1:16How many people are on this moment?
1:26So everybody's here now.
2:28Yes, we are waiting for Administrator Cagnoni.
2:36Yes, we have a quirum.
2:39Um I call to order the code and regulations committee meeting for June twenty second, two thousand twenty-six to order.
2:48Clerk, please call the roll.
2:59So um for committee reports.
3:02Um we have several items tonight.
3:05Um beginning with number one, the thirteenth Avenue and seventeenth street traffic commission recommends the approval um requiring that traffic on thirteenth Avenue uh and be uh required to yield prior to entering the intersection of seventh street.
3:26Um is there a motion to approve second there's okay.
3:32It's been moved and second.
3:34Uh is there any discussion?
3:38Hearing not all those in favor say aye.
3:45And I meant to say aye, I'm sorry.
3:48This matter is approved.
3:51All right, item number two, Fourteenth Street and Tenth Avenue Traffic Commission recommends that a restriction be approved requiring traffic on fourteenth street to yield prior to entering the intersection of 10th Avenue.
4:07Can I get a is there a motion to approve?
4:11All right, it's been moved and second.
4:13Is there any discussion?
4:16Hearing not all those in favor say aye.
4:22Uh this matter is approved.
4:31Um Guilford Road, Prospect Street to Alpine Road.
4:35Traffic Commission recommends that a restriction be approved prohibiting commercial vehicles on Guilford Road from Prosper Prospect Street to Alpine Road.
4:46Is there a motion to approve?
4:48So is there it's been moved and second?
4:52Is there any discussion?
5:00Alderman from the Alderman Beach.
5:09I'm not sure if exactly what that means.
5:18Can we um little trucks?
5:21Yes, I will have to refer to Mr.
5:26Local deliveries, Amazon moving trucks, stuff like that would still be allowed.
5:31Commercial vehicles are our vehicles uh making it their direct route to uh um for commercial access, making it like a through street for commercial access, but this is for uh uh local deliveries, Amazon, UPS, they would still be allowed.
5:49So one last question.
5:52If rural hopes, for example, we would have a delivery from a big truck semi.
5:58Yes, they're still a lot.
6:04Alderman uh Toomberg.
6:06Thank you, Chairwoman.
6:07I'm speaking on your committee.
6:08Uh this is already in place, correct?
6:15There was no ordinance in place to actually enforce it.
6:19So this is a a bookkeeping type of uh request.
6:24So I I have uh could high crest.
6:29Uh I've had issues with individuals saying that it's being used as a cut through for commercial vehicles.
6:38Uh I let my constituents know that there are some commercial vehicles that are delivering uh within the neighborhood, and that would be allowed, but uh do we have that ordinance as well on ICRS right now?
6:53If not, could we look at do we just to make it more official?
6:58I will verify either way, yes.
7:01I'll verify and get back with you.
7:04By by nature, all through streets are truck routes, um, unless marked otherwise.
7:10So I will I will check on that for you.
7:13Is there any other discussion?
7:19All those in favor say aye.
7:22Uh opposed, same sign.
7:26The matter is approved.
7:28All right, item number four, no action items.
7:31The traffic commission recommends that no action be taken on the following items.
7:36One request to establish a four-way stop control at the intersection of Phaeton, Thayton Drive, and Wagnet Drive.
7:47Request to establish a stop control at the intersection of Pioneer Drive and Winthrop Lane.
7:54Request to establish traffic control at the intersection of Wisconsin Avenue and Holland Street.
8:01Is there a motion to approve?
8:06Um is there any discussion?
8:12All those in favor say aye.
8:16Okay, the matter is approved.
8:36So all right, item number five.
8:43Annexation of 14 XX Edison Road, 15 XX Edison Road, 16 XX, Edison Road, and a portion of 8631 11th Street.
8:56The subject property is currently agricultural farmland.
9:00The contract purchaser plans to develop an industrial subdivision on this land.
9:07Is there a motion to approve?
9:12Is there any discussion?
9:18Is this uh is this a part of will this if this were approved, would this be a part of um some of what we've been discussing today?
9:30Like the would this go into that area?
9:35Yes, it would, madam chair.
9:36This would be a part of the annexation of the property, and uh the next two items are also involving this property as well.
9:44Would they go into the TIFF district?
9:47They're proposed to go into the TIFF district, yes.
9:49Okay, if they okay, all right.
9:53Any other discussion, questions, comment?
9:56Yes, Alder Woman Tarina.
9:58Uh I'll just quickly say that excuse me.
10:01I did have a meeting with Mr.
10:03Good that spoke tonight.
10:05Um, and I thought it was a great meeting.
10:08I just appreciate the information that he shared, the plans.
10:12I think I definitely felt more at ease with the project um after the discussion with him.
10:19Um I think he made it very clear about rail service, being close to highway, being close to um cargo access, all the things.
10:32So I felt very comfortable after after the conversation I had with him.
10:35So I guess I just want to thank Mr.
