All right, it is 3 30, so I'm gonna call us to order.

0:09

I know we're missing.

0:10

Hopefully, Becky will come in a little late.

0:12

I just know that we're on a time schedule, so I'm gonna start us.

0:14

But um, again, this is a special meeting, so we have one topic.

0:18

Again, it's a consideration of a separation agreement.

0:20

Um, and again, uh, we're on a on a time restraint here.

0:24

We do have lots of people that have things to do, and this was a hard meeting to get everybody assigned to.

0:28

We do have Mayor Yako and Don Cleaver online, so people are aware.

0:32

Um, and we are gonna need to have a hard fast about 425, 430 because people have prior obligations.

0:39

And again, so if we can be a reminder to keep on topic, be concise just so we can kind of meet that and try to find some consensus on the issue at hand.

0:47

So awesome.

0:48

I'll hand it over, Chris, if you have a little intro for us.

Speaker 2

0:51

All right, thank you, President Fair and Council members.

0:54

So, as you have on your agenda, um, the topic of consideration is a separation agreement that is related to uh city staff member, long-term city staff member,

uh

finance director Marshall Halleck.

1:07

Um

Unassigned speaker

1:08

just

Speaker 2

1:08

a little background on this process.

1:10

Um, as all of you know, we are currently actually under um uh uh status quo status uh by the Bureau of Uh Management Services BMS related to a uh a proposed uh supervisory union process.

1:27

And so that's an important um beginning statement in that um this process is uh initiated, was initiated

Unassigned speaker

1:36

um

Speaker 2

1:37

by Marshall as a voluntary resignation.

1:40

And uh we had several weeks of conversation um over uh starting in July about the possibility of of this.

1:47

Obviously, with his long tenure with the city over 26 years.

1:50

Um he's he's nearing retirement and um it was initiated by Marshall.

1:56

We uh moved through um several conversations, had um a draft resignation agreement uh that was uh on the timeline that was provided to you by the city attorney that was provided um about six weeks ago.

2:09

We had some back and forth on on proposed terms with that agreement, and um the the intent was to bring that forward for the full comp for full full council consideration at a regular meeting at some point.

2:21

However, um the the the first um letter uh from Marshall, as you saw in your in your uh additional information um from the the city attorney and the the related information that was provided in the the PDF uh document of communication.

2:37

Um the timing of that um initial resignation from that initial letter was September 4th.

2:44

And uh in light of uh two council members being gone, not not uh available for the September 14th meeting, and uh Marshall not wishing this to extend beyond that uh to September 28th.

2:56

The option for the council to consider this was to have a special meeting.

3:01

So that that was the the background.

3:03

Um voluntary in nature, um, a a separation or resignation agreement was the the process for doing

Unassigned speaker

3:11

that.

Speaker 2

3:11

And um

Unassigned speaker

3:12

I

Speaker 2

3:13

think the rest is going to be led by our uh city attorney.

3:16

We have Liz Vieira here.

3:18

Um she will be able to provide uh an overall overview on on some of the comments that she provided in the attorney client privilege um information yesterday, and then uh I think begin to address any questions that you may

Unassigned speaker

3:32

have.

Speaker 2

3:32

So without further ado, I'm gonna hand it over to Liz.

Speaker 1

3:35

Welcome, Liz.

3:36

Point of order.

Unassigned speaker

3:38

Um

Speaker 1

3:39

you're not recognized, we're in the middle of a business meeting right now, okay?

3:42

No, thank you.

Speaker 3

3:43

Okay, where's the public comment going to come in?

3:47

There is

Speaker 1

3:47

no public comment this evening.

Speaker 3

3:50

There is no

Speaker 1

3:51

public comment this evening.

3:52

Please sit down.

Speaker 3

3:54

That will be objected to, of course.

Speaker 1

3:56

Thank you, Liz.

Speaker 4

3:58

Good afternoon.

3:59

Um I wanted to at the top just address two pieces that I think um can help guide the discussion today.

4:07

Um, so first is that council has received um some private personnel data on Mr.

4:12

Halleck as part of um its consideration of a separation agreement.

Summary of Proceedings

Consideration of Finance Director Separation Agreement – Red Wing City Council (September 9, 2026)

The Red Wing City Council held a special meeting on September 9, 2026, to discuss the proposed separation agreement for Finance Director Marshall Hallock, who had submitted a letter of resignation. The Council reviewed the timeline of negotiations, debated severance terms, and raised concerns about the notification process, but took no formal vote.

Public Comments & Testimony

  • An unidentified individual interrupted the meeting demanding public comment. City Council Administrator Chris Heineman and Council President Janie Farrar denied the request, stating that the meeting agenda did not include a public comment period. The individual objected and was asked to sit down.

Discussion Items

  • Background and Process: City Administrator Heineman stated the process began with a voluntary resignation from Director Hallock, a 26-year employee. The initial resignation date of September 4 was followed by negotiations aimed at extending his employment to February 12, 2027, for a smooth transition. City Attorney Liz Vieira explained that the proposed six-month severance originated from a 2022 letter designed for involuntary termination and did not apply to this voluntary resignation. She outlined the Council's options: accept the proposed separation agreement, accept the resignation, or modify the offer.
  • Notification to Council: Council Member Vicki Jo Lambert strongly objected to the nine-day delay between Director Hallock's August 6 letter and the full Council being notified on August 15. She argued the City Charter requires the Council to appoint the financial officer and that the Council should have been informed immediately. Council Members Kim Beise, Becky Norton, and Mayor Gary Iocco agreed. Administrator Heineman responded that the September 4 resignation date was unexpected, and the delay was used to draft a formal separation agreement and consult the Personnel Committee.
  • Division on Severance Terms: Council Members Donald Kliewer, Ron Goggin, and Janie Farrar supported following the employee handbook only, arguing that a voluntary resignation should not warrant an expensive six-month severance package funded by taxpayers. Council Members Kim Beise, Vicki Jo Lambert, and Becky Norton advocated for the proposed severance, emphasizing Director Hallock's critical institutional knowledge, his role in securing $6 million in bonds, and the importance of a stable transition and staff morale. Council Member Beth Snyder stated she was in the middle, supporting a smooth transition but expressing strong concern over the cost and precedent of a six-month payout.
  • Employee Intent: Mayor Iocco stated he was unsure whether Director Hallock was being forced out or leaving voluntarily and requested direct communication with him. Council Member Beise stated he believed the employee wanted to stay, while Council Member Kliewer stated he believed the employee wished to move on.

Key Outcomes

  • No Formal Vote: No action was taken by the Council at this meeting.
  • Path Forward: Attorney Vieira suggested presenting the September 5, 2026 draft agreement to Director Hallock. If he signs it, the Council can vote on approval at the September 14 regular meeting. If he declines, the Council would accept his resignation. The Council appeared split on the terms, with a later count suggesting four members favored the handbook-only option.
  • Future Policy: Council President Farrar called for the development of a formal policy to guide the Council through similar personnel transitions in the future.
  • Adjournment: The meeting was adjourned at 4:30 p.m.
