Number two, submit the required proof of financial ability to pay for proposed work and discuss feasibility of repair dependent upon money at hand.
And number three, request the amount of time needed to complete the work.
All abatements ordered by the board shall be enforced.
All work proposed must be done within code regulations with required permits prior to commencement of work.
You may obtain all permits from the Department of Development Services located at 1901 South Alamo Street, San Antonio, Texas, 78204.

Any owner or lienholder dissatisfied with the order of this board may file an appeal in civil district court within 30 days after the date that the order is mailed.

I have one item to read into the record, if I may proceed.

We do have an emergency demolition structure located at 202 Avenue in Council District 5.
Um it is listed as an accessory structure.
Was demolished as an emergency on August the 6th of 2025 due to a fire which occurred on September 29th.
I'm sorry, July 29th of 2025.
Pursuant to Chapter 6-175.
No further action is needed by the board at this time.
There are before and after photos of that structure.
That does complete my report this morning, unless there's any questions regarding that.

And our first case is going to be 1412 Pasadena.
Excuse me, 1412 Pasadena.

For the record, my name is Crystal Town.
Dangerous Premise Officer for the City of San Antonio Development Services Department.
The structures being presented today are located at 1412 Pasadena with a recommendation for demolition in accordance with City Code Article 8, Chapter 6.
This is the first time 1412 Pasadena is being presented before the board.
Please note on March 25th, 2025, a dangerous assessment response team inspection was conducted.
The inspection is a collaborated inspection with variety of city departments that included the San Antonio Police Department.
The legal description is NCB 7101, block 234, lot 7 and west 25 feet of 8, located in City Council District 1.
The owner on record is Artuchi Gregory with the mailing address of 1412 Pasadena Street, San Antonio, Texas, 78201.
The property owner, Gregory Zertucci is present along with San Antonio Police Department Officer Pena.
The Office of Historic Preservation has confirmed on April 16th, 2025, the property is not eligible for historic designation.
The first inspection regarding 1412 Pasadena was conducted on March 21st of 2025.
The original notice was mailed on March 26, 2025, and the certified receipt has not been returned.
On April 2nd, 2025, an afteraction meeting was held at the city attorney's office.
The property owner was not present.
On July 29th, 2025, the notice for the BSB hearing was posted at 1412 Pasadena.
On July 28th, 2025, the notice for the BSB hearing was mailed to Gregory Zertucci, and the certified receipt was returned unclaimed on August 4th of 2025.
On July 15th, 2025, an administrative warrant was executed to obtain photographs of the structure to present before BSB.
No scope of work or financial proof or letter of credit or engineers report has been provided.
No permits have been obtained for the property as of today.
So this is the front elevation of the main structure.
So here's a closer view of the rotted overhang, and there is separation of the site wood plank siding from the structure.
This is going to be the left elevation of the main structure.
This is the rear elevation of the main structure.
Again, the shingles of the roof system are worn.
Here's a closer view of the sill beam of the post and beam foundation.
It is rotted and has severe water damage.
And again, the siding is lacking weather protection and is broken.
This is the closer view of the electrical panel.
CPS did actually cut services due to the electrical panel needing an update.
So currently the property owner is utilizing a generator.
This is going into the front door of that main structure.
The subfloor is exposed.
It is rotted and soft when you walk on it.
There has been some work being done at the property as well without permits.
There's multiple areas that are showing where they did some spackling where new sheetrock has been installed.
This is going into the kitchen area.
So the back portion of the room is missing the sheetrock over the ceiling, and the decking is exposed, which is rotted, and then the remaining of the kitchen area is unaccessible due to the large amount of items being stored.
So here's a better view to show that area of the kitchen, all the items that are being stored.
It is hard to access that area.
So here's a closer view of that decking that is exposed.
It is rotted and has the water damage.
So there is yellow Romax that is being exposed.
Romex was not utilized when the structure was built, so at one point, electrical work was being done without any permits obtained.
And here's a closer view of that subfloor exposed.
It is rotted, and that portion of plywood is coming up from the floor, posing a tripping hazard.
This is going into one of the bedrooms.
Again, some work was being done on the ceiling.
There's spackling shown.
This is the bathroom area in the hallway.
Again, the subfloor is exposed.
It is soft when you walk on it, and it does have severe water damage.
Here's a closer view of that subfloor exposed, and there's water damage.
And this is going to be the shower area that they're using.
And there is water damage on that upper right corner of the photo.
This is a back bedroom area, just a large amount of items scattered throughout.
The window is boarded up with plywood.
And here is a photo of the generator that they are now utilizing.
So this is going to be the rear accessory.
This is also occupied as well.
And there is a hole on the top left corner of the roof system, and then the remaining roof system, the shingles are worn and are missing.
This is going to be the right elevation of the structure.
The wood paneling is lacking weather protection, and it is detaching from the corner of the structure.
This is going into the front door of the accessory structure.
The slab on grade foundation is exposed and it has minor cracks throughout.
But this is the hallway where it leads to the bathroom, the kitchen, and then the bath of the bedroom.
So here's one of the cracks in the slab on grade foundation.
So this is the kitchen area.
There are multiple microwave ovens being plugged in to extension cords.
And then a stove top was installed into a wooden table, and there are uh there is an extension cord in that bottom portion of the photo.
This is the bathroom area.
They're storing a generator inside of the bathroom, so the bathroom is not accessible for use at this time.
And that would be the shower area.
Again, it's now being used as storage.
So this is going into the back bedroom area.
There is a slight step going into that bedroom.
And this bedroom is again filled with large amount of items.
The flooring is missing or it's unlevel.
So when you're walking, it is a tripping hazard, and there's extension cords being ran throughout in between all of the items that are being stored.
And here's a closer view of the overuse of extension cords.
And again, there is a generator being utilized, so this is posing a fire hazard.
And this is the door frame walking out into the main area.
The door frame looks to have been uh newly installed again with no permits obtained.
And this is the back portion again with the generator running cords um to the accessory as well as the main structure.
The structures located at 1412 Pasadena are in violation of city code, Article 8, Chapter 6, 156, subsections 1, 2, 8, 11, 12, and 15 for the main structure, and subsections one, two, eight, eleven, twelve, and seventeen for the accessory structure for which any building or structure which has any or all of the conditions or defects here and after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation pose a threat or potential threat to life health property or human safety.
Staff recommends demolition for the main structure and the accessory structure and for the property to be vacated.
That concludes my presentation for 1412 Pasadena.

