Good morning and welcome to planning housing economic development committee.

0:06

Um can we have a roll call?

0:08

Vice Chair Oriana Chair.

0:10

Councilmember Denoga.

0:12

Councilmember Olsen.

0:13

Three members present at roll call.

0:15

Thank you so much.

0:17

Um we have a few pieces of legislation today.

0:22

We will start with um CB90 2026 and act as machine line development subdivision review act of 26.

0:29

I'll pass it to staff for a um overview.

0:33

Yes, good morning, um uh chair Oriada.

0:36

Uh draft one would amend the subdivision regulations to create a combined application for detailed site plans and preliminary plans of major subdivisions and allow concurrent review of certain development applications, including natural uh resource inventory plans, floodplain, delineation plans, site development concepts, storm water management plans, and erosion and settlement control uh plans.

1:05

The bill in the agenda item summary can be found on pages four through nine of your virtual binder.

1:10

Ms.

1:11

Cree Ganyu is here and can provide a fiscal and policy overview of the legislation.

1:16

There is a proposed draft two of the bill, and Mr.

1:19

Hamlin can discuss those amendments.

1:22

The planning staff also provided comments, which are on pages 17 through 21 of your virtual binder, and they are also here and can discuss their comments.

1:33

Mr.

1:33

Um Griffin Benton from MBIA submitted a letter of support with amendments uh that was sent to you this morning as part of backup.

1:42

In addition, there are going to be two speakers.

1:44

At this time, I would like to either request Ms.

1:46

Gann you provide a fiscal and policy overview, or we can turn to Mr.

1:50

Hamlin to discuss the amendments.

1:52

Uh we'll go to Josh Hamlin for the amendments.

1:57

Okay, good morning, uh Josh Hamlin, legislative attorney for the council.

2:01

Um you should have before you now a proposed draft two of the bill, and you'll notice it's it's pretty substantial amendments to it.

2:09

Um I'll be as brief as possible.

2:11

Uh it essentially strikes the current purpose clause, uh, which would have made all of the changes.

2:19

Uh inserts new text saying, you know, for the purpose of expressly providing that certain applications for preliminary plans of subdivision minor or major may be approved simultaneously in accordance with the provisions of the zoning ordinance.

2:32

The zoning ordinance already has a provision which allows for simultaneous review of applications.

2:38

Um this makes sure that nothing here interferes with that and the potential for the applications if they're in a posture to be approved independently can be approved at the same time.

2:51

So it changes that purpose.

2:53

It strikes basically all of the text in the current bill.

2:58

Um and adds in for context provisions from subsection D1A.

3:05

Um basically just adding a new last sentence both for minor and major subdivisions saying nothing herein precludes simultaneous approval of applications reviewed simultaneously in accordance with the provisions of the zoning ordinance.

3:19

And again, that's that's referring to existing law in the zoning ordinance.

3:27

Thank you.

3:29

Um turn to well, are there any questions from oh yes here?

3:40

Um any questions from colleagues on the draft two before I go to the speakers list.

3:47

Okay.

3:49

We we'll have time for more questions if needed.

3:52

Um, the first person on the speaker's list we have Matthew Tedesco.

3:58

Thank you.

4:05

Good morning, madam chair, members of the committee.

4:08

For the record, Matthew Tedesco, the law firm of Macamihosi.

4:11

Um, here in uh relative support of uh CB90.

4:16

Um, as I think the council recalls back at the retreats back in January, we we were asked to sit on a panel and address some of the ongoing concerns with respect to development review process in the county.

4:29

And one of the items that we had talked about was consolidation of entitlement applications into um one or no more than two applications.

4:40

Currently, right now, um entitlement could take up to three different applications and in the current zoning ordinance section 27-6105B ties back preliminary plans of subdivision to certain required findings of the zoning ordinance.

5:00

Um subdivision is required to conform to 27-620, which is roadway and access, 27-640 open space set aside, 27-680 environmental protection, and depending on zoning 27-6130, the agricultural compatibility and 27-6140, their urban agricultural compatibility.

5:19

So currently the codes right now between subtitles 24 and 27 do overlap.

5:25

And so the policy direction behind this bill, we would support with respect to having a consolidated entitlement application that really handles both the subdivision aspect of the development process as well as the detailed site plan process.

5:39

Um it would create more efficient and coordinated review processes.

5:43

Um if there is determined to be a conflict with uh this local law and existing state law with respect to the land use article, we would encourage and ask um that the council uh consider that, but also at the same time would consider continue to work with the council, the bill sponsor as well as our state officials to make sure that that is coordinated.

