Um I just wanted to speak a little and I and I share your comments.

Certainly, nobody uh had positive thoughts or when when seeing what happened uh with the school shooting, but I want to bring this to everybody's attention.

I am guessing maybe this year we've had three or four comments from the mayor about this.

Depending on what your uh statistics you use and definition you use of a school shooting, it usually depends on was it intent a gun intentionally fired, misfired, was it an officer's gun.

Um, there's somewhere between 27 and 150 school shootings in the U.S.

this year.

Most would say uh 51 where at least one person was injured.

Why are certain ones brought to our attention and spoken about by our government, and why aren't others?

The main reason the color of the skin of the students who live who live there.

Or currently, because of certain identities of the person who did the shooting.

I spent the last two days, and remember I'm married to a trans person seeing that.

Oh, look, another trans shooting.

Ninety-one percent of shooters are cis white men.

Keep that in mind.17% of shooters are trans people.

Less than 30% of trans people live past the age of 40.

Yeah, no.

Pay attention to why these things are happening.

I don't blame any of you for it, but let's look a little deeper in the news.

Um, I just want to make a comment, uh, city manager and to the chief.

I really appreciate um your effort the other day on channel.

I can't remember what uh channel it was, but one of the news channels, a story came out and uh about folks being in the apartments with hoods and masks running through the apartments over here off of 550.

Um I think it kind of painted a bad light on the city, which was not the right thing to be doing because uh RPD quickly responded and identified all ten of those folks, and on top of that, they're all gonna be pending charges.

So this isn't uh one of those cities where we're running rampant with crime.

It's something that our police departments quickly on top of, and uh had they approached us, I think it's something that we could have solved without bringing it out and trying to make us look uh a way it didn't deserve.

So I want to say I I appreciate it, Chief, and I know that the the folks that were involved in it and they're doing a good job.

So I appreciate everyone's quick attention to that, and thank you very much for your time.

Counselors, I too'd like to echo um Councillor Tyler's comments there.

Uh the reports were made, uh the police responded, already identified the 10 individuals, and that was just really fast work.

And I've talked to other uh people from other communities uh that where something like that's happened, and they can say they'd be lucky if it ever got solved.

But uh RPD jumps in, they do the investigation, they try to find people as quickly as they possibly can to resolve the situation.

So, Chief, another testament to your great leadership there at the police department and all of the fine people that work with you.

So thank you for doing that, and thank you for keeping our community safe.

Uh I just want to say today was uh an honor and privilege.

Uh we several of us, uh Councilor Dabson, myself, uh I know City Manager Geisel, um, I would assume others over the course of the day, but we were able to celebrate and uh participate in the last call for Chiefbo, and we were also able to see uh Chief Winsl take the reins.

So congratulations to both gentlemen.

Um what a what an emotional moment that was, and so cool to see so many um of the former officials from the fire department come out as well.

So anyway, thank you, Mr.

Mayor.

Yes, uh Counselor Lennon time echo what counselor list uh said and also wanted to stay on on that theme uh last Tuesday.

Uh the uh elementary and uh uh private school that I'm associated with uh reached out to uh Chief Winsel and to the fire department to see if they could come on that Tuesday morning uh to just kind of help welcome all of our elementary students back to school, and they did.

They brought out uh a uh they brought out an ambulance and also uh an engine as well, and a bunch of uh you know, seven or eight firefighters, they were held in signs and high-five on all of our students as they were coming back in.

It was a really cool thing, and so I just appreciate you guys uh coming through, and uh you sent out a great group of people, and uh they had a uh uh really big impact on the kids, and we really appreciate it.

And uh thank you guys for uh being part of that uh for all those little students as they came back.

So the item for you tonight.

Uh, so the item before you tonight is for a site plan for uh apartments between Rosarito and Walsh.

Um, and so that would be south of Southern.

Um, and so that would be south of Southern, um, and just before uh the start of Cabazon.

So this is an item that previously had come before this governing body a few years back for a very similar, if not uh pretty much the exact same site plan for these apartments.

Uh the conditional use permit that went with that or that site plan lasted for um two years, um, and so it's lapsed.

So that's why they're coming back forward.

There's not been any dramatic changes to this.

Um previously, when this was heard in front of the governing body, there was a couple of additional items that were added on.

Um, and so there was a additional buffer standard that was requested, and then some additional lighting um, and the lighting was to move uh from the south part of the buildings to a different part of the building so that it wouldn't reflect on those neighbors.

All of those things have been addressed and on our part of this uh site plan that's in front of you tonight.

Uh one thing I wanted to touch on really uh briefly is that when you look at the acreage, it says 5.99 uh two, um, and so it's just a teeny bit under six.

