2:56My name is Samantha Benavides, Planner with Development Services.
3:00Item number 16 is the request for approval of a resolution to amend the South Central Community Perimeter Plan from low density residential to community commercial, located at 125 Stonewall Avenue.
3:14There were 30 notices mailed, one in favor, two opposed within 200 feet.
3:19Leo's Neighborhood Association gave no response.
3:51While commercial land use designations do exist nearby, they are appropriately concentrated along south floors, a designated secondary arterial and established commercial corridor.
4:01This corridor provides the infrastructure, access, and contacts necessary to support higher intensity commercial activity.
4:08By contrast, Stonewall Avenue does not and does not and functions primarily as a neighborhood serving residential street.
4:16Additionally, approval of this request would create an incompatible land use pattern by placing the existing single family residents immediately to the east between two properties designated for higher intensity commercial uses.
4:31For these reasons, the proposed commer community commercial request is out of character with the adopted land use plan and would undermine the stability and integrity of the established low density residential area.
4:41Staff recommends denial.

6:57So this it would be used just for parking.
7:02This this uh land this piece of land will be used just for parking, and uh just in case we need to do some light work that has that makes no noise so that we don't disturb the neighbors.
7:39Uh this would only be for um keeping the cars within that um land.
7:47And uh I know that some neighbors have complained for so some cars uh parked, but this is not uh my uh my cars it's a cars uh on the other side of the street.
8:10So my intention is to move all these cars to the to the land and then keep visible uh the clear vision on Flores Street That's it.

8:40Yeah, the applicant had stated uh that they wanted it to primarily use it for parking.
8:45Is there a uh land use that would allow for allow for just a parking lot to serve his his facility that is less intense?
8:52Most likely we don't ex we have parking lot use, but they'll most likely be left overnight for extended periods of time, and so that would be more of a parking um and or storage long term, and those are industrial uses.
9:15My question would be isn't parking already allowed on the street.
9:21You are allowed to park on the street.
9:24Um parking is allowed on public streets, but I can't answer on the times that you know the time dis links that you would be permitted to leave vehicles on there.
9:36So that's the most I could say on that really.
9:39What what we looked at on the Google maps or the street view is that one side of the street does not allow on street parking at any time.
9:47That's signs have already been installed by public works.
9:50Again, parking can uh be permitted on the street, but for long-term parking of vehicles needing repair for a business that would be problematic.
10:03Well, because the neighbors complain, but I don't know when they complain during the day or during the night.
10:08Yeah, I'm I'm not aware.
10:17Is there any conditional use that would limit it to parking only?
10:23I know that's kind of a rephrasing the question I was just asked, but um the gentleman did mention something about light work, and that's a whole different scenario.
10:33But if it's strictly for parking, is there residential with conditional use?
10:38There is not because it has to be uh you could potentially do a conditional use on a residential base zone, but it would only be uses that are permitted in like NC or C1, and again the parking andor storage is permitted in light industrial and I one.
10:57Which would have to go uh you would have to go to a commercial base zone, correct?

11:47I have questions about the fence that was put up in November and um whether there's a final inspection that's been done on that, and whether it uh what's already been built complies with the actual uh development code that we have on the books already.
12:02Um those are the questions that I have, but I don't know if either the applicant or any of the staff can answer them.
12:10Uh I think that I was gonna say we can we'll go ahead, we'll take a look at our permitting system for the fence permit right now.
12:21The Oh, I already have I already have there's if there's a final inspection outstanding, it hasn't been scheduled yet.
12:31So um yeah, so it really wasn't a question, it was more of a statement.
12:37I I think that for that person who owns that single family home that is uh directly east of the property to be sandwiched between um vehicle storage and uh an auto repair shop would be really unpleasant.
12:53Um and also for the people across the street, that would be unpleasant.
12:58And uh, you know, if the parking that's taking place on the street already is creating um sight line uh hazards at the corner there, then that's not something that um a plan amendment is needed for.
13:11That's something that parking enforcement is needed for.
13:14Um so I'm not gonna be inclined to support this plan amendment.

16:50Furthermore, the request could provide essential neighborhood serving amenities, potentially capturing local trips and preventing commercial traffic from encroaching into the adjacent residence.

17:39We have Tuzle Road to the East, and then Bendera is to the left, and we are adjacent to a little preschool called the Kids Garden Learning Center number two.
17:53Next week we're set to be before zoning commission.
17:57Um we're requesting a change from zoning from R6 to C2.
18:02Um, and that is the purpose for a retail strip center.
18:06So think any kind of C2 permitted use that will serve the community, like bookstore, bakery, jewelry store, professional doctor's offices, that kind of sort.
18:19Um, so again, we're here uh requesting a plan amendment from low density residential to community commercial.
18:28Um we have met with Braun Station West prior to submitting our zoning case.
18:34Um and they have issued um a non-opposition letter.
18:38Um they have some conditions, but those have been met.

