Speaker 1

16:14

Good evening, ladies and gentlemen.

16:16

Today's date is September 25th, 2025.

16:20

The Pleasantville zoning board of the bills is in session.

16:25

Krause, uh Budson, and Krieger are present.

16:30

Uh normally we have five members, but our last member um retired from the board and uh a replacement has not yet been appointed.

16:40

Uh from one perspective, that should mean nothing, because we like to think that people get what they're seeking if they are entitled to get it legally, and they don't get it if they're not entitled to get it legally.

16:55

But as I'm sure all of you can read recognize as a matter of mathematics, it's easier to get three boats, and that's what you need out of five, then three out of four.

17:06

Uh if this uh situation uh causes any of the applicants here this evening to want to go over to our next meeting in the hope, and I stress the word hope.

17:18

Uh I certainly hold out no uh guarantee that this is gonna happen in the hope that we have uh another member by then certainly willing to do that and you don't have to refile and all that stuff.

17:33

Uh but uh let me know whether your case is called.

17:37

Otherwise, uh we're gonna proceed tonight.

17:40

We have a quorum, we're legally authorized to proceed, and that's what we're gonna

Unassigned speaker

17:44

do.

Speaker 1

17:44

Uh case number twenty twenty-five, fourteen, pet.

17:48

I'm getting feedback still.

Speaker 2

17:52

Nobody has a laptop in here, right?

Unassigned speaker

18:01

I

Speaker 1

18:01

mean, I can live with it, but it's a it's a little bit

Speaker 3

18:10

coming from Tim's

Speaker 4

18:13

I'm in a soundproof booth, Erica.

Speaker 3

18:15

Okay.

Speaker 1

18:35

I don't hear it.

18:38

Let me let me start that again.

18:40

Case number twenty twenty-five fourteen, Patty and Eric Tanner, four fifty-four, Washington Avenue, post through four addition to existing single family dwelling on site in violation of section, etc.

18:52

etc.

18:52

etc.

18:53

Is the are the applicants present.

Speaker 4

18:56

I'm Tim Leonard, the architect.

18:58

I think one of my applicants is there in the audience tonight.

Speaker 1

19:06

I am Tim, uh you you heard what I said and you you're one of our regulars, so you know the the approach.

19:12

We've gotten our material you submitted.

19:14

We've had an opportunity to review it.

19:16

This is your opportunity to supplement your application if you want to.

Speaker 4

19:22

Sure, we're perfectly happy with the four members tonight.

19:24

I'm glad we have four.

19:26

And if Robert wouldn't mind, I'll share my screen and I'll um explain my submission to

Unassigned speaker

19:31

you.

Speaker 4

19:34

So we're can you all see what I've got up here?

19:37

Says Timothy Leonard has started screen sharing.

Speaker 1

19:40

Double click and there it is.

Speaker 4

19:43

There it is.

19:44

Okay, good.

19:44

So what you're looking at is my

Speaker 1

19:46

public see this as well.

Speaker 4

19:49

Okay, go Tim.

19:51

So what you're looking at is uh my site plan.

Unassigned speaker

19:53

We're on Washington Avenue on the west side, as you all know, the grade slopes from Washington down to the train tracks and the park way down there.

Speaker 4

20:02

So we've got a sloping lot, which is causing the need for a third story variant, which I'll walk you through step by step.

20:10

Um, and we also have the need for a small uh de Minimus side yard setback because the existing house on the north side is at 7.96 feet, where we're eight feet is required.

20:25

We're planning on extending that plane straight up and getting no closer to the northern property line, but I ask for a few extra minuscule of a foot uh of a variance to make it an even number for a half a foot variance there on the north side.

20:43

So this house was built back in the 50s, and on the second floor, uh there's a wall at the back of the house that's only five and a half foot high, and therefore there's no part of this upper floor that is seven foot six inches in height, which is the minimum height that would uh turn it into a story.

21:06

So even though there's bedrooms and a bathroom up here, and it's you know it's a livable space, but every single almost every single part of this second floor is a sloped ceiling.

21:16

Certainly in the front, where there's a four-foot knee wall, the back, even as short as I am, I I can barely walk up to this wall.