That's the gas meter right there, right above it is the bottom of the electrical box, correct?
Yes.

The CPS has pulled the power.

Did they shut the gas off?
Not to my knowledge.
Those are directly above, and I didn't see where the gas line goes.
So according to CPS, their account still remains active.
So if they were to get the panel updated, they would still have an account.
They would still have electricity.
So they pulled for inadequate power source.
Yes.
The the City of San Antonio had nothing to do with with that aspect.
CPS did that.
Well, that's what I'm saying.
Yes.
CPS runs the gas as well.
Yes.
And they did not, they did not disconnect the gas.
As far as CPS notified me, they do still have an active account, so they wouldn't cut off the gas just for that.
They're waiting for them to update the panel.
And they didn't tell you why they pulled other than that.
How did they find that?
Correct.
They they don't disclose a lot of personal information.
Well, how did they find out the meter was inadequate?
Again, but again, they didn't tell you that.
Yes.
Um were they were there any indications that they were overloading, which is probably what it was, the meter with all the extension cords?
Yes.
During on our initial Dart inspection, there was a numerous extension cords being ran throughout the main structure and through the accessory structure.
And in the bathroom, it showed no shower here, but there was a yellow.
I'm assuming it was a hose, and you know there's yellow extension cords as well.
That was a yellow hose, correct?
Yes, it was a hose.
It was not an extension cord.
Did you count how many extension cords were in the generator?
No, I did not count.
Um I did not count the extension cords, but there was probably at least five.
And everyone went to a different area, and then it was yes.
Took off that.
Yes.
Um extensions and extensions and extensions off of those.
Yes.
And they have water.
Yes.
Did you on the egresses?
How many egresses were blocked?
The rear bedroom had windows that were blocked with plywood, and then the kitchen area just had a large amount of of accumulation, but you could still get to the rear, the rear door.
In the kitchen.
Yes.
But if you're in the back bedroom.
If you were in the back bedroom, you would not be able to get out of windows.
And it's yeah, you can't get out if the fire is in the house.
You cannot get out of that room.
So the egresses were blocked.
The bathrooms?
Did they have windows?
There was one bathroom and the main structure, and it did have a window.
Accessible from the bathroom?
Yes.
What about the other bathroom that was used for storage?
No, that did not have a window.
The accessory structure bathroom does not have a window.
And in the back room, these was it blocked on his egresses?
The back room of the accessory or for the main.
The back room for the accessory had a large accumulation of items.
There is a window there.
The bed was sitting in front of the window.
So you could still use the bed to get out the window.
Yes.
So there was no block there.
All right.

You went pretty quickly about the remediation of the yard.
How many cubic feet were taken away from there?
It was uh sixty cubic yards of accumulation was removed from the property.
The other area I like to get back to is where the the photo uh I think it was JPEG 28.
We I see this the the the seal plate, but the foundation beam is that gone right there.
This is right at the theory.
So the the soil beam, the sylbeam is there, it's just significantly rotted.
See that the soil beam is there, it's just significantly rotted.
Oh so you just deteriorated that four inches or so.
Correct.
Were you able to get underneath in inspect further?
No, there was too many items.
I was not able to get any close close view of underneath the structure.
Okay.
And there were loose dogs as well, so that was also another issue.
Um during our abatement, they removed five out of seven dogs.
Um, but during our Dart inspection, they got most of them, but there was one or two that were still roaming, so I wasn't going to put my head under a structure where there were dogs.
Yeah.
And then the final question regarding the accessory and really the main house as well.
I didn't see any smoke detectors or CO2 monitors.
There are no smoke detectors throughout the main or the accessory.
Are in the accessory.
And that generator in the bathroom, is it look like that's where it's been operating?
I think they were storing the generator in the bathroom and switching them out, utilizing depending on which one ran out of gas.

Cost of the abatement, do you have that?
I do.
The cost of the abatement was 1,168.
And you said they removed dogs the first time?
So the first time they did remove um, I believe three dogs from the abatement.
Uh no, that was during the Dart inspection.
During the abatement, they removed five.
Five dogs.
And when was the abatement?
The abatement was on July 29th of 2025.
So how prior to that was the Dart inspection?
The Dart inspection happened on March 25th of 2025.
So you removed uh eight dogs were removed.
And you still had some outstanding.
So they replaced the dogs that were removed.
I believe they did have newer dogs, and then some were the ones that were there on the initial inspection.