10:36Good for meeting with myself and all the women needs to answer our questions.
10:44Any other discussion comments?
10:50Um all those in favor say aye.
11:02Oh, it says uh same sign, opposed, so I I oppose.
11:11So item number six, annexation agreement for 14x Edison Road, 15x Edison Road, 16xX Edison Road, and a portion of uh 8631 11th Street.
11:31Is there any discussion?
11:33Okay, hearing not, all those in favor say aye.
11:44Okay, item number seven, 14 XX, 15XX, and 16X, Edison Road and a portion of 8631 11th Street.
11:55Zoning Board of Appeal recommends approval from County AG or AG to I um three Airport Industrial Zoning District at 14 XX, 15XX, and 16X Edison Road and a portion of 8631 11th Street.
12:16Venture 1 acquisitions, LLC is the applicant.
12:20Is there a motion to approve?
12:24Uh is there any discussion?
12:28Uh hearing out all those in favor say aye.
12:35That motion um that matter is approved.
12:39Um item number 8, 52 or 25, 20 driftwood lane.
12:44Zoning board appeal recommends approval for a variation to reduce the required front yard set back from 30 feet to 20 feet and five inches in an R1 single family residential zoning district at 2520 Driftwood Lane.
13:01Uh Christian Solars.
13:05You told me what is it that you don't want me to read?
13:11All right, thank you so much.
13:13Um, is there a motion to approve?
13:16There's second, thank you.
13:18Is there any discussion?
13:20Hearing none, all those in favor say aye.
13:26That matter is approved.
13:28Number nine, eighty-five thirty-night East State Street Zoning Board of Appeal recommends approval for a zoning map amendment from R1 Single Family Residential Zoning District to C2 Limited Commercial Zoning District at 85 39 East State Street.
13:47Is there a motion to approve?
13:51Is there any discussion?
13:54All those in favor say aye.
14:00This matter is approved.
14:02Number 10, 714 Broadway, liquor and tobacco advisory board recommends approval for the sale of tobacco products in conjunction with a tobacco store in a C4 urban mixed use district at 714 Broadway.
14:20Is there a motion to approve?
14:29Is there any discussion?
14:35Hearing now, all those in favor say aye.
14:44So this one is essentially like they don't, they're not selling tobacco.
14:50I think they're just selling paraphernalia for tobacco.
14:55Um, Alderman Trina, they are gonna sell tobacco.
15:00It's going to be um they're basically the cigarettes are not going to be sold, but if they're going to sell the cigars flavored cigars, and they are going to sell uh vape material as well.
15:11This one staff denied this.
15:13Can you explain the staff deny?
15:16Um staff did deny this, so we didn't uh the initial plan was very vague when we first wrote the recommendation, then when we got the revised plan, it showed that they were going to have uh a lot of glass bongs at pipes, etc.
15:30And then the applicant decided to withdraw that portion of his application at LTAB, and uh LTAB asked if that would change our recommendation, and we said no, because it's kind of weird to have a tobacco store that's only selling something that's 10% tobacco and the rest all these other associated uh type of uses that are um that normally would be part of a tobacco shop, so uh that and the hours of operation seem a bit strange to us.
15:59So we definitely in agreement with that because it's only open like on the weekends.
16:06I don't remember the I don't have the documents in front of me, but only open on the weekend until two o'clock in the morning.
16:13Um to me, the business plan, business model doesn't fit with what I think the direction of the building of the vacuum should look like.
16:28So for that reason, I'll be voting home.
16:32Is there more discussion?
16:34All right, hearing none.
16:37Um all those in favor say aye.
16:46Motion uh is this matter is denied.
16:51All right, item 11, 501 East State Street, liquor and tobacco advisory board recommends the uh approval for the sale of liquor by the drink and the sale of packaged liquor in conjunction with a cafe, restaurant, and bar in a C4 urban mixed use zoning district at 501 East State Street.
17:16Is there a motion to approve?
17:20Is there any discussion?
17:26Um there's no discussion.
17:28All those in favor say aye.
17:34Okay, this matter is approved.
17:36Item number 12, 6075 East Riverside Boulevard.
17:41Liquor and Tobacco Advisory Board recommends approval for the modification of an existing liquor license to include liquor by the drink with video gaming terminals in conjunction with a restaurant and banquet hall in a C1 limited uh office zoning district, C2 limited commercial zoning district, and a C3 general commercial zoning district at 6075 East Riverside Boulevard.
18:08Is there a motion to approve?
18:12Madam Chair, I just like to let the I've got a late notice that the applicant wanted to extend his hours until 2 a.m.
18:19So if someone would want to amend that, um sorry, I'm done.
18:32Is there a discussion?
18:33I don't who made the motion?
18:38Oh, you I I miss I I shouldn't have said that, but I did not make a motion.
18:44All right, I'll make the motion.
18:54Is there discussion?
19:00Um Chief Sanders, can you?