21:23

So, what the plan, what we're asking for is to make all of the perimeter walls be a full eight foot so it can be completely usable, and we can have a nice layout for bedrooms, bathrooms, and closet spaces.

21:37

Um there's uh some work being done on the first floor and a porch and a deck that doesn't get affected by the the variance here.

21:45

Um, and this is what the elevation views look like.

21:48

This is the current front view from Washington.

21:51

It looks like a cape from the front.

21:53

Um, and we're proposing to turn it into look like a two-story.

21:57

Uh, the issue, as I mentioned before, is it's a sloping lot, and as it slopes down, what happens is the basement due to the average grade calculations and the way that it's done in Pleasantville, is that be that basement, even as it exists, becomes a story because more than half of that floor space is above the average grade.

Pleasantville Zoning Board of Appeals Meeting – September 26, 2025

Note: The transcript of the meeting states the date as September 25, 2025, but the provided date for this summary is September 26, 2025, creating a discrepancy.

The Pleasantville Zoning Board of Appeals met with four members present (one seat vacant) to consider seven applications for area and parking variances. All applications were approved unanimously.

Consent Calendar

  • The minutes of the previous meeting were approved by motion.

Public Comments & Testimony

  • Alison Quintus (15 Ashland Avenue) spoke on Case 2025-15 (4 Christie Court), expressing concerns about privacy impacts from the proposed second-floor addition and deck. She stated that recent construction on nearby lots had already reduced her privacy and that variances should consider neighbors' interests. She also raised concerns about lighting and ongoing construction at 12 Christie Court. The applicant voluntarily agreed to cut the deck back to the required 20-foot setback and to avoid floodlights, which was accepted by the board.

Discussion Items

  • Case 2025-14 – Patty & Erik Tanner (454 Washington Avenue): Applicant sought variances for a third-floor addition due to a sloping lot causing a third story and a 0.5-foot side yard setback deficiency. Architect Tim Leonard presented plans, noting the house had a low ceiling on the second floor and the addition would be unseen from the street, only visible from the railroad. The board voted to grant (4-0).
  • Case 2025-15 – Shana Weldon & Michale Duffy (4 Christie Court): Applicants sought variances for a second-floor addition on a non-conforming lot. After public comment, the applicant voluntarily agreed to reduce the deck setback to 20 feet and no floodlights. The board granted the variances (4-0).
  • Case 2025-16 – Daniel and Meghan Bruen (15 Great Oak Lane): Architect Mary Scott presented a revised plan for a side entry and straightening the rear wall, requiring variances for building coverage and floor area ratio (40 sq ft addition). The board found the request minimal and granted (4-0).
  • Case 2025-17 – Kristen & Rajesh Kumar (31 Sarles Lane): Architect Lou Dumasy (also representing case 15) presented a second-floor bath addition over an existing sunroom, requesting a 5-foot front yard setback variance. The board approved (4-0).
  • Case 2025-18 – Sanjay & Neeru Girdhar (25 Church Street): Contractor Mario CCM presented plans for a one-story addition to a non-conforming lot, with a 4.28% building coverage increase mainly due to a deck. The owner noted a prior 2018 approval (expired). The board granted (4-0).
  • Case 2025-19 – Westshore IV Services LLC (62 Wheeler Avenue): Owner Ali Mestringal sought a parking variance (9 spots required, 0 provided) for a change of use from retail to a personal service (IV Nutrition). The board discussed the lack of parking downtown and that the use would have short visits. The board granted the parking variance (4-0).
  • Case 2025-20 – Westchester Eyes (199 Marble Avenue): Architect Nicholas Faustini sought a parking variance for converting a veterinary office to an ophthalmologist office with a rear addition. Existing parking had 9 spaces, but due to Planning Board concerns about tandem spaces and ADA requirements, the applicant proposed 8 spaces (requiring a variance for 4). The board deliberated on the reduction caused by Planning Board preferences but granted the variance (4-0) and encouraged the applicant to discuss tandem spaces with the Planning Board.

Key Outcomes

  • All seven applications were approved unanimously (4-0), with conditions on Case 2025-15 to reduce deck and prohibit floodlights.
  • The board noted the next meeting is scheduled for October 30, 2025 (the day before Halloween).
  • The board reminded applicants that lighting must comply with village codes regarding light trespass.