Thank you for being here this morning.
Um Officer Anthony Pena.
I'm with the uh San Antonio Police Department's West Safe Unit.
Uh been a part of the unit for about uh going on three years now.
So this property was brought to us uh through complaints from uh the neighborhood as well as uh criminal history.
As far as the complaints from the neighborhood, there was a lot of uh traffic complaints, foot traffic complaints, people coming and going from the house.
Um that's kind of that kind of that's a trend with uh with narcotics use.
Uh they come to the house, use narcotics, leave the house, buy narcotics, leave the house, whatever the case may be.
Um the criminal complaints, one of the biggest ones that we got was uh approximately a year ago today, um August of twenty-four.
Uh there was a shooting in progress um at the called at that location, uh focusing more so on the rear structure of the of the location.
Um there was a victim with a gunshot wound who unfortunately uh didn't didn't didn't make it uh from his gunshot wound.
Um therefore a uh murder report was was created.
Um since then we've had uh more calls for shots fired at the location.
Uh there has been uh narcotics that have been um college reports that have been made at the location.
Um recovered stolen vehicles have been found at the location as well as recovered stolen property.
So as stated uh March of uh March 25th of 2025, uh our office as well as code and other entities, city entities made location uh to address the uh the issues with the administrative warrant on that day uh the owner uh Mr.
Greg Zertucci, he was arrested on outstanding warrants.
Arrested on uh possession of narcotics.
on March of uh March 25th of 2025 uh our office as well as code and other entities city entities made location uh to address the uh the issues with the administrative warrant on that day uh the owner uh mr greg zertucci he was arrested on outstanding warrants arrested on uh possession of narcotics he had approximately uh nine grams of methamphetamine um in his pocket other persons that were there was another person arrested there uh for possession as well and there was a another person that was there that was arrested on uh on outstanding warrants that person that last person uh was actually um hiding um underneath a lot of the obviously in some of the pictures you can see there's uh debris throughout the house so he was actually hiding um in the debris during our our search of the house on the uh on our most recent visit to the to the house uh mr zertucci was again arrested on outstanding warrants uh which was uh the uh the abatement date um outside of that the uh the the house is i guess there's two schools there's uh st mary magdalena which is a catholic school um and then there's uh frankly elementary school and it's about between those two schools it's about inside a half a mile from the uh from the house that uh that's gonna conclude my uh my part thank you do we have questions of officer uh pena go ahead Caleb uh do you have a total on how many calls in the past year two years I can give an approximate I don't have uh year to date um I can go back as far as March of twenty five and we're probably looking at I'm probably gonna say over 30 calls for service um and that's just from uh a two year from March of 23 to March of 25 um that doesn't include what we've what we've done since March of 25 to to date um there's probably going to be more calls for service but it's gonna be well over 30 calls for service okay thank you go ahead with your question Fred first thank you guys for your service thank you sir um did this property is one of the outstanding properties in your district for a criminal activity it is an outstanding property um for for our service area yes sir and it actually sits I know I mentioned the schools it actually sits right next door to a uh to a church and they've probably gotten a lot of unfortunate camera footage um that they probably didn't want to see um coming from the yards or the yard of this this location the walk to school from children's level do they walk by this property to get to the school is in an active area where the children walk uh no it's not gonna be an active area um the elementary school is uh off of like West Avenue in Fresno and the Catholic school is gonna be north um a few blocks up I don't know what the uh I can't remember what the what the street is but as far as active um children foot traffic um it's if it is it's just gonna be because they live right you know right there but it's not gonna be an active walkway to the to the schools but in the area it's in it do you see on other calls on this call the same amount of individuals are some of the individuals from the area going to this place?
Uh it's criminals yeah so it's gonna be it's definitely a hub for for the uh for homeless um to kind of come and go from the house it's um definitely some of the same individuals that that we come across have been seen coming and going from the house um that we've encountered uh within the area the house itself is it set in an area where they can access the property not just from the street um I I don't know as far as where the back structure is at I know that there's there was probably some uh some fence damage back there and it kind of has like a little I believe um an alleyway um so I'm sure that they've accessed either through broken gates um through the church side um they've they can gain access to that you know to the to the front structure but it's easier to get to that back structure so it'd be safe to say that there might be more activity body wise than what's being seen at the front gate.

In the notes, uh, I don't know if you have them with you in our notes, the fifth line down where it says service, and then it goes into a a 10-day notice of violation was posted and mailed to the property owner according to Bear County appraisal for outside debris and stuff like that.
Correct.
So you didn't give the 10-day notice.
Who it's just on the record as somebody has a 10-day vacate.
Is that Bear County or the notes are from the Dart inspection?
So I posted a 10-day notice the date of the Dart inspection, and then also mailed a notice to the property owner notifying him of the violations.
That's what I'm asking, because it says in here according to Bear County tax appraisal.
Yes, we mail according to Bear County appraisal.
That's that's who we mailed the notice to.
Then there needs to be a step because that gave me the impression Bear County tax appraisal gave him when you read that.

Okay, so that that's why I want to clarify that that we you gave the notice, not Bear County Tax appraisal.
Yes, I posted the placard on the property so he could physically see it, and then he was mailed a notice of violation as well, notifying him to clean the property.
And that's what I wanted to clarify, not say Bear County did it because Bear County didn't do all right, thank you.

I'm just uh I really don't have anything to say.
I just just listening to what that's what I'm here for to understand what's going on with everything.

I never got it.
I only had one one certified letter from was in the last past two months, and that was for somebody who had stayed there a while back, but I never was no no notified or anything like that.
So you were never notified that the property was in violation of city codes.
Oh, yeah, I saw the paperwork and everything, but I wasn't uh it was posted on the wall, it was never given to me like that, or certified letter or anything like that, or and you were notified that there was a meeting at the attorney's office day uh no sir.
You were never notified.

So the time that you got the notification of the problem issues, uh nothing else happened.
You were never notified of anything else.
No, that's why I'm here today, because that's the first time I got it.
I was supposed to be a record data.
So you didn't make the attorney's meeting in the or the meeting between you and the city in the attorney's office.

