The Olathe Planning Commission met on Monday, February 24, 2025, with six of nine commissioners present. Commissioners Bergita, Chapman, and Tronis were absent. - Olathe Commons Third Plat (FP24‑0041) – Public Hearing: Senior Planner Nathan Jury presented the request for approval of a final plat with vacation of existing easements and dedications. The site is located southeast of 119th Street and Black Bob Road. The property was previously platted as Olathe Commons First and Second Plats in 2013, but that development was never pursued. The vacation would remove unneeded water line easements, sewer easements, private drives, build lines, and paving setbacks, and would dedicate new easements for the approved development. Staff recommended approval with one stipulation concerning a maintenance agreement for private sewers. Commissioner Creighton asked clarifying questions about consistency with the previously approved plan; staff confirmed the layout, unit count, access points, and traffic improvements have remained the same. The applicant, Judge Clausen of Phelps Engineering, was present but did not make a presentation. The public hearing was opened and closed with no public participation.

Like to call tonight's meeting to order. Please join me in the Pledge of Allegiance. I pledge allegiance to the flag of the United States of America. One under God. Liberty Justice Raw. As we begin our meeting this evening, we'll take a moment to acknowledge that we have a quorum of planning commissioners present, barely, but we're good with six out of nine commissioners in attendance. Commissioners Bergita, Chapman, and Tronis are absent this evening. Planning Commission meetings are an important part of the process for interpreting and applying the city's comprehensive plan and unified development ordinance. It's important that our meetings are conducted with dignity and respect, and that applies to every person in attendance. We strive to provide an atmosphere where the ideas and opinions of all participants are held in the highest regard. Finally, the actions on the issues we discuss are ultimately under the responsibility of the City Council. As a planning commission, we're here to help the council as our elected representatives to be fully informed to make the best choices for our city. This evening we have two items on our consent agenda. Commissioners, do you need any items pulled or any additional information or questions from staff on these issues? This public hearing is request for approval of a plat with a vacation of easements and dedications for Olatha Commons third plat, which is located at 119th Street and Black Bob Road. Mr. Jury will present the case. Welcome, Nate. Thank you, Chair Janner. Planning Commission. Good evening, Nathan Jury, senior planner. Before you tonight is the request from the applicant for approval of a final plat for Alatha Commons third plat, as well as uh this does this plat does include the vacation of public easements and dedications. The site is located southeast of 119th and Black Bob Road Road, just east of Olatha Point, as outlined in red on your screen. This is an undeveloped property that was platted previously for a previous development as Aletha Commons first and second plats. Um on your screen are Olatha Commons first and second plates with the web of easements that were uh dedicated on those platts. Uh the uh vacation request does include uh vacating uh some water line easements, I think on both plats. Um there's some sewer easements kind of scattered throughout. Um there's some private drives as well as uh uh build lines and paving setbacks um throughout the perimeters of the property. Um so this this uh plat will vacate all those existing easements and dedicate the new ones. Uh those existing easements are no longer needed as those were dedicated for a previous um development approval um back from 2013 time frame that is was never pursued on the site. And so with the new approval, um the developer is just cleaning up the site to allow development of the proposed and approved development. So with that, um vacations do require public hearing, um which is why it's before you planning commission tonight. Uh the applicant did mail the required public notice to the surrounding property owners. Um and staff provided the application um to one interested neighbor. Um no further inquiries were made. Um additionally, no private utility companies um are impacted by the requested vacation. Um staff does recommend approval of the final plat and the vacation of easements and dedications with one stipulation regarding uh the maintenance agreement um for private sewers throughout the property.
