1:00Our first agenda is the combined hearing agenda.
1:03Cases on the combined hearing agenda are cases where uh staff recommends approval.
1:08The planning commission doesn't require further detailed discussion, and nobody in the audience is signed up to speak on the item.
1:14All cases on the combined hearing agenda will be read into the record in one unified motion.
1:18Anything not on the uh combined hearing agenda will be on the individual hearing agenda.
1:23Those cases will be heard individually before the commission takes action.

2:49Item number 12 might look familiar.
2:52We have uh this is a continued item from the March uh eighth um agenda.
2:57This is a MPA plan amendment uh requesting industrial from uh they're currently agricultural requesting light industrial.
3:06Um 56 notices mailed, three opposed outside the 200 feet.
3:10Uh we had three opposed as well.
3:12Staff's recommending denial of this.
3:15Um really it all ties down to the light industrial uses um being proposed right next to a neighborhood.
3:22We realistically light industrial is intended to be built uh are placed next to other manufacturing and heavy business uses, not next to residential.
3:31Um that's why we're recommending denial.
3:33Again, JBSA standard standard comments um and the applicant is here for any questions.
3:41The applicant like to address the commission.
3:49Hi, good afternoon, Commissioners.
3:50Ashley Ferramon with Killen Griffin and Fairmond.
3:53Um I I won't do the full presentation again, but we were tasked after the last meeting with reaching out to the HOA and seeing if there was any opportunity for agreement there.
4:02Um we did with the help of one of the neighbors that was here, get contact information for the management company, um, reached out and finally were able to get a hold of them.
4:11And as of last week, they said they have no questions and would let us know if they want to discuss further.
4:16So that is where we stand with them.
4:20Um happy to answer any questions.
4:22Again, we feel like the light industrial uh is the best option here across from the base and hope you would support it.
4:31Uh nobody signed up to speak, so we'll move to Commissioner questions.
4:34We'll start on the left with Commissioner Bustamante.
4:52The number of opposition was less than what we have today.
5:00And I understand that you have made an effort to reach out to the neighbors, specifically the close by, as well as the homeowner association.
5:04So now I have six opposition on this call today.
5:07I know nobody signed to speak.
5:10So would you just tell us what really happens?
5:13Why they are now having more people to oppose than that the last time?
5:21Yeah, we can so I mean the previous I'm sorry, following the previous meeting, we we did receive a couple of notices essentially right after that planet commission hearing.
5:33Since it was a continuance, we didn't send an additional notice.
5:38So those property owners that may that wrote in after that meeting were weren't able to be counted the last time, but were counted for this time.
5:47So this number is different than the number.
5:50So last time we had received two notices in opposition by the cutoff, and then after that, we got the four more, so that's how we're at six today.
6:03And if we allow the light industrial neighbors to the north and the south of this lot could request in the future a similar use for their land.
6:18That is aligned with light industrial.
6:20This would be open for discussion.
6:25I mean it it I mean a property owner can always ask.
6:30It doesn't necessarily mean that if this is approved, that will happen.
6:34They're allowed to ask today, regardless of the outcome.
6:38But but they would make the case that this is a similar use, and we just feel the like that we could apply for it.
6:51I don't have a question on the nature of the use.
6:54I don't think it's a very complicated manufacturing request.
6:58So I I don't have another question for you.

9:44My name is Joel Palimus, zoning planner with development services.
9:47Item number 14 is a request for approval of a resolution to amend the North Central Community Plan from neighborhood commercial to regional commercial located at 1315 Basi Road.
10:00There were 39 notices sent, one in favor, zero posed within 200 feet.
10:02North Central Neighborhood Association is in favor.
10:05Sherry Hills, Ridgevie Neighborhood Association in San Antonio, Texas, District One Resident Association gave no response.
10:11The proposed plan amendment from neighborhood commercial to regional commercial is requested to rezone the property from C2 commercial district to C3 general commercial district to allow for the development for auto motor vehicle sales.
10:24The proposed regional commercial land use is inconsistent with the surrounding properties.
10:28The surrounding land use classifications are neighborhood commercial, low density, residential, and community commercial, which are intended to support low-intensity commercial and low density residential uses.
10:39The proposed regional commercial classification would allow for more intensive uses than what is typical for the area and is inconsistent with the established locational criteria for regional centers.
10:49Such centers are intended to accommodate large-scale developments, including shopping malls, hospitals, and wholesale operations that serve a regional market rather than the immediate neighborhood.
10:58Furthermore, the subject property is adjacent to a residential neighborhood to the north, and the introduction of this classification could further facilitate the encroachment of high-intensity commercial uses into the surrounding residential area.
11:09Therefore, staff is recommending denial for neighborhood commercial to regional commercial.
11:14During the zoning commission meet and held yesterday, April 7th, the applicant amended her request to C2 CD commercial district with a conditional use for automotor vehicle sales rather than the C3 general commercial district.
11:27The amended zoning request of C2CD better aligns with the community commercial land use classification in a North Central Community Plan.
11:35As such, staff supports an amendment from neighborhood commercial to community commercial instead.
11:41The applicant is here to answer any questions.

12:14And that's to allow you to do what do you exactly exactly to do the car sales?
12:24My understanding was that the C T C D would permit car storage.
12:30So it would be an annex.
12:32We already have a car lot on 1203 and 1211 Bassi Road.
12:36So this would be an additional location to our car lot.
12:39My understand staff correct me if I'm wrong.
12:41I thought that's the question.
12:42I I had misspoke with the work session, but yes, it believes it would be automobile sales.
12:48Sales would still be permitted under C2CD.
12:51And that can go under the community commercial.

12:59Are you planning on using the uh alley for a means of egress?
13:03The alley was cleaned up because it was in very poor condition, but it will just remain an alley, and we already spoke to the neighbors to either side.
13:12Um so we all agreed that we will keep it clean and there wouldn't be any vehicles or anything on there.
13:20The existing structure that's there, that's what you're going to use as far as the office.
13:24Yes, it's it's a small office building, so we just knock down one of the walls inside to make it look like a bigger office, and um and we would be housing the vehicles in the back so that people can park in the front.
13:42Uh I do not have any questions either.

13:51So I noticed that the backyard is mostly grass with quite a few shade trees.
13:57Um I wonder if um paving has already been put into the backyard.
14:04Okay, and what um what kind of review was required for that?
14:09Because you're imp increasing the impervious cover of a commercial property.
14:14Um, I'm sorry, I'm not familiar with any of these.
14:17Was it permitted doing the paving in the backyard?
14:19Was a building permit pulled for that?
14:22Um we actually hired a company to take care of that, so if there were any permit requirements, I think that they would have taken care of that.
14:29I did agree with the neighbor next door.
14:31We knocked down the entire fence on the one of the sides, and she wants to do Cypress trees right there, so that would, you know, kind of help a little bit with the water running down because the um it'll be running like the the way the building is made instead of the water running towards the building and towards the sides, so the water would run towards the cypress trees that she wants to put on there.
15:00Could I ask for staff to take a look at that and see if the impervious cover was increased beyond what might be allowed for a property and whether or not a permit was pulled to make that modification?
15:08Not at this moment, but just going forward working with the applicant.
