On May 13, 2024, the Olathe Planning Commission convened with eight of nine commissioners present. RZ24-0007: Primrose School of Olathe – Rezoning and Preliminary Site Development Plan
- Location: Southwest corner of 158th Street and Hunter Street (3.74 acres).
- Request: Rezone from RP-1, CP-1, CP-O to C-1 (Neighborhood Center) District; approve preliminary site development plan for a daycare (lot one) and future commercial building (lot two).
- Staff presentation (Andrea Fair, Planner 2): Noted consistency with Plan Olathe's complete neighborhoods and walkability goals. Three waivers requested: (1) reduced front setback (60 feet) due to play area/irregular lot shape; (2) decreased clear glass percentage on facades, offset by additional architectural details; (3) increased parking from 17 required to 43 spaces to accommodate 28 staff and drop-off/pick-up needs. Staff supported all waivers.
- Commissioner questions: Concern about detention issues (deferred to final site plan); parking adequacy for staff and parents; and a single access point (applicant confirmed no second entrance needed). Applicant held a neighborhood meeting on April 8, 2024, with seven residents attending; topics included traffic and design.
RZ24-0009: Olathe Family Dental – Rezoning and Preliminary Site Development Plan
- Location: 355 South Parker Street (0.74 acres, existing car wash).
- Request: Rezone from R-1 and CP-3 to C-1 (Neighborhood Center) District; adaptively reuse existing building for dental office.
- Staff presentation: Site improvements include reducing impervious surfaces, adding landscaping, removing old canopy/vacuum structures, and updating facade with stone veneer and storefront glass. Use restrictions recommended to maintain compatibility with nearby residential. Neighborhood meeting held on April 22, 2024, with no attendees.
- Commissioner comments: A commissioner noted a long patronage of the dental practice and expressed concern about parking. Applicant (Judd Clausen, Phelps Engineering) confirmed parking will be maximized using existing pavement with new islands, and that the number of spaces will exceed the current location.

As we begin our meeting this evening, we'll take a moment to acknowledge we have a quorum of planning commissioners present with eight of nine commissioners in attendance. Uh Chairperson Wayne Janner is absent this evening. Thanks to everyone for attending in the chamber for tonight's meeting. Planning commission meetings are an important part of the process for interpreting and applying the city's comprehensive plan and unified development ordinance. It's important that our meetings are conducted with dignity and respect. That applies to every person in attendance. We strive to provide an atmosphere where the ideas and opinions of all participants are held in the highest regard. Finally, the actions on the issues we discuss are ultimately under the responsibility of the city council. As a planning commission, we're here to help the council as our elected representatives to be fully informed to make the best choices for our city. By statute, the planning commission strives to not engage with any party on the issues on our agenda prior to our meeting. Should that interaction take place as a result of a business relationship or other interaction referred to as ex parte communication, commissioners will report that interaction when we reset item in the agenda this evening. We will now move on to the consent agenda, which we have four items on this evening. Commissioners, do we have any items that we need to pull for additional questions or discussion? The first of which is a request for an approval of a rezoning and preliminary site development plan for Primo School of Olatha, southwest of 158th Street and Hunter Street. Ms. Fair will present the case. Ms. Fair. Good evening, Commissioners. Andrea Fair, Planner 2. As introduced, the following is a request to rezone lots one and two along with the preliminary site development plan for Primrose School. The property is located at the southwest corner of 158th Street and Hunter Street, highlighted here in yellow. The development includes two commercial lots located on 3.74 acres. The property is part of the larger Asbury Commercial Center commercial area, as you see here outlined in black. The overall development has begun to develop with the country kids' daycare located in the northeast portion of the development. A rezoning and site development plan were approved for lot four in October of 2023 and will allow for the construction of a bank and a separate multi-tenant building on April 29th. An application for rezoning and a site development plan was recommended for approval for tract A by the Planning Commission and will go before City Council on May 21st, 2024. The subject property is currently zoned RP1, Planned Single Family Residential, CP1, Planned Retail Business, and CPO Planned Office, and is requesting to rezone to the C One neighborhood center district, which provides for greater variety of neighborhood focused commercial uses and services. The C One district is also consistent with the applications previously mentioned adjacent to the subject property. The future land use map of Plan Aletha identifies the subject property as conventional neighborhood, which typically consists of single family housing. However, as provided in Plan Oletha, the neighborhood centers are typically distributed throughout Olatha neighborhoods to provide local access to convenience convenience goods and services, reduce the need for lengthy drives, and promote walkability. The proposed C1 district does align with other policies of the Plan Aletha regarding complete neighborhoods, high quality design, and a mixture of complementary land uses. So the C One District does permit over 70 land uses that provide convenient goods and services called for by Plan Olatha. This rezoning is compatible with the adjacent commercial and office districts already found in Asbury Center. However, some use restrictions are recommended, which is consistent with the overall restricted uses within the development.
