3:05

The unified development ordinance uh ordinance specifies that an accessory dwelling unit located in an accessory structure is not allowed.

3:16

The UDO requires accessory dwelling units to meet the minimum setbacks of the zoning district and requires accessory structures to be located a minimum of five feet from the interior lot line.

3:30

Though the property may not meet the strictest interpretation of the code, staff recommends the planning and zoning commission accept the findings of facts and recommend approval of a variance from section nine point zero three accessory uses and structures of the UDO to permit an accessory dwelling unit located within an accessory structure and reduce setbacks to a minimum of one point five feet for associated accessory structures, as well as a variance from section eight point one one to permit a reduced interior side setback for an ADU to six point four feet for the property at one twenty-four Chicago Road.

5:27

And the intent here is to it fix up the property and it's gonna be family uh family, that's all families going to be living in there.

5:38

This property was previously zoned as such.

5:44

It has an existing accessory dwelling unit above the detached garage, but it's been empty for years, so it's lost its legal nonconforming status.

Summary of Proceedings

Oswego Planning & Zoning Commission Meeting - August 6, 2026

The Planning & Zoning Commission held a public meeting on August 6, 2026, at 7:00 PM at Village Hall. The agenda included four public hearings: a variance for an accessory dwelling unit at 124 Chicago Road, a major rezoning and PUD for Traughber Estates (162 residential units), and two text amendments to the Subdivision Regulations and Unified Development Ordinance. The commission approved the variance, both text amendments, and deadlocked 3-3 on the Traughber Estates proposals.

Consent Calendar

  • Approval of Minutes: The minutes from the July 9, 2026 meeting were approved unanimously via roll call (8-0).

Public Comments & Testimony

  • 124 Chicago Road Variance: One public speaker, Rod, expressed concerns about potential impacts on adjacent property setbacks and emergency vehicle access to the coach house. Staff clarified the variance would not affect other properties and that the driveway condition is separate from the variance request.
  • Traughber Estates: Multiple residents spoke in opposition:
    • Amy McDonald questioned the traffic study's validity on already congested intersections and criticized the density.
    • Linda White echoed traffic concerns on two-lane roads.
    • Mary Murray raised concerns about asbestos/lead remediation during demolition, tree removal, road closures, and air quality.
    • Mark Benstein requested a berm with pine trees along the retention pond to reduce noise and dust.
    • Michelle Boyd opposed the density, citing overwhelming scale and traffic impacts from multiple developments.
    • Lisa Spiro argued the traffic impact on Franklin Street would be severe, noting a previous light request was declined.
    • Heather Chanel criticized the village board for approving large money deals, referenced campaign contributions, and questioned the timing of school district repairs.
    • Jeff Chanel argued the infrastructure cannot handle the added traffic and crime, and suggested the land could be used for another school.
    • Cathy Schalinger asked who pays for asbestos removal and noted traffic already diverted to avoid the area.
    • Michelle Boyd (second appearance) pointed out a typo on a plat survey that said "Yorkville, Illinois."
  • Text Amendments: No public comments were offered.

Discussion Items

  • 124 Chicago Road Variance (Project #1329.26): Applicant Victor Cossyleon requested variances from Section 9.03 and 8.11 to permit an ADU within an existing coach house and reduce setbacks to 1.5 feet and 6.4 feet respectively. The property had been recently purchased; the coach house had been vacant and lost non-conforming status. Staff recommended approval. The commission approved the variance unanimously (8-0).
  • Traughber Estates Rezoning, PUD, and Subdivision Plat (Project #1330.26): Applicant JM Developers proposed rezoning from R2 to R5 and a PUD for 162 units (36 for-sale townhomes and 126 rental apartments) on the former Traughber School site. The plan reduced density from an initial 246 units and eliminated five-story buildings. Access via right-in/right-out on Route 71 and full access on Washington Street. Commission discussion centered on land use, traffic impacts, and compatibility with the neighborhood. Commissioners expressed mixed views: some appreciated the density reduction and stormwater improvements, while others opposed the multifamily use in the historic neighborhood. The commission deadlocked 3-3 on both the rezoning motion and the PUD motion (with conditions for additional parking and landscape buffers).
  • Subdivision Regulations Text Amendment (Project #1326.26): Assistant Village Engineer Andre Jungerman presented changes to standardize utility line styles, increase manhole spacing to 500 feet (per Fox Metro), increase sidewalk thickness to 6 inches, revise surveyor certificates, update street pavement criteria, and replace/add construction details. Approved unanimously (8-0).
  • Unified Development Ordinance Text Amendment (Project #1325.26): Rachel Riemenschneider presented clarifications on open fences, temporary use processes, downtown sign letter/height limits, and a new Section 9.06 for renewable energy systems (solar, BESS, and wind). The accessory structure discussion was postponed to the September meeting. Approved unanimously (8-0).

Key Outcomes

  • 124 Chicago Road Variance: Approved (8-0). Recommendation to the Village Board for approval of variances to permit an ADU in an accessory structure with reduced setbacks.
  • Traughber Estates Rezoning: Motion failed, deadlocked 3-3 (no recommendation).
  • Traughber Estates Preliminary/Final PUD and Subdivision Plat: Motion failed, deadlocked 3-3 (no recommendation).
  • Subdivision Regulations Text Amendment: Approved unanimously (8-0).
  • UDO Text Amendment: Approved unanimously (8-0). Accessory structure discussion deferred to September 10, 2026 regular meeting.
  • Next Meetings: Special meeting on August 11, 2026, and regular meeting on September 10, 2026.