Uh but when you go way back to the actual first plat for this um uh book one um plat, um the number should have worked out uh for six acres.

Um it's just when it got replatted from all of those half acres into one lot that they lost a teeny bit of land.

Um staff assumes that it was just the way that it was rounded.

Um so we don't see any problem with the 156 units that uh would move forward with this item.

Uh here is a copy of the rendering of what this building would these buildings would look like in your agenda briefing memorandum.

There's a lot more different elevations because of all of the different buildings.

You get a view of every angle of those buildings.

But I just put in uh a couple of them really quick for tonight.

There's also a copy of the landscaping plan.

This was uh one of the requirements with the zoning ordinance was that it would go in front of the planning and zoning board for review for the site plan as well.

It has been reviewed and approved by PZB, and now um staff recommends approval as well, and I will stand for any questions.

Mayor and and counselor, uh we are enclosing that uh retention pond.

Um first off to get into the community, it's gated around the perimeter with controlled vehicular access and pedestrian access into the site itself.

So that would uh prevent anybody from outside the community from entering the uh stormwater pond, and then within the pond itself, uh we have security fencing around that retention pond as well uh to prevent you know just you know kids getting involved and pets that sort of thing.

So uh we took that item of safety pretty seriously.

Uh moving on to R 95 resolution amending the Paseo Gateway Master Plan.

And Amy, are you gonna present on uh R95, R96, and O23 all at the same time?

So just for anybody that's here, we're gonna cover R95, R96, and O23 in this presentation on R95.

So we'll take comment and input on R95 and then move directly into votes on R96 and O23.

Good evening, Mr.

Mayor, and members of the governing body.

So R95 is going to be a resolution amending the Paseo Gateway Master Plan.

R96 will be a resolution adopting the Cleveland Height Master Plan.

And then O23 will be a zone map amendment for what would be the newly created Cleveland Heights Master Plan, changing the existing zoning, which may is a combination of R3 and R2 and R1 to R4.

So location-wise, this is located around Cleveland High School, is probably the easiest way to graphically to find it.

What we're talking about tonight is when you combine both of the areas that are outlined.

So the area outlined in red would be what's going to be the new Cleveland Heights Master Plan.

The area of red and black is the current boundary for the Paseo Gateway Plan.

So what's going to be left over in the Paseo Gateway Plan is going to be the areas outlined in black.

And then for the zone map amendment, this is going to be if we zoom in on that Cleveland Heights master plan area.

Under the proposal for the zone map amendment.

So the planning and zoning board reviewed this item at their July 22nd, 2025 meeting and recommended that the governing body adopt the resolution in a seven to zero vote in favor for uh the master plan that would uh the new created master plan for Cleveland Heights.

Uh the planning and zoning board reviewed again at their July 22nd meeting and voted seven uh in favor as well.

And then for the zone map amendment, uh that would change the zoning to R4 for that northern portion of that Cleveland Heights master plan area.

Uh they again voted uh to recommend.

Good evening, Mayor and uh members of the governing body.

I appreciate you all having me here.

I'm Charlene Johnson, senior planner with consensus planning.

We're the agent for the state land office, and uh are also representing Paseo Gateway LLC, who are the uh lessees for the state land office and are uh developing the Cleveland Heights Master Plan.

Um we really believe that this is a good thing for this area.

We know that Paseo de Volcan is a is an up and coming corridor, and this area has just sort of been um you know slated for more development um going forward, and as you can see, um track 17 um has been was is underway in development, so that's exciting.

Um and so that's sort of just sort of is the impetus of sort of moving forward and trying to get this Cleveland Heights master plan to sort of uh continue the development in the area.

I just want to give you a little bit of background on why this sort of um started.

There was a uh Paseo Gateway State Land Office Drainage Master Plan done in 2009 and was adopted in 2009.

In 2016, there was an amendment.

So the land use that you see in it's on page seven, I believe, of the proposed Cleveland Master, um Cleveland Heights Master Plan is the layout that is in the Paseo Gateway State Land Office Drainage Master Plan.

And the reason why that was reconfigured was really to create a more efficient way to install infrastructure and and prevent um off-site drainage flows in the area that especially from the north and west.

So as you can see in the original master plan, there's a big, really big area of open space that's just to the north of Cleveland Heights Road.

Um the new master plan has five different smaller regional ponds, and that sort of spreads out the drainage.

Um it reconfigures it so that it's a little easier to uh to install the um the necessary infrastructure in this really big area.

Um what ends up happening is that the uh open space goes from about 24.1 acres to about 21.6 acres, but that is not including parks and those kind of things that will come in a little bit later as each development comes in and starts to uh over and starts to develop within the the bulk tracks.