19:02Um has there been previous activity or criminal activity as maybe the hours of midnight at this sorry are we on 13?
19:24Is there any other discussion for item 12?
19:286075 East Boulevard, East Riverside Boulevard.
19:38All those in favor say aye.
19:42Okay, this matter is approved.
19:47So that was the approval on hours to 2A.
19:52Oh, um with this amendment.
19:57Did anybody make a motion to amend the hours?
20:08So we just need a motion on the item passing.
20:13So it's a vote on the item motion and second.
20:16So just a vote on that item.
20:18So we need a motion to um on the item as amended, and that is with the 2 a.m.
20:26Is there can I get a second?
20:28I just think we just need a vote.
20:31Oh, we just need a vote.
20:36Uh opposed, same sign.
20:40That matter is also approved.
20:43Okay, now can I go to 13?
20:46Uh 922 Kilburn Avenue Liquor and Tobacco Advisory Board recommends approval for the sale of packaged liquor and the sale of tobacco products in conjunction with the liquor store in a C2 limited commercial zoning district at 922 Kilburn Avenue.
21:05Is there a motion to approve?
21:16Is there any discussion?
21:22Is there any discussion?
21:26Um, uh all those in favor say aye.
21:38Can we do a roll call?
21:40Um chair, I had my hand up.
21:43I'll be more intentional.
21:46I guess for this one, only why segment it because it's like if it doesn't go through, it's just gonna come back anyway.
21:53Like I don't understand the power of committee sometimes because all it's gonna do is we send it through denial, all the rewards gonna reverse it, and it's gonna pass anyway.
22:01The same thing we do every morning.
22:03However, this one was interesting to me because they're actually I was looking at the I think it was exhibit D, and I was looking at the amount of liquor in the area, and it actually wasn't a lot.
22:20So you know that seems like it.
22:22That's like how could that be a thing?
22:24Because it feels like they're being put one on every corner on the west and south side, but so I think I'm I as of right now I'm gonna be a yes, but I could change.
22:34I could change my next week.
22:39Any other discussion?
22:42All right, yeah, I I um as stated previously in many city council meetings.
22:50Um pertains to West Side Liquor stores.
22:53Would love to see some type of uh fresh food access.
23:00It may not be from the customer going to get a bottle of liquor uh or tobacco, but it could be the individual who lives on the street and doesn't have uh access to a grocery store nearby.
23:14So um it's been made clear that it's not a desire.
23:21Um so I'm I'm gonna be voted no on this one for other reasons as well, but don't need to say these.
23:27Okay, any other discussion?
23:31All those in favor say aye.
23:37All right, this matter passes a point of verification items on the five person community urban votes to be approved.
23:49So I just want that to be clear.
23:51So wait a minute, say it again.
23:53So I on three affirmative votes to approve.
24:00So if it's a two to one vote that fails.
24:02Okay, so it's failed.
24:04I'm sorry, this matter fails.
24:05Did another one fail that I okay?
24:12That I said it passed, but it really didn't.
24:16Item five two approvals.
24:23All right, madam chair, point of clarification.
24:27Is this item still go to count?
24:33Okay, thank you for that clarification.
24:37I believe we're on item 14.
24:40Okay, uh 3222 and 3208 South Alpine Road unit, liquor and tobacco advisable re board recommends approval for the sale of liquor by the drink in conjunction with a restaurant in an I-1 light industrial zoning district at 3222 and 3208 South Alpine Road Unit.
25:06Is there a motion to approve?
25:09All right, it's been moved and second.
25:11Is there any discussion?
25:14Oh, you're not holding your hand up.
25:17Thank you very much.
25:19All those in favor say aye.
25:25This matter is approved.
25:28Item 15, 7054 Walton Street, Liquor and Tobacco Advisory Board recommends approval for the sale of beer and wine by the drink in conjunction with a restaurant and video gaming terminal in a C2 limited commercial zoning district at 7054 Walton Street.
25:51Is there a motion to approve?
26:00Um is there any discussion?
26:05Thank you, Madam Chair.
26:08I will not be voting yes for this one either.
26:14I attended the zoning board meeting as I typically do, and I wasn't comfortable with the business model from this owner.
26:24And this is another sort of like catch style restaurant, like just to get chicken and go.
26:33And I don't see why a place like that needs liquor and gaming.
26:36So for those reasons, not we voting, yes, for this item.
26:42Is there other discussion?
26:47All those in favor say aye.
26:52This matter fails because we did not have three votes.
26:57Um proposed amendment regarding committee chair and vice chair selection.
27:05Is there a motion to approve?
27:07Madam Chair, this item was requested to be held out.
27:11Thank you very much.
27:12Number 16 is held out.
27:14All right, resolution.
27:16Um a request for authorization to allow the zoning officer to file text amendments for multiple sections of the zoning ordinance.
27:28Is there a motion to approve?
27:32Okay, is there any discussion?
27:36All those in favor say aye.
27:42So this one does pass.