You never got a letter stating to be there.
No.
But you got a notice on your door, supposedly.
And mailed letters stating that you have issues, but you didn't reach out to the city to find out what they were.
Um, this is the first I heard of it.
I mean, you know, I've gotten messages guards letters too, and I'm at first I've gotten to what was the certified letter that you got.
Uh uh, the one that certified letter was for a gentleman that was staying there a while back.
He was a sook on insurance, or somebody else it was a uh priority mail letter that went to the post office at uh vast Jackson, that's where it usually all goes, and that's the only certified letter that was there the last good six months or years.
I'm not certified letter in a while.
Besides my car being stolen, that was a while back.
That's the only further questions.

The Office of Historic Preservation has confirmed on August 21st, 2024 that the property is not eligible for historic designation.
The following is a timeline of events regarding the notification process.
The first inspection regarding 601 South Hackberry was conducted on February 12th, 2024.
Original notice was mailed on February 13, 2024.
The notice of violation was delivered on February 17, 2024.
On July 28, 2025, the notice for the BSB hearing was posted at 601 South Hackberry.
On July 28, 2025, the notice for the BSB hearing was mailed to the owner, and the certified receipt has not been returned.
No scope of work or financial proof or letter of credit or engineers' report has been provided.
As of August 11th, 2025, there are no permits on file for 601 South Hackberry.
On July 14th and 2025, an administrative warrant was obtained to take photos being presented today.
The photos that are being provided for today's presentation were taken also on December 2nd, 2024.
April 8th, May 27th, and July 14th of 2025.
The first photo is of the front elevation showing a single story structure in a residential zone built in 1913 with a pier and beam foundation.

Built in 1913 with a peer and beam foundation.
The structure has wood siding, a cross-gable metal roof system, and is 1,368 square feet.
This structure is located within a thousand feet of Douglas Elementary and Douglas Academy.
The structure is currently vacant and has had no water since March 27th of 2024.
The exterior of the structure has smoke damage, missing wood siding, and lacks weather protection.
The support posts on the front porch are listing to the left.
This is an angle from the front and a portion of the right elevation.
The wood siding is missing, again lacks weather protection, and you can see the roof decking along the right elevation is wavy.
This is the right elevation again.
Same issues are visible with the lack of weather protection and some missing siding.
This photo shows a portion, uh shows the front and a portion of the left elevation.
Due to the vegetation coverage, two photos have been taken for this elevation as well.
The flooring on the front porch is weather damaged, deteriorated, and it's very unstable as you walk across it.
The risk of falling through is significant.
The siding on the left elevation is lacking weather protection, and you can see on the left elevation, the roof decking is also wavy.
This is a photo that was taken by the initial officer back in December of 2024 without the vegetation present.
You get a better view of the additional smoke damage at the siding to the back of the porch where it meets the house.
The extensive rust on the metal roof is also visible on that back gable.
The front left post on the porch is leaning to the left, and it's also missing siding.
This is the left uh elevation at the rear with the same deficiencies.
Uh smoke damage is also visible at the peak of the rear gable.
The rear elevation shows more of the missing siding.
Uh the fascia and soffit at the top or the overhang on the the back porch are water damaged and separating from the roof system.
The trim is rotted.
Uh the porch posts are deteriorated where they connect at the bottom.
Foundation skirting is missing around the porch.
Uh fence panels were dumped at the property, creating egress issues from the rear entrance.
Uh we made entry through the rear entrance.
Uh this is looking into the the very first room, which appears to have been a kitchen.
There was a fire on February 7th, 2024.
Damage uh occurred at the walls in the ceiling.
The wood is charged, charred, and the wall covering is burned and missing.
The electrical panel on that wall uh by the doorway was also fire damaged.
This is a close-up of the exterior wall in the kitchen showing the charred wood and cabinets, the tile on uh the walls and the counters are also smoke damaged.
On the other side of the kitchen, uh towards the the rear of the house, uh the walls and the trim are charred as well.
The fire appears to have affected mostly the walls and the ceiling.
On the far right side of the kitchen, you can see the extent to which the fire damaged the ceiling, uh the ceiling joists and the rafters.
The ceiling boards are burned away and the joists are charred.
Roof decking uh on the inside is also smoke damaged.
This is uh if you back out from that same photo, it kind of gives you a contextual view of the damage that was concentrated in this corner.
The first room off to the right of the kitchen.
Uh we see more charring and smoke damage to a section of the ceiling and the wall.
The wall covering uh is fire damaged and missing.
The corner in that same room shows the wall boards are charred and missing.
There's a small section of the flooring in the corner that is missing.
It's my understanding from Ms.
Jarman that that was where uh an old chimney used to be that had been removed.
The room to the front of the kitchen uh has missing and charred wood on the ceiling.
The walls at the top are smoke damaged.
This photo um I don't know if it shows it as well.
Um I tried to get more of a focus into the actual uh roof decking up there.
I don't know if it's as light as I I probably should have tried to make it a little lighter.
But it what I wanted you to see was that the roof decking is mostly just smoke damage.
There's there's not hardly any charring or anything on that.
The opposite side of that same room shows the ceiling, the ceiling covering has collapsed and the wood is smoke damaged.
In that room on the other side of the bathroom uh to the front of the house on the left elevation, the wall covering is damaged and collapsing.
And on the opposite side of that same room, uh, it's also damaged.
The ceiling in that room is missing the covering as it has also uh collapsed.
This structure uh suffered a fire a year and a half ago and has not been repaired.
The structural members remain in violation.
To recap, the structure is located, the structure located at 601 South Hackberry is in violation of City Code Article 8.
Chapter 6-156, subsections 8, 11, 12, and 15, in which any building or structure which has any or all of the conditions or defects herein after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation pose a threat or potential threat to life, health, property, or human safety.
Staff recommends repair.