Um so anyway, so yeah, and then we're also asking for the zoning change to R4.

Um the R4 lots that are already that are zoned R4 now are doing really well, and so we want to keep that momentum going, and we think R4 is a really good um uh a good density for the area, especially given the uh the drainage issues and the water issues.

So um with that, we also are leaving it.

You know, there's still some C1, some SU for mixed use, and some light industrial that is still gonna be in the Cleveland Heights master plan.

Um so that's my little presentation.

And my big thing is over there the congestion is horrible.

It already for the lack of better terms.

I don't want to say it's horrible.

Oh, the congestion is a good thing.

Yeah, like you can't even get in around there.

The roads, it's one way in, it's they're one-way roads.

We got to do something that's better over there with the whole development of that whole area.

The there's got to be, we gotta look at uh additional traffic signals.

We're gonna have to do a lot more than just worry about building R4 homes, because the problem is we're plopping all these homes and all these schools next to each other, and it's creating a whole lot of problems.

And we need to really think through this and really make sure that we have a great plan for the community that makes it accessible, easy for folks to get in and out of, and right now I deal with enough complaints from Cleveland Heights as it is on kids parking all over the place during school.

So it's something we need to work on, especially since we're gonna have this high density of R4s over there.

Um we really need to think through that, Amy.

Yeah, uh Mr.

Mayor, uh Counselor Tyler.

So one of the things that is coming in, and I'll go back to this map.

Um so uh what you can see in the red, um, and so where all the mull mines are really close together is the existing subdivision.

There is a new subdivision phase that's coming in to the south of there.

That um housing subdivision that's coming in has already triggered the need for that traffic signal.

So um, as they're moving forward with that subdivision, that traffic signal at Loma, Colorado and PDB uh should be coming in.

Um, and so as each phase of these subdivisions come in, there are gonna be additional traffic studies, and and that the traffic uh should be mitigated for with each phase as it's coming in.

Okay, so that leads me to just one more question then.

Will that also lead to widening the road instead of just one lane both ways?

Would it make it now wider to a total of four lanes, two on each side?

On uh Cleveland Heights, uh so that's a great question.

I don't know the answer to that right off the top of my head.

Uh that would be something that as the subdivisions come in with their traffic impact analysis, it will identify if there needs to be expansions.

Um but I I don't know when that those expansions are gonna be triggered.

Because I my only thing is they're just the on both sides, public safety aspect of it, fire, something happens, critical incident at Cleveland High School.

Now everyone's locked down and they have no way out.

And um, so we really need to think through that a little bit over there, especially since there's that school sits right there.

Tonight I am seeking advice and consent on the award of the Rainbow Boulevard Connection Design Project between Southern Boulevard and Irving Boulevard in the city of Albuquerque to HDR Engineering Inc.

in the amount of $2,499,440 and 90 cents, which includes New Mexico grocery seat taxes.

This connection or the this project is the second pipeline infrastructure initiative.

And it's funded by a specific earmark in the FY25 budget.

During our project, uh the engineer will map all right-of-way needs, develop environmental documents, uh plan for termini phasing, uh, review utility needs, and ensure future growth is supported.

This project will follow all federal guidelines to ensure future eligibility for construction funding.

Um we anticipate the project will start in 2020 or October 2025 and will take two years to complete.

I should also say this creates another important and critical north-south route into and out of the city for our residents.

So with that, I'll stand for any questions you may have.

So uh for those out there that are gonna go, oh, look what's happening.

This is not the build, we're not building the road.

Uh Mr.

Mayor, you're correct.

This is only a design, it's right now we're just taking it to 30 percent, and most importantly, what we're trying to do is get a phase that makes sense that we can build.

Right because we know it's gonna be an expensive endeavor.

We add a big bridge over the Calabase Desarroy, and we need to make sure we build that and figure out what makes most sense box culvert bridge and how we get two lanes at least to and from before we worry about the four lanes.

So, yes, just the design.

Right.

So I just wanted to point that out because you'll uh invariably have somebody saying, Oh, they're gonna build rainbow and actually this is just the starting point.

So from this point forward, considering the terrain out there and the arroy and the drainage ditch that that comes across.

We're probably looking at potentially construction somewhere what 10 years down the road, maybe or Mr.

Mayor.

I hope sooner than that, but it could be it could be based on cost.

So just yeah, because first you get to get a design, understand what it's gonna cost, and then we gotta find the money.

Right.

Mr.

Mayor, if I may, real fast, and yes, I can actually elaborate on this too.

But one of the important things too doing the corridor study, then leading in the final design.

It helps provide guidance.

Yes, when we're interfacing with developers, there's a potential school to be built out there in the future.

