Item number four is a request for approval of a resolution to amend the Southeast Community Area Plan from neighborhood mixed use to community commercial located at 1514 Rigsby Avenue.

There were 38 notices mailed, five in favor, zero opposed within 200 feet, no registered neighborhood association within 200 feet, and outside the 200 feet, there were five in favor.

I have gone to a barbecue restaurant in that location for pretty much my entire life.

This area is always been mixed-use industrial, commercial, and residential.

This particular property has had a yellow metal building on it for at least through the Google look back for approximately seven to eight years, but I think actually longer.

It has consistently, and I apologize.

But this area has um bail bonds, it has taco areas, it has other industrial items, I'm sorry, industrial properties in the area.

And there was a recent, I'm not, I'm not sure what address, but there was a recent plan amendment for another industrial property within about two blocks.

Um my client is wanting to utilize the property as it has historically been used.

We um also recently were made aware that the current setback of the building that has been there for quite some time is not in compliance with municipal code.

So our next step after zoning and then planning is Board of Adjustments.

Um my client has always wanted to do things in the proper manner and the proper method, and is asking to utilize this property for um used auto parts.

I'm sorry, used car sales, as you can see through these photos.

These all these photos are within two blocks.

Directly across the street is a it's one of the school districts um fleet operations.

Um it's where they park the buses and they refuel.

It's a very large property, but it there's no residential directly across the street.

But the entire two blocks, both right and left, are both commercial and residential.

And so that is what I our request is.

I know that there was a um a plan change the last couple of years that made this area residential, but before that it was commercial, and this property was actively engaging in commercial and industrial um exercises throughout that time.

The proposed plan amendment from suburban tier to regional center is requested to rezone the property to see 3CD General Commercial District with a conditional use for manufactured home, oversized vehicles, cell service, and storage.
