The applicant, Michael Birch (Longleaf Law Partners), announced plans to add conditions: increased stormwater detention, enhanced erosion control, a public bicycle/pedestrian easement to ensure continuous connection to Chatterson Drive, and an emergency vehicle access easement with collapsible bollards. The Planning Commission recommended approval by a 4-2 vote, with dissenting members citing pedestrian safety and environmental concerns. The rezoning is consistent with the Comprehensive Plan but inconsistent with the Future Land Use Map (rural residential), so approval would amend the map to low-scale residential. Falls Lake area plan supports the density (4 units/acre) and residential-only use.

All right. Welcome everybody. We only have one item on the agenda tonight, and that is the rezoning for Z thirty-four twenty-four honeycut road. And we have Hannah Reco from planning and development here. Good evening. So this is a rezoning request Z thirty-nine twenty-four eighty-four fifteen honeycut road. A little over fourteen acres in size, currently zoned R one with the Falls Watershed Protection Overlay District. So I'll situate ourselves. This is just north of the Falls of News Strickland Road intersection. The site is undeveloped, has frontage on Honeycut Road, and then Chatterson Drive stub ends right on the western part of the property. Other landmarks nearby, Lafayette Village, off to the east southeast of the site. And then generally residential in the surrounding area. So there are nine proposed zoning conditions. Prohibit other uses normally allowed in R6. They also commit to 15% of the site as tree conservation area. So that's the rate for the current zoning R1. For every other zoning district, it is 10%. They're also committing to 30% of the site to be designated as open space. And then the remaining conditions pertain to transportation features. So condition six would exempt the site from the UDO block perimeter standard, dead end street standard, and cross access requirements. Generally speaking, zoning conditions are not allowed to be less restrictive than code. This is the one example that the UDO allows. So they're requesting that. Normally the Chatterson Drive stub would be required to connect through the site to Honeycutt Road. Conditions also commit to a 10-foot-wide path from that Chatterson Drive dead end there to the internal pedestrian network of any future development. And then can uh condition eight uh provides an option. So the developer would provide either a sidewalk at least six feet wide on both sides of the street internal to that development or a multi-use path of at least 10 feet in width on one side of the street. And then the final condition uh subject to approval by NC DOT would provide a high visibility high visibility crosswalk across Honeycutt Road near the intersection with through Monet Drive. So existing versus proposed, uh keeping the Falls Watershed uh protection overlay district, both uh residential districts, but an increase in the uh variety of building types that are allowed, smaller lots, smaller set packs, uh allows quite a few more dwelling units on the site. Uh again, that's capped by the proposed zoning condition, uh no more than 56. Request is uh consistent with the comprehensive plan. It is inconsistent with the future land use map designation here, which is rural residential. And there are a number of consistent policies. You can see these touch on um housing, uh, compact development, open space preservation, and a few of the uh area plan uh policies. Inconsistent policies in addition to the future land use map, uh the development would be different than this how the area is currently uh developed, and then uh that road connectivity policy is in response to the uh block perimeter condition. So uh because this request is inconsistent with the future land use map, approval would amend the map. Uh specifically, that would be from rural residential to low-scale residential. Here's an image of what that map currently looks like in the surrounding area. So if approved, that property would turn uh yellow, like uh the area south of Falls of News Road. Planning Commission recommended approval in a split vote uh four to two. I can see their finding here. Um the two commissioners who uh opposed uh approval um cited concerns about pedestrian safety and concerns about uh environmental impacts of the request. Uh with that, um happy to answer any questions before you proceed with the hearing. Questions. Okay. So I can open the hearing good evening, uh mayor, members of council, Michael Birch with Longleaf Law Partners here on behalf of the uh rezoning applicant. Uh appreciate Hannah's uh presentation, and I will be brief because uh we are going to be requesting a deferral to the June 3rd meeting so that we can add a few zoning conditions. Uh those are in response to some of the council member feedback as well as uh our meeting. Uh we attended the stormwater management advisory commission meeting last Thursday and uh agreed to add conditions related to increased stormwater detention as well as enhanced uh erosion control measures during construction. Uh additionally, the other condition that we will be adding is you know there is this segment of uh the multi-use path that will connect to Chaterson and then to our internal public street.
