Um elaborate on the change.

0:53

What do you?

0:54

Sorry, the question we're just we had a pre-annexation agreement with them, and then when they received their um in the in the pre-annexation, I believe they had to get um the solar designation or get a solar contract of some kind, they have secured

Unassigned speaker

1:08

that.

Speaker 4

1:08

Um so we're ready to move forward with the full agreement.

Speaker 3

1:12

Thank you.

1:12

And this is I believe maybe a month and a month and a half, maybe two months ago we we approved something.

1:19

Is that right for this property?

Speaker 4

1:22

I do not recall.

Speaker 3

1:23

How long ago?

1:24

I feel like we

Unassigned speaker

1:26

uh,

Speaker 4

1:27

2025 was the pre-annexation agreement.

1:29

1:39

Yes.

Speaker 3

1:40

Can you does anyone know any more information on this on this development?

1:44

Can you elaborate, please?

Speaker 2

I don't have any details as to the development, but it is solar.

Speaker 3

1:51

1:55

What are you looking for?

1:56

Um, sorry, we're pinch hitting for Scott.

2:02

So

Speaker 3

2:02

all good.

2:03

Totally understand.

2:03

I could have been.

2:04

We'd like to know the

Speaker 4

2:05

we can get the information for you though.

2:06

You'd like to pay.

2:08

You'd like to know.

Speaker 3

2:09

Yeah, I'll say it again.

2:10

Um, and this is just committee, so we'll we'll continue on conversations.

2:15

Uh just want to make very clear we're receiving funds here in our community um uh so that individuals can be trained up in solar uh development through workforce development training and uh you know I think that as we approve solar developments here at City Council, we ought to encourage uh the developers that come to uh City Hall uh to go through this process of annexation and approvals that they would consider to um uh partner with the solar training programs that have graduated individuals to get on these jobs um so that they're building solar in their community instead of bringing outside folks to to do so.

3:01

So I'll continue to be an advocate for that, but uh we'll I'll have a conversation with Scott uh later this week.

Speaker 4

3:06

Sure, and we'll make sure that um I know the the last one that did come through, we did connect a number of um workforce connections to them and had different conversations, happy to do that again.

Speaker 1

3:17

Awesome.

3:19

Older one printy.

Speaker 6

3:22

I'm sorry, I'm not knowing that.

3:24

Um, is this the this is the one um this would be in the sixth ward, but I was concerned about how like who would serve this area?

3:41

So in the piece, it looks as though if somebody from this area needed um first responders, they would call Cherry Valley.

Unassigned speaker

3:55

It

Speaker 4

3:55

does have Cherry Valley Fire District listed on it, but again, this is gonna be a solar farm.

Summary of Proceedings

Rockford Codes & Regulations Committee Meeting – October 26, 2026

The Codes and Regulations Committee of the Rockford City Council met on October 26, 2026, to discuss several zoning, liquor license, and special event items, with the primary focus being a resolution to advance the public process for draft data center regulations. The meeting began at 12:30 PM and included discussions on annexation, workforce development, fire department resources, and data center performance standards.

Consent Calendar

  • Annexation of 54 XX 35th Street – Approved without objection. The property was awarded a renewable energy contract, making it contiguous to the municipal boundary. The parcel will be annexed for a solar development. Aldermen discussed workforce training opportunities and fire district jurisdiction. The Rockford Fire Department will respond to the property upon annexation.
  • Items 3-8 – All approved unanimously:
    • Special use permit for body art services at 5920 East State Street.
    • Special use permit for an auto body shop at 3509 Auburn Street.
    • Packaged liquor and tobacco sale approvals at 4106 Harrison Avenue (gas station/convenience store) and 4724 East State Street (convenience store) – both change of ownership.
    • Liquor by the drink and video gaming terminals at 501 & 507 15th Avenue (restaurant/bar) – change of ownership.
    • Liquor by the drink and video gaming terminals at 2525 Auburn Street (bar).
  • Stroll on State 5K Event – Approved for November 28, 2026, with street closures from 11 AM to 9 PM.
  • 2027 City Council and Committee Calendars – Approved.
  • Resolution to Advance Public Process for Data Center Regulations – Approved (roll call not detailed, but passed without recorded opposition). The resolution directs the zoning officer to file a zoning application for text amendments and schedules a public hearing at the Zoning Board of Appeals in November 2026.

Discussion Items

  • Data Center Regulations – City Administrator Cagnoni presented draft performance-based regulations for data centers, covering water conservation, stormwater, air quality, noise, setbacks (150-foot buffer from residential uses), decommissioning, and financial responsibility. He noted that due to non-home rule status, the city cannot outright ban data centers. Aldermen raised concerns:
    • Alderman Meeks questioned the lack of stakeholder input, the definition of data centers (hyperscale vs. standard), the performance review vs. special use permit process, the 150-foot setback (calling it insufficient compared to a half-mile to two-mile standard), and the absence of a bond for decommissioning. She cited the Essex example and requested a more thorough report before public comment.
    • Alderman Bell supported moving the process forward, reminding the committee that the resolution is just the start of public comment and thanking staff for advancing the conversation ahead of the February 2027 moratorium deadline.
    • Alderman Prunty asked about water systems (city has three zones), Four Rivers Sanitation District's governance (no city representation on its board), and intergovernmental coordination. She noted that the draft regulations were shared with taxing bodies but they were not asked for input. She also requested a field trip to existing data centers and multiple public comment opportunities (written submissions included).
    • Alderman Durkey confirmed personal familiarity with data centers in Elk Grove Village.
  • Annexation Discussion – Aldermen Bell and Prunty emphasized workforce development in solar and fire department resource concerns. Staff clarified that the property will be zoned R1 upon annexation but has zoning authority for solar farm.

Key Outcomes

  • All agenda items were approved by the committee, including the data center resolution (passed with majority support; no vote tally recorded but no objections noted).
  • The data center regulations will proceed to the November 2026 Zoning Board of Appeals public hearing, with city council consideration to follow, allowing adequate time before the February 5, 2027 moratorium expiration.
  • Staff committed to sharing the Metro Mayors Caucus data center resources, arranging a tour of existing data centers for council members, and providing written public comment opportunities for the data center regulations.