Um I pulled it up on Google Maps to kind of look around the neighborhood, and I noticed that in all directions around the house, it's brand new construction.
Um I also noticed some discrepancies as I moved along the map where there is a cane link fence and then there's a wooden fence.
Is the property secured all the way around to where the kids coming by the walking from the school can't get into the yard?
No, it is not.
So the the the gap is along the street side where the school's at?
Uh it's it's where where the driveway is that into the rear entrance of the property, it is open.

And um why are you recommending it for repair?
Because a lot of the other structural members are uh in fairly decent condition, and really uh the only reason it was brought before us was uh because it appeared on a fire report.
And uh as it make my way around, I don't really see any foundation issues other than the areas where the the fire occurred.
Um none of that really meets the definitions that would uh request us to maybe you know recommend something else.
And has there been any uh police activity at the property?
There has not.

Did the city put up the abatement, or was that already done after the fire?
No, uh, that was done uh by whomever was in charge of the property.
And the city hasn't abated or done anything other than get this notice that it was on the fire report.

The grass and the landscaping has been well maintained.
There are two accessories on the property as well that we are not taking because they are well maintained.
The fire started in the corner.
It looked like it was isolated in that one corner.
Was that because of the chimney or is the chimney in another corner?
The chimney's in another corner.
That they took down.
So do we have an explanation of what happened on there?
Was it an appliance that went up or?
I don't have an explanation on the report.
So the report just says it was a fire.

And you were notified that way.

Now, when you notified all parties, and you said the deceased is in an estate, so that you contacted the individual who claims owner.
What was the conversation?
So uh the original uh the initiating officer um spoke with Angela Harman.
Uh, she stated that the house was vacant at the time of the fire.
She stated that she had been doing renovations on it and planned to continue the renovations, uh, that her son had been cleaning out the house and that he would, and that she would reach out about doing a meeting to do an interior inspection for the fire.
She did uh eventually um allow the initiating officer to go in and take photos on March 2024.
She told the officer that she would begin repairs, and she was given 30 days to begin those repairs.
Uh, that did not happen uh by April.
Uh no permits had been pulled.
Um then uh after May, I want to say that uh there wasn't much contact at all after that.
Uh when I received the case, um, which was in March of 2025, I also called the phone number to try to make contact with Miss Darman, and um she didn't call me back, um, tried to find out if she was if there was any kind of an update about the renovations.
Um at that point, I decided to go ahead and proceed with the BSB case folder.
It wasn't until we made um entrance into the structure with an administrative warrant that I received a call from Miss Jarman.
One of her neighbors had told her that we had gone into the property, and uh prior to that I had absolutely no contact.
So when they say they were making repairs or renovations, there's no sign of renovations in there other than cleanup, correct?
That's what it looks like.
I don't know what it looked like prior to the fire.
So I wouldn't be able to answer that question.
Right, because renovations would require permits.
Correct.
So if they had a fire near, kind of makes sense it if the sun was in there, it would probably clean.

My name is Angela Jarman, and I'm in district two.

Um the estate is that's my father.
I'm his daughter, I'm his only heir, so I take responsibility for that property.
Um my grandparents built that structure, and my father and his siblings were born in that house.
So that's why when he passed away, I wanted to keep the the house and the family.
And I've been doing um renovations on it.
At one point, I was living in the house, but my mother got ill, so I moved in with her to help her.
Uh during that time, um, my things were in the house.
I wasn't actually physically living there.
I would go by and check on it, and it had been broken into uh a couple of times, and they had stolen my property.
Um at the time of the fire, no one was living there, and I still had uh furniture and items there.
Um I had a chimney in the kitchen, and we had it removed, and there was a uh a space on the floor that was open, and we had covered it up and everything.
Um since I wasn't living there, and I stayed at my mom's my mother has since um been deceased.
Um I'm sorry.
I'm so sorry.
Um like I said, the house was um vacant, and I had the electricity turned off because I wasn't there, and um about a week before the fire, the the water was on, and I don't know what happened.
There was a pipe that burst or whatever, and there was a like a flood, and the neighbor behind um got in touch with one of my friends because my friend um was passing by and she stopped to see what was going on, and the yard was flooded.
So she contacted me and I came over to see what was going on, and so I called the city uh the the water company and they came out and they turned off the water, okay, and then I actually had the water turned off.
And this was maybe a few days before that fire.
So there was no electricity, no water, none of that.
And I guess the vagrants or whatever, because sometimes there would be people trying to stay on the porch or whatever, they must have gotten from under the house and came in through the kitchen.

My neighbors next door, they uh called me about four o'clock in the morning to let me know that there was a fire, and they heard somebody in the house from what they were telling me.
I actually don't know how the fire started, but it was just in the kitchen.
And it messed up everything because I had brand new cabinets and everything in the kitchen.
Ma'am, according to the information that we had from the code officer, there are violations of the city code both outside and inside the the property.
Uh and the recommendation to us was that the uh structure be repaired.
Uh first question I've got for you, I guess, is are you aware of the cold violations on the outside of the house?
Yes.