So that is also very important document because there's a chance that private sector development will beat us.

Yeah, but now we have literally a roadmap to talk to them about how the what their portion uh would you need to be built.

Right.

That's between 10th Street North Northeast and Cherry Road.

And it's to compass Engineering and Construction Services, LLC.

They're the same company that did Spring Road in the amount of $2,487,000, $54.57, including uh GRTs.

The 19th Avenue Northeast Reconstruction Project is the third of three 2024 Geobond projects.

Uh during this project, the cons the contractor will complete full depth repayment, uh install a new water line with services as necessary, upgrade curb ramps to ADA compliance, install drainage improvements, which is needed out there, and update traffic signage.

Um it is anticipated this project will also take place in October and will last six months, and so with that I'll stand for any questions you may have.

Uh Mr.

Mayor and Counselors, I am seeking advice and consent on the award of the Aquatic Center Dehumidification Project to all right construction.

Any amount of $2,976,511.50, including GRTs.

This project is currently funded in the FY25 budget.

The aquatic center has been open since 2007, and the current HPAC dehumidification system is at it at the end of its useful life cycle.

Since the system is no longer compliant with the EPA's refrigerant requirements and has been unreliable over the last two years, we do need to replace this uh the system.

In addition to the HVAC replacement, we are also going to do stucco repairs to the back of the building, uh replace deteriorated floors, and uh restore the storefront of the facility.

It is anticipated this project will begin in September and take six weeks to complete.

Uh Aquatic Center staff have been notifying patrons since the end of July about this upcoming closure.

So with that, I'll stand for any questions you may have.

Moving on to R 97, resolution amending the city manager's employment contract.

Mayor, members of the governing body, uh, good evening.

Um before you, I have a requested amendment to my employment contract.

Uh both the requested amendments are tenure-based.

Um I currently have a cumulative 13 years and 10 months as an employee over your rancher between uh the two times I've been here.

Um the first one uh is longevity uh would be longevity pay based on my cumulative tenure with the city of nearly 14 years, as I mentioned, 13 years um and and 10 months, putting me in the uh first threshold of longevity pay at 10 years.

Uh this would be a thousand dollars a year spread over the 26 pay period, so it's not a lump sum payment.

Um, it is earned on on a on a pay period basis.

Uh the second request is uh sick leave conversion based on a cumulative tenure of 15 years.

I'd be eligible for this benefit in November of 2026, a little under uh 14 months regardless.

Um it would only have an impact, it would only have a cost impact on the city if I were separated prior to November of 2026.

Uh and the benefit is only applicable at separation and good standing with the city.

Mayor, members of the governing body, uh, thank you for um that that vote right there.

And uh thank you for the opportunity to to be the city manager and continue to serve the city of Rure Rancho.

As I um stated when I interviewed for this position now, four and a half years ago.

My goal, my dream is to carry out this job for nearly a decade when I can become retirement eligible.

Um we've made a lot of progress, and I hope to have another five and a half, six years to continue for us to make more progress with the solid, fantastic senior leadership team and employees that we have across the city.

So thank you very much.

I'd like to do a couple uh uh quick up uh updates and tidbits.

Uh one, just um building on uh the Rio Rancho Aquatic Center item that uh uh BJ referenced.

Uh we will uh actually reopen Rainbow Pool during the period that the Aquatic Center is closed, uh so it'll be available for lap swimming at Rainbow Pool.

Um growing up as a competitive swimmer, I trained outdoors even in the cold months.

As long as the temperature of the pool is there, you get a half a lap, you get a lap in.

You know, it's a little bit of a burr running back and forth to the water, but otherwise it's uh um you can still get a good workout in.

Uh so Rainbow Pool will be open, and we are also communicating that information.

Uh appreciate the uh comments of the members of the governing body acknowledging uh Chief De Filippo and his uh retirement.

Um uh Jimmy's gonna be missed, but there's a new Jimmy.

Um we'll we'll work with the new Jimmy.

Um, but the new Jimmy's days in the future today, it's uh Jimmy D.

Filippo, and um uh really uh appreciate uh the relationship that I was able to forge with Chief De Filippo and the very solid progress that we saw with Rio Rancho Fire uh under his leadership and with the support of the command staff, and we have two of the gentlemen from the command staff and all the the ladies and gentlemen of the command staff and their support because it is a team effort, all of us rolling in the same direction to make make some headway.

Uh two other things on Saturday uh September 6th, uh we have uh two city events, Pooch Plunge at uh Haynes Park, as well as Councilor Tyler's meet and greet event at Plaza Enchanted Hills at the block.

Um look forward to uh seeing you at uh in the public at both of those events on the sixth.