6:05

So thank you, madam chair, for the opportunity to be heard.

6:08

Thank you.

6:10

Next we have um Nat Ballard, and then after Janet Greagle, I'm sorry, Gingle.

6:26

Good morning, Madam Chair and Committee members.

6:28

Uh, my name is Nat Ballard.

Planning, Housing and Economic Development Committee Meeting - September 15, 2026

The Planning, Housing and Economic Development Committee met on Tuesday, September 15, 2026, at 9:37 AM in Committee Room 2027, with Vice Chair Krystal Oriadha presiding (Chair Wala Blegay excused). Members present: Council Members Shayla Adams-Stafford, Thomas Dernoga, and Eric Olson. The committee considered three pieces of legislation: CB-090-2026 (Streamlining Subdivision Review Act), CB-092-2026 (Accessory Dwelling Units), and CR-095-2026 (ADU State Deadline Gap Resolution). All three were favorably recommended with amendments to the County Council by votes of 4-0.

CB-090-2026: Streamlining Subdivision Review Act

  • Staff Presentation: Legislative Attorney Josh Hamlin introduced Draft 2, which struck the original purpose clause and added language ensuring concurrent approval of applications under existing zoning provisions, rather than creating a new combined application. The Maryland-National Capital Park and Planning Commission (M-NCPPC) provided comments.
  • Public Comments: Four speakers addressed the committee:
    • Matthew Tedesco (attorney, Macamihosi) expressed support for consolidation of entitlement applications, noting current code overlaps and encouraging coordination with state law.
    • Nat Ballard (Rogers Consulting) supported the bill, stating it would create a more coordinated and efficient review process while maintaining substantive standards.
    • Janet Gingold (Prince George's County resident) urged caution, arguing sequential review improves decision-making and environmental stewardship.
    • Casey Anderson (Rogers Consulting) supported the legislation, contending concurrent review improves development quality and reduces the typical four-year process in the county.
  • Discussion: No additional questions from committee members were recorded.
  • Key Outcomes: Motion by Vice Chair Oriadha, seconded by Council Member Dernoga, to favorably recommend Draft 2. Vote: 4 ayes (Oriadha, Adams-Stafford, Dernoga, Olson), 1 excused (Blegay).

CB-092-2026: Accessory Dwelling Units (ADU)

  • Staff Presentation: Legislative Attorney Kathy Canning outlined six substantive amendments in Draft 2, including: replacing affidavit with attestation for owner occupancy; requiring property owners to notify adjoining neighbors (with no invalidation if notice fails); prohibiting short-term rentals; adjusting rental length-of-stay references; limiting Woodland and Wildlife Habitat Ordinance references to variances only; and limiting Tree Canopy Coverage Ordinance references to waivers only.
  • Sponsor Remarks: Council Member Dernoga explained the bill originated from provisions removed from a previous zoning bill (CB-74) at M-NCPPC's request, covering owner occupancy, rental licensing, environmental protections, and neighbor notification. He noted agreement with M-NCPPC to clarify in the committee report that a Use and Occupancy Permit (U&O) is required for ADUs, with a future technical amendment to eliminate any ambiguity.
  • Public Comments: No oral testimony was provided, but written comments were submitted by Cheryl Cort (Coalition for Smarter Growth, expressing concerns), Mr. Mingo (Prince George's County Association of Realtors, supporting with amendments), and Melissa Sangoth (opposing owner occupancy requirements).
  • Discussion: Lori Parris (DPIE) clarified that attestation has the same legal effect as an affidavit under perjury penalties. Laura Talarico (M-NCPPC Associate General Counsel) confirmed the committee's intent that ADUs require a U&O permit, and M-NCPPC will propose a clarifying amendment.
  • Key Outcomes: Motion by Council Member Dernoga, seconded by Council Member Adams-Stafford, to favorably recommend Draft 2. Vote: 4 ayes, 1 excused (Blegay).

CR-095-2026: ADU State Deadline Gap Resolution

  • Staff Presentation: Staff noted Draft 2 contained a technical amendment to correctly reference state law. The Maryland Department of Housing and Community Development (DHCD) had no comment.
  • Public Comments: None.
  • Discussion: Council Member Adams-Stafford thanked colleagues for addressing the gap between the state ADU local law deadline and county enactment, noting work with the ADU task force.
  • Key Outcomes: Motion by Council Member Adams-Stafford, seconded by Council Member Dernoga, to favorably recommend Draft 2. Vote: 4 ayes, 1 excused (Blegay).

Adjournment

Motion to adjourn by Council Member Olson, seconded by Vice Chair Oriadha, carried 4-0. The meeting adjourned.