Uh and obviously you're aware of the fire damage that happened on the inside.
Yes.
Uh do you have uh any information to share with the board about financial ability to make the repairs uh to bring it up to code?
Um I found a uh licensed contractor, and I've been talking with him, and I made arrangements for him to come on Saturday, and he's gonna do um he's gonna look at the property and tell me what what's needed, and I gave him the list from what was told to me, what needs to be done, and we're gonna um make a plan to do it in stages.
Now the property has two entrances onto the property.
The one that you were looking at, that's the side street, which is the back of the house.
I had a gate there, it was a wooden gate, and they kept trying to get in the vagrants or whatever, and they end up breaking it.
So I took it down.
Okay, so that's what you see, all that wood, that's that gate.
The other side, which is facing Hackberry, I had a gate there.
Well, somebody ran into the gate because one night they called me to tell my neighbors called me, tell me there's a a truck in my yard.
Okay, and they whoever did it, I guess they stole the truck and they ran because it was just sitting there, and the police called, I guess, the tow truck or whatever to come get it.
They never found out who did it, and so that was knocked down.
So on this Saturday, the uh contractor, he's gonna put up a gate there.
I already purchased the gate and everything.
That was this past Saturday, is that correct?
No, this coming Saturday.
This coming Saturday, okay.
Yeah.
Uh when did you actually see your contractor?
Actually, he's a neighbor, and I've been talking to him for the last two weeks.

Uh so he basically has a listing of the items that needs to be repaired to bring it up to code.
And he has not has he provided you a cost to it.
Yeah, that's what he's gonna do on Saturday.

Did he indicate any uh time factors in terms of how long he thought the repairs would take?
Um, well, I told him for the rafters.
I know that was important because the first time that I talked to the first officer, she told me to to take care of the rafters that are like over the kitchen or whatever.
Um he told me he could do that within 30 days, and then from there we'll we'll go from there.
But he wanted to do the most important things that so the house could be safe.

Um I'm gonna make arrangements with him, and most of it is gonna come out of pocket for me.
The insurance that I have for the house, it was an old policy, so it didn't have a lot of coverage, and I already used that to gut out the house and take out all the trash, and and I had dumpsters there and all that, so that's what I used the money for.
So now it's gonna end up coming out of my pocket and probably out of my retirement.

What's what would you like to see happen at the end of this road that you're gonna go down?
Um I would like to eventually move back into the house.

Uh but your immediate problem right now is the vagrants, and and vagrants can take that house down in no time.
What do you plan to do that uh to address that?
So right now I'm trying to secure the property at least with the the um the gates and everything.
Now when the fire happened, I had windows all over the house, like a regular house.
When I got to the scene, the fire department removed all of my windows, all of them.
That is why it's boarded up like that, because it wasn't boarded up before, and I have burglar bars and everything on on the house.
Just to mention about the boarding, is it all the entry points to the house are boarded up now?
I still have the doors, the original doors and everything, and I have the burglar bars, but I put that on there so the vagrants wouldn't get in.
Super easy.
And so every time I go in, I have to remove the screws and and all of that for now.
And so the the fencing, that's you plan on having that done this weekend, and then you're gonna get a cost estimate for doing the repairs, and then you'll come up with a timeline to actually do the repairs at that point.

Here you can see that the roof is dilapidated.
There are holes present in the front.
The facial boards are missing and damaged.
The structure lacks weather protection, and the skirting is separating from the foundation.
This is the right elevation.
It is within about three feet of the fence line.
Very difficult to photograph with the uh plants that are growing.
Um the siding that is present is uh deteriorated and lacking weather protection.
This is the left elevation of the structure.
Here you can see that there is plywood being used as skirting.
Uh, you can see damage to the foundation on the front uh elevation on the left corner.
Uh you can see that some of the posts are leaning towards the right, and there is deterioration to the sill.
Um you can also see that the siding is damaged and lacks weather protection.
This is the rear of the structure.
Here you can see the sag to the roof line.
There is damage to on the left side of the photo.
You can see that the roof has collapsed in that area.
There is a large hole present where the wall is missing, and that's the area that the structure has collapsed.
Um, and a close-up photo, you'll see that the foundation is also damaged and collapsing in this area.
This photo shows that close-up of that damage.
You can see that there were cinder blocks that were being used as um support for the foundation.
You can see that the foundation beam is damaged and broken.
Uh you can see one of the posts that's holding the broken beam, and you can see how it's sinking into grade.
Uh, this is a photo as you're looking up into the roof system.
You can see that some of the joists have uh collapsed and are just hanging on into the room.
There's damaged drywall on both sides, and there is visible damage to the roof decking.
This is as you're looking into that uh rear room to towards the inside.
You can see that there is no floor covering uh that is exposed uh grade and floor joists that are visible with weather damage.
This is a room towards the right of that hole in the area.
Uh you can see the damaged drywall that is on the ground that is visible grade, and there is no uh foundation present in this area.
Uh making entry into the room here.
You can see the damage to the floor joists and to the foundation, uh, the grade visible beneath, and that there was weather damage to the wood members.
This is the front room of the structure.
Uh, here you can see there's again no floor covering.
Um, they just expose foundation floor joists, and they are damaged, weathered.
There is natural light that is entering into the structure.
Here is that front room on the right side of the structure.
You can see that there's a large hole present in the rear on the side that and allowing access into it for any critters or uh animals or even vagrants, and that there is damage to the foundation as well.
This is the front room on the left hand side.
Here you can see the foundation where it is sinking into grade.
The joists are starting to uh bolt inward, and that there is damage to that uh beam.
And here is looking up into the roof or the ceiling of that room.
Uh, you can see the damage to the drywall and it where it is collapsing.
This is the rear room of the structure on the left-hand side.
Again, there is no floor covering, it is all exposed grade and foundation with damage to the joists and to the beams.
And here's a photo looking into the back wall.
Uh, you can see where that area where the most of the foundation is missing on the right hand side of the photo, and that the foundation beam is sinking into grade.
And here's just a photo of into the wall on that right hand side where you could natural light is entering into the structure.

