butta, second by Kevin Rohe; all in favor).
  • Site Plan – 8305 Atlantic Ave Duplexes: An identical duplex project was proposed on the subdivided vacant lot. The plan mirrored the 8303 design. The Commission approved (6-0-1, Butta abstaining).

Key Outcomes

  • Unanimous approval of the Purple Moose site plan (all commissioners present voted aye).
  • Preliminary subdivision approvals for 8303 and 8305 Atlantic Ave passed 6-0-1 (Butta abstained on both).
  • Site plan approval for the 8303 Atlantic Ave duplex (6-0-0; Butta made the motion and did not abstain).
  • Site plan approval for the 8305 Atlantic Ave duplex (5-0-1; Butta abstained).
  • All approvals are subject to the conditions outlined in the staff reports and applicable town codes.
