1:39Uh 2525 Auburn Street Liquor and Tobacco Advisory Board recommends approval for the sale of liquor by the drink class L50 in conjunction with the restaurant and video gaming terminals in a C3 General Commercial Zoning District at 2025 2525 Auburn Street, Colleen Therese, Kaulaski, Michelle Kines, Eero House and Moore Incorporated doing business as a Eurohouse are the applicants.

2:20So I believe the last time we talked about gaming terminals, there was a number associated with or discussed about the city's uh ability to issue pass a certain number.
2:37Um can you remind me of that number, please?
2:41There's a term there's a cap at 600 terminals for the city per the host agreement with uh hard rock.
2:48And how many are we currently at?
2:57So we currently have uh Alderman, uh 579 authorized within the city.
3:03Um so this request is for five additional.
3:15Uh so I did have a conversation with the Alderman of the ward.
3:21So she knows my position on this, and I don't think it's any surprise to anyone that I always I I really don't love the machines in general, but when we add liquor and gaming to what I already feel is a vulnerable community.
3:42Um I just think that this adds to the cumulative negative effect of again adding liquor and gaming to communities, especially when this is like it's essentially a fast food place that put in their plan that while they have been established for three years, they need liquor and gaming to grow their business.
4:10And so I don't agree with that.
4:14Um so I will not be supporting this.
4:17Um I just wanted to go on record as saying so.
4:25Capavilla, I'm wondering if you can um it's my understanding that we we have previously approved um uh VGTs at this location, but that they but the the applicant actually never um pulled those and that this so this is sort of a this is a reapplication of something that we've already approved, but I don't know if it did it time out or something.
4:54Chair, the the it was four and a half years ago it was approved for uh liquor and gaming.
5:00My understanding is they did take the liquor license, but then they forfeited it in 2024.
5:05So now this uh new person has purchased this and they're partnering with uh this owner who is also has uh three other um you know uh taverns and our restaurants in town.
5:17So did do we know why they forfeited those?
5:24Did they did this location previously have the same number as as what's they were originally approved for that many, yes?

6:20We don't have a limit on the square footage.
6:22If they can fit the machines in and we and we we authorize them, then you know, as long as they can meet the state criteria.
6:30I know it I think areas have to be roped off or sectioned off in some sort, um, then there's no issues.

8:06Um, so item three is 609 Kilburn Avenue Zoning Board of Appeals recommends denial for a special use permit for planned use development consisting of a ground mount solar array within the existing parking lot, and um B variation to allow a chain link fence within the front yard along Acorn Street and C variation to increase the fence height from four feet to six feet within the front yard along Acord Street and then R2 Family Residential Zoning District at 602 Kilburn Avenue.

10:00You know, we received uh an email over the weekend from the Boys and Girls Club requesting uh that the item not advance forward.
10:04I had conversations with Alderman Bell um earlier today, um, understanding that this is his own item that went through a public notification process and that they wanted some time to evaluate the concerns that were raised.
10:17Uh we had discussed uh 30-day layover, which staff supports the case.
10:24But there was a notification.
10:25There was notification done.
10:30And it's concerns raised by that notification.
10:35No concerns on the notification.
10:37The current concerns that came out because of through the notification process.
10:42The applicant notified myself and others via email requesting uh the item not to advance forward tonight.
10:50I followed up with Alderman Bell.
10:52We discussed uh 30-day layover as a result of the request from Boys and Girls Club and on a staff level we felt it was appropriate, understanding they wanted the opportunity to evaluate the concerns that were raised by staff and the CBAs to see if they could address them.
11:08So I'm still what are those concerns besides the fencing issue?
11:13Yeah, I don't know the full um situation uh in its entirety because I wasn't at the zoning board of appeals uh meeting, but there was concerns raised related to the chain link chence as well as the freestanding solar in the parking lot.

13:14Zoning Board of Appeals recommends approval for a special use permit for a standalone coffee shop with a drive-through with deviations from the regulations for parking and landscaping in the C3 General Commercial Zoning District at 73 XX, East Riverside Boulevard 28 2018 DT Sandy Hollow.

13:49I just had a couple questions because on the agenda um initially uh what was in front of the ZBA included a special use permit for both the drive-through coffee shop and a um retail strip center.
14:06Uh but I think I was told I was told earlier today that is the strip center been removed from the SUP.
14:12And so I have the other conditions that staff had issues with with for instance the landscaping uh requirements.
14:18Have they now been met or are they still on the met?
14:21The coffee shop is uh about 90 percent satisfactory in terms of like our landscaping ordinance.
14:28So they're just asking for a deviation on the front area, which should be 20 feet, and they were and they're actually proposing 10 along and then also the parking setback, which was required at 20 feet would be at 10 feet as well because it would match the setback of the landscaping area.
14:44Other than that, they did withdraw the request for the remainder of the the retail center uh on the rest of the portion.
14:51Is there any any sort of reason why the landscape requirements can't be met?
15:00They wanted to have that correlate to the development that they were proposing to the east of the coffee shop.
15:06Because if they would have put in a 20-foot perimeter landscaping up on Riverside, then that would have offset the uh corresponding drive aisles between the two lots that they're proposing on this property.

15:29So I think I I read that too, and I was a little.
15:33So are you saying now that both staff and the board are for this?
15:42Or for the amended application.
15:44They the applicant amended this on the floor of this of the ZBA.
15:48So there it was advertised as a special use for a planned unit development for the coffee shop.
15:53In addition to that, they were asking for a retail center next to it.
15:58They've taken that off the board and they're just asking for the special use permit for the coffee shop now.
16:03So that's the only thing that we're voting on this evening.
16:06Under under the staff's report, it's exhibit F, I believe.
16:10It just shows the coffee shop.
16:12That's all we're voting on at this time.
16:13We're not voting on the rest of the development.

16:33Now that it's that that part is gone that that uh takes care of the infrastructure type, it issues that were presented.
16:45Um it's it's it's just taking the western part of this property and just saying we're just approving the coffee shop.
16:57Uh what was proposed on the eastern portion of the lot is now just been taken off the table.
17:02So that's not even a consideration.
17:04They will probably come back with a new plan for that portion of the lot and ask for a separate special use permit in the future for that.
17:16Maybe to help clarify that staff report is always written before it before ZBA considers the item.
17:24So the staff report recommending denial was before the amendment occurred at the ZBA.