Well, better question would be how much time can we allow on an order for demolition.
Just keep in mind that any resets are based on the testimony that is given.
And once the order, if if it is that the board recommends demolition, just for practical purposes, you do understand that it is a process for us to do it.
So if the owners go and do it where they transfer title and they can get the permit to demolish it before we get to it, or before the city gets to it, I should say, then that would be given the opportunity to occur.
You see what I mean?
Because it is a process, you know, and there's it it's a it takes it takes time, even though there is going to be a time limit.

Uh Jenny, if you want to chime in on that.
No, I think you covered, I think you covered it.
Um the limits do you need to be within within the reasonable times that we have available, but so in other words, once a motion is given or an order is given to demo a property, then we would have to wait the allotted time for the appeal, let that expire, and then in addition to that, after that is done, then get it to a contractor.
So in the meantime, if they're in the process, the owners of uh doing everything they need to do to transfer it to a new owner, then you know they can basically uh beat the city to the punch, so to speak.
The the reason why I asked the question, Fred, is because uh if if we uh reset the case, uh that means that everybody has to come back into the uh case if we uh since the owner wishes to have it demolished anyway, if we just order a demolition.
Uh it wasn't it wasn't I'm asking not for the reason because it goes two ways.
Even you can't ask for an open recess.
There has to be the closest when the count and if they don't have but on a demo, you also have to remember that you can't commit the demo until you as a presider sign the court order.
So there's another two weeks there.
So it buys them enough time almost 40 days plus by the time demo even if it's a 30-day demo.
There's a processing because we do have to go through our processing.
Um they'll have the opportunity to pull a demolition permit up until our contractor obtains our per the permit.
So, you know, there cannot be two demolition permits sitting on a property.
So one will cancel the other one out.
Typically, a if we have a contract to demo, we will cancel out any outstanding, we won't let that linger forever.
Uh a demolition permit is usually less than 30 days.
So if it's pulled, it needs to be done immediately within that permit pooling.
That takes time to apply for and and whatnot.
So we do give some time lot in there, but it is not open-ended.
There are as it's processing through, it will keep moving through the hands that need to uh check every box.
So I wasn't asking in a reset process, I was asking the the uh potential homeowner what their timeline was if they've already started the process because that's gonna naturally, and that then she answered that her sister is started the process.
The question would be once they put all the paperwork in, and they got to go through the other channel.
So either way it goes, there's time there that's gonna be played.
That was for the question of we can't just give an open-ended um reset, which was I don't think was talked about because they're already wanting to demo it.
So and then again, too, we just want to avoid resetting it just so that people can figure out their title because that may or may not be you know uh it like I said, we we don't want to be resetting cases so that they could figure out ownership.
And that was her question on the reason or her uh thing was she wanted to reset based off of that's what the questions come in.
I have a question really well.
Um if we order the demolition, uh is it going to affect the ability to change uh ownership of the property?
No, it's just that when they do do it, it's just usually if they go through a title company, the title company will let them know that that is actually occurring.
So and what she already knows because she's gonna be here if she is in fact the person that's gonna take over.

So I think what we're saying is that the the house is the public news that it does need to come down.
We're gonna give uh a 30-day looks like we'll move intowards a 30-day demolition.
In the meantime, though, you can work with your sister and get that permit pulled for for demolition and have that actually going while you're sorting out the uh the issue with the title.
So you can continue to move forward with everything you're doing.
It just that we're gonna actually move to have that taken down, I think.

The structure being presented today is located at 1711 East Carson Street with a recommendation for demolition in accordance with City Code Article 8, Chapter 6.
This case is the first time being heard before this board.92 of 9 and E 25 feet of 8, located in City Council District 2.
The owner on record is Joe L.
Smith with a mailing address of 1711 East Carson Street, San Antonio, Texas, 78208-1616.
All notices of hearing were properly issued as required.
The owner on record is not present today.

