1:31Cases on the consent agenda will be right into the record in one uniform motion.

3:08Item number four is a request for approval of a resolution to amend the Southeast Community Area Plan from neighborhood mixed use to community commercial located at 1514 Rigsby Avenue.
3:20There were 38 notices mailed, five in favor, zero opposed within 200 feet, no registered neighborhood association within 200 feet, and outside the 200 feet, there were five in favor.
3:57Staff finds the proposed land use classification inconsistent with the surrounding area.

4:32And first I'd just like to say we appreciate being the consideration to be reset multiple times.
4:39And we understand that we've worked through quite a few issues with zoning and then my schedule, and we really appreciate your time.
5:00It's at the corner of Roland and Rigsby.
5:03I have gone to a barbecue restaurant in that location for pretty much my entire life.
5:08This area is always been mixed-use industrial, commercial, and residential.
5:15This particular property has had a yellow metal building on it for at least through the Google look back for approximately seven to eight years, but I think actually longer.
5:28It has consistently, and I apologize.
5:34Thank you for turning those.
5:41But this area has um bail bonds, it has taco areas, it has other industrial items, I'm sorry, industrial properties in the area.
5:53And there was a recent, I'm not, I'm not sure what address, but there was a recent plan amendment for another industrial property within about two blocks.
6:01Um my client is wanting to utilize the property as it has historically been used.
6:07We um also recently were made aware that the current setback of the building that has been there for quite some time is not in compliance with municipal code.
6:18So our next step after zoning and then planning is Board of Adjustments.
6:22Um my client has always wanted to do things in the proper manner and the proper method, and is asking to utilize this property for um used auto parts.
6:33I'm sorry, used car sales, as you can see through these photos.
6:37These all these photos are within two blocks.
6:38Directly across the street is a it's one of the school districts um fleet operations.
6:46Um it's where they park the buses and they refuel.
6:50It's a very large property, but it there's no residential directly across the street.
6:54But the entire two blocks, both right and left, are both commercial and residential.
7:01And so that is what I our request is.
7:03I know that there was a um a plan change the last couple of years that made this area residential, but before that it was commercial, and this property was actively engaging in commercial and industrial um exercises throughout that time.

7:36I do have one question.
7:37Is there any um automotive repair or make ready that's going to be proposed on those uh in that garage?
7:43Um the only make ready will be oil changes, nothing um more extensive than that.
7:48Um there won't be actually any repair done other than just prepping them for sale with oil changes.
8:01Um does the recent zoning appro change that was approved uh cover oil changes?
8:08This is in the Salado Creek watershed.
8:18So the the request was approved for C2 C D for motor vehicle sales.
8:23Um that would not permit oil changes.
8:29Just so long that your client is aware.
8:32We could make my client aware.
8:33It's definitely something we brought up during the zoning hearing as something that we would be doing for make ready.
8:38If that's an issue, then we can absolutely make sure that that is not done.
8:43If it's gonna be a difference between being accepted and not accepted, my client is absolutely willing to not do that.

9:02I just wondered, I saw that there you've garnered some support from neighbors on the street behind you.

9:50My client has owned this piece of property for quite some time and has a lot of good relationships with the neighborhood.
9:56And everyone wants to see something done with the big yellow building.

10:09So staff is required to mail notice to property owners within 200 feet of the property seeking the plan amendment.
10:15A check mark would indicate a property owner that wrote back in support of the request.

11:17Item number six is a request for approval of a resolution to amend the Southeast Community Area Plan from suburban tier to regional center, located at 322 Tarosco Drive.
11:28There were 18 notices mailed, one in favor, zero opposed within 200 feet, and Rainbow Hills Area Neighborhood Association gave no response.
11:35The proposed plan amendment from suburban tier to regional center is requested to rezone the property to see 3CD General Commercial District with a conditional use for manufactured home, oversized vehicles, cell service, and storage.
11:48Staff finds the proposed land use classification inconsistent with the surrounding area.
11:53The request would remove any low density residential zoning options and introduce higher intense commercial uses along the street to an established residential block.
12:02Staff recommends an alternate request of mixed use center, of which is already existing within proximity to the east and would limit the intensity of commercial uses permitted.
