Appeal #3255 – Gallagher Trail Holding Company LP (110 Gallagher Road)
- Request: Variance from Section 280-103 of the Code to reduce off-street parking from the required 42 spaces to the existing 34 spaces for a new spa tenant (indoor recreation use). No new construction proposed.
- Testimony: David Falcone (applicant’s attorney) and C.F. Holloway (property owner) explained that the site has six units, 34 marked spaces, and has never had a parking complaint. The spa’s hours (10 AM–8 PM weekdays, 10 AM–5 PM weekends) complement existing uses (Pilates, orthodontist, offices). The spa will have up to five facial therapists. The adjoining neighbor (512 West Lancaster Avenue) expressed no objection.
- Board Discussion: Members noted that more data on customer turnover would have been helpful, but given the history of the property and the testimony that parking has always been adequate, they found the variance warranted.

Appeal #3252 – Wayne Property Acquisition / Wawa (302-306 East Lancaster Avenue)
- Background: Final land development for a convenience store with gas pumps was approved after litigation. Two conditions required ZHB approval: an eight-foot shadow box fence along the southern border and a nine-foot masonry trash enclosure. Additionally, the applicant sought variances for multiple sign provisions.
- Testimony:
- Eric Britz (engineer, Bowler Engineering) described the site layout, buffering (32 arborvitae, 5 Washington hawthorn trees, shrubs), and the fence/trash enclosure design. He explained the sign package: monument sign (sign A) at 55.5 sq ft (over 50 sq ft due to coping); wall signs B (west elevation, 42.82 sq ft at 21 ft 8 in height) and C (east elevation, 28.19 sq ft at 16 ft 1 in, later lowered to 15 ft); spanner lettering removed; pump island signs (geese on dispensers, 0.63 sq ft each); and instructional signs (pump numbers) at 11 ft 3 in. He argued that the sign code is ambiguous on total sign area and that the applicant had reduced signs significantly from typical Wawa packages.
- Michael Spiegel (Wawa real estate project engineer) testified that the west elevation wall sign must be high due to structural constraints (steel I-beams, ductwork) inside the tower. He noted that the store design was customized and that the sign height is necessary for safety and brand identification. He also stated that the pump numbers are required by Pennsylvania labor and industry for emergency identification.
- The township solicitor, David Keatley Jr., opposed the application.
- The board reviewed exhibits including the resolution requiring the fence and enclosure, and Commonwealth Court orders.
- Board Discussion:
- Several members expressed that the height variance for sign B (west elevation) lacked sufficient evidence of hardship; they viewed it as self-created and were unsatisfied with the explanation of structural infeasibility. The board voted 4-0 to deny that variance.
- For the monument sign (sign A), the board found the extra 5.5 sq ft from the coping and the ATM content request to be de minimis or acceptable, approving both.
- For the wall signs B and C, the board acknowledged ambiguity in the code regarding 50 sq ft per frontage vs. total, and granted the variance for total square footage as a precaution.
- For the pump island signs (goose height, instructional sign height, ground sign square footage), the board accepted safety reasons (taller vehicles, emergency identification) and the minimal exceedances, granting those variances.
- The fence height (8 ft) and trash enclosure height (9 ft) were considered necessary for screening and consistent with the resolution, approved unanimously.

Zoning Hearing Board for Radner Township. And we're going to go a little bit out of order. First, the appeal number 323 has been continued to the March hearing. And we're going to call the appeal number 3255, applicant Gallagher Trail. Applicant seeks relief from Section 280-103 of the code. Regarding off street parking. The applicant would like to reduce that by eight spaces. Pledge. Oh, I'm sorry. Yeah. I didn't see. Yeah, please join us for the uh Pledge of Allegiance. To the flag United States of America. For which it stands. One nation under God. Indivisible with Liberty and Justice for all. We should elect the chair or vice chair. We should do all that. Should we do that first? So the board was not able to have its organizational meeting, which is uh a meeting that's uh required by the municipality's planning code uh because of the snowstorm, so we had to do it uh uh just prior to the start of tonight's meeting. And um so the chairman I uh has been reappointed uh for another year. Uh Vice Chairman is is uh John Nagel, he's been reappointed for another year. Our solicitor uh uh US economy has been appointed for another year, and I do think that's about all of our business as that. Same rules and procedures as before. We haven't changed anything in that regard. So having said that, we're ready for appeal number 3255. Thank you very much. That's good to see everyone. Happy New Year. Um David Falcone here on behalf of the applicant Gallagher Trail Holding Company LP, who is the owner of the property at 110 Gallagher Road. Um we are seeking a variance tonight with respect to parking at the property. It is an existing, a non-conforming condition. Um the parking at the site is not being amended in any way, and no new construction is being proposed as a result of this application. Instead, we have a situation where a new tenant is being brought to the site to fill a space which has been vacant for a couple of years and actively marketed for lease. Uh and that tenant is a spa service, which is indoor recreation under the code, and the code would require a certain number of spaces on site, 42 total, when the property only has 34. Uh again, this is space that has been historically leased for a various um number of uses over the years. The owner has owned the property for nearly 20 years. Gallagher Trail Holding Company, it has been an office, it's been medical, uh, various uses, and again, in this instance it's being proposed for indoor recreation. The uh zoning district is the C2, and we had reached out to the zoning officer for determination on the number of spaces that are required on site based on the mix of uses, and it was based on that zoning officer's determination that there is a requirement of 42 spaces, and again, we have 34 today, and we'll have 34 after this application. We've marked uh a number of exhibits for you, um, which I believe will help explain the situation. Uh A1 is our zoning hearing board application, A2 is the deed to the property to Gallagher Trail Holding Company, A3 is a copy of the actual lease agreement with the proposed tenant. Um A4 is a survey showing that the site as it exists today. A5 is an aerial photograph, uh6 is a photo array showing various times for parking. Um A7 is the Pilates studio schedule. Uh A7 being included specifically because this use will dovetail as far as times go with the Pilates studio. So unlike some of the other uses we've had on site, this will actually complement some of the existing uses and put even less of a traffic burden and I'm sorry, a parking burden on the site. So Mr.