19:41Um, why am I against it?
19:43We already voted against putting in a satellite in that area, and we are certainly against shopping center.
19:49We do not need more traffic in that area.

19:56I live at 7766 Crooked Road Street.
20:00I'm calling in reference to case number Z2026 107014.
20:08Um specifically turning the residential lot into a community commercial lot.
20:16Uh my concern is the few accidents that I've that have been in the area since I've lived here are specifically coming out of the daycare that is right next to the the zoning or the lot in question.
20:28Um due to the unprotected less and the generally high nature of the traffic flow in the area.
20:34I don't think it would be a good idea to add in more storefront possibilities, especially if it's a busy storefront with those unprotected less than the high rate of traffic, especially the unregulated speeding that happens all the time.
20:47Um not to mention the personal stuff with like the potential with excessive um like pollution coming into the yard and all that other fun stuff, but more specifically with the traffic is my main concern here.
20:58Um I do have some opposition towards this idea uh generally speaking, especially, but it's hard since we don't know what exactly the full development plan is outside of just turning into commercial.

21:21We'll start on the right with Commissioner De Suki.
21:26C2 uh to what extent and intense this uh zoning or planning would allow in the future.
21:36Uh are you asking like what sorts of uses would be permitted?
21:42So C2 would be a medium intensity commercial district, it would allow, I think it was some were mentioned in the presentation.
21:50Um small retail shops, bakery, restaurant, professional office, medical office, those sorts of uses.
21:58It does not allow big box retailers like HEBs.
22:03Uh it would not allow uh bars, tattoo parlors, those are all C3 uses, so it would be kind of in that medium intensity.
22:16Would in the future uh a C D of an auto shop would be allowed at some point?
22:21Not without going back through a change of zoning.
22:25So the the zoning that they're seeking is not paired with a conditional use.
22:30So to obtain one, they would have to submit a new application and go through the zoning commission and city council all over again.
22:41The neighbors in the back of this lot, have they have any concern?
22:49Have they worked with them?
22:51We have only been in contact with Braun Station West.
22:54Um, we have been in contact with District 7's office, and they haven't relayed any questions from them.
23:02There are several residentials that you'll gonna share defense with them.
23:07Those you haven't been in contact with.
23:15Oh, yeah, some question was mentioned earlier.
23:18Do you have a layout of what you're going to do on this at this point?
23:22No, I mean it's a pretty small lot, so it's just gonna be your typical rectangle retail strip center.
23:28So I would I would say something like uh to the west uh of this northwest community shops.
23:36I don't know if you don't have the map that I see right now at Gilbu and Old Tizzle.
23:42There is another store shops would be something like this.
23:45I I don't know what that one looks like, but it's just gonna be a pretty typical retail strip center following the UDC code.
23:54And remind me uh homeowner association have shared any response to this.
24:00The property owners association within 200 feet submitted a letter of non-opposition.
24:10I will ask Commissioner Siegel before we forget again.

24:32No, um, all of that, of course, is taken care of during the plotting process, but with the type of stores that are predicted to go in there, they're gonna be like the non-peak times.
24:42So I understand that daycare is right next door, but the in and out of the daycare would probably be different than ours.
24:49But again, that will be taken care of during the plotting process.
24:52So the traffic impact analysis will determine what needs to be done.
25:00And then to follow up on Commissioner DeSucci, the uh I think according to code, those properties on the south will be required to have buffering, uh screen fencing, et cetera.
25:08And they will be following all of the UDC rules.

25:20I just really had a comment.
25:21Um do you does the owner intend to put a means of egress off of a old village?
25:29Not that I'm aware of at this time.
25:31I think all of that again will be taken care of during the plotting process.
25:40I just wanted to ask uh so this is zoned R6, and you're not allowed to have driveways from single family homes go on to a thoroughfare, so and that they don't look deep enough to necessarily provide adequate lots.
25:52I think that's a little hindrance there.
25:54I so I was just curious.
25:55And also looks like this is the last parcel that hasn't done the right-of-way dedication to give the proper width down the way.
26:01So or I'll be in support of this.
26:07No questions from me, just I think uh kind of tying on to what uh Commissioner Orion said, it's uh logical use for the property.
26:14I'm not sure it could be uh used for residential anyway, considering the shape, size, and location.