A phone number was found for the owner, however, I have not spoken with him.
The initial officer was able to make contact.
The following is a timeline of events regarding the notification process.
The first inspection regarding 1711 East Carson Street was conducted on December 4, 2024.
The original notice was mailed on December 18, 2024, and the notice of violation was delivered to the mailbox on December 20, 2024.
On July 28, 2025, the notice for the BSB hearing was posted at 1711 East Carson Street.
On July 28, 2025, the notice for the BSB hearing was mailed to the owner, and the certified receipt has not been returned.
No scope of work or financial proof or letter of credit or engineers report has been provided.
As of August 13th, 2025, there are no permits on file for 1711 East Carson Street.
On July 14th, 2025, an administrative warrant was obtained to take photos being presented today.
The photos that are being provided for today's presentation were taken on February 24th, May 20th, and July 14th, 2025.
The first photo is of the front elevation showing a multi-story structure.
It's single story in the front.
There was an addition to the back.
It's two-story on the back side.
In a residential zone, it was built in 1948 with a slab on grade foundation.
The structure has wood and brick siding, a mono-pitched roof system with shingles, and is 1,512 square feet.
The structure is located within a thousand feet of Pershing Elementary, which is actually on the very next street.
The structure is currently vacant and has no water, has had no water since February 17th, 2025.
The front overhang to the main entrance is sagging to the left side.
The structure is deteriorated and has deteriorated and detached siding.
The roof overhang on the second front entrance is weathered and rotted.
The brick veneer is separated from the structure and has step cracking caused by the foundation being unlevel.
This is a photo of the front elevation on the right side showing that second entrance.
The wood in the brick siding can be seen detaching from the entrance on that left corner.
The roof overhang has weathered and deteriorated wood decking that is collapsing on the left side of that entranceway.
The entry door is shifted and tilted also from the unlevel foundation.
This is a close-up on the front elevation showing that step cracking that I had mentioned of the brick veneer.
Here you can see the roof decking is sagging between the rafters.
The shingles are worn, and the overhang at the front entrance, the main entrance is sinking on the left side.
Wood members and the wood decking on the roof of that carboard carport is collapsing and detaching.
The posts are no link no longer able to safely support the structure.
This is looking at that carport from the right elevation of it.
You can see that it's listing heavily to the front of the property.
Wood members are warped and decayed due to a lack of weather protection.
The lattice pieces have fallen and are damaged from the shifting of the attached structure.
This photo is of the left elevation.
The wood siding is warped, detaching from the structure.
Interior items can be seen from outside the structure.
The wall studs are exposed completely to the elements, water damaged and rotted.
Floor joists to the far rear, which will be visible in the next photo, are also exposed and water damaged.
The missing wall and exposed wood framing is visible from here.
The windows are separating from the structural framing.
In the structure addition, you can see from the front to the back, right in the middle.
Fascia boards are missing from the top roof component towards the rear corner, and the shingles are now just hanging over the edge of the roof.
This is the rear elevation where the second story balcony is being supported by two by fours.
Those two by fours are listing into the structure.
This is the flooring for the balcony.
It is water damaged and deteriorated along with the rafters.
The siding on the side of there on the front section is detached and warped from the weather.
This is a close-up photo of the flooring for the second story or the roof of the ceiling for the first story right out on the balcony edge.
It's rotted completely through from water damage.
It's no longer able to support any load.
The ceiling joists backward attaches to the main structure are being supported by improperly installed boards.
This is the right elevation from the rear where the wall can be seen detaching from the structure.
The siding and the studs have collapsed, exposing the interior to the outside elements.
To the far right of this photo, you can see the amount of decay in the structural members right there at the top right corner.
A closer look of that same wall on the right elevation.
You can see the wall detached.
It's falling where the owner has attempted to support the wall, the falling wall with wood studs.
Some sort of bracing.
The siding is rotted and peeling away from the structure.
The roof decking at the top of the photo shows how damaged it is from lack of protection.
The owner built a wood ramp at some point around the structure.
It has decayed to the point that it's no longer safe to walk upon it.
There are holes throughout the ramp, making the exterior egress very unsafe.
This is the interior of the structure to the rear, directly under that second story.
The sheetrock has collapsed from the ceiling, and the amount of debris, insulation, and items being stored in the structure present a very real egress danger to first responders should an emergency occur.
This is the left side of that same room showing more of the ceiling sheet rocks collapsing.
This is over on the right side of that room.
You can see the sheetrock has collapsed completely off the ceiling joists.
There's a stairway right there up to the second floor.
I opted not to go up there for my own safety given the condition of the structural members on the outside that I observed.
The ceiling in that same room, this photo shows where this sheetrock collapsed.
You can see the extensive water damage to the ceiling joists.
It's on the right elevation, the right wall of the structure.
You can see that the roof was being supported by a 2x4.
It's sagging severely.
The deficiencies in the structure are so dangerous that the city will not send contractors out to the structure to abate the property.
We are unable to secure it from the back because of the photos that you saw of the ceiling collapsing.
So it's it's still open there.
We can't get it closed up.
We wouldn't send the contractors out there to clean the property as well.
There was too much of a risk.
Portions of the left elevation are detaching.
They're landing in the neighboring yard.
The last windstorm we had, we had a really bad windstorm.
I think it was in May.
And sections of that where you saw the studs were exposed.
And uh sections of that where you saw the studs were exposed, those sections just came down into the neighbor's yard.
Uh he was very concerned about addressed it with me several times uh when we came out to do re-inspections.
So to recap, the structure located at 1711 East Carson Street is in violation of City Code Article 8, Chapter 6-156.
Subsections one, two, five, seven, eight, eleven, twelve, fifteen, seventeen, and eighteen, in which any building or structure which has any or all of the conditions or defects herein after described shall be deemed to be a dangerous building and a hazard to public health, safety, and welfare, provided that such conditions of defects of dilapidation, substandardness, or unfitness for human habitation, pose a threat or potential threat to life, health, property, or human safety.
Staff recommends demolition.

That was I I did discuss that with the building inspector.
Um he said that we do not do that for um long-term deterioration.
But if it's a safety issue, and I I guess now I have to move over to the staff.
If it's a safety issue and it's been deemed not to get close to it by city employees, then stuff's falling in the yard.
Would that be an exception to the rule?
It was considered and not approved.
So that's why we brought it forward for determination from the board.
This case was expedited here.
Just to clarify, that would also include securing the property.
Well, they can't they can't secure it because if they can't get near it to put up security on the back and the walls are falling, then they've they can't that's what they're saying.
They can't even secure the property.
Yeah, and I agree with that determination.
It I think you went in there to abate that you would not have been able to stop, it would have been a teardown at that point.

We did use caution tape, uh, taped off the property as best we could, but um I did request for it to be expedited, and and that's why we're here.
Can I uh did the did the engineer state uh the city engineer did he give notes or just verbal?
I mean it would help.
We we did not have a city engineer review.
We do not have city engineers review for an emergency.
It is our chief building inspector that has a consideration.
Um chief, and there is a definition they follow, there is a determination they follow, they look at the photos, they look at everything.
They made a determination, and that triggered us to make a response to bring it to the next available board hearing once all notices had expired already.
