And this uh it's an alcohol variance and it falls in the district of Miss uh Ivellas Mesa Gonzalez.

Your district, madam.

Alcohol variants, madam, is a whereby you're not a law, you're not allowed to sell alcohol within 300 feet of a education institution, the school, high school, college, and so forth.

But uh the state law gives the city council some discretion in that regard.

And so uh Ms.

Gonzalez, um I notice that this item number one, which all of you are going to be voting upon, is uh the idea of um okay continuing the just this kicking debt kicking the can down the road regarding this alcohol uh variance over near where within 300 feet of a college the University of of Texas specifically UTSA and uh yeah right where all the all the college kids uh um good congregate so anyway Ms.

Gonzalez, I'd appreciate it if you would uh well instead of you just continuing so say say no to the idea of alcohol being sold is Ms.

I'm an uh real estate agent here in San Antonio.

And it's in regards to the zoning for that cemetery's proposal.

And um when you see at the 200 feet uh residents around it that could really really oppose there's only like maybe eight families total.

Um there's a subdivision across from the proposed cemetery, which is Mission de Lago, which is getting a lot of uh traction into people opposing to it, but they're outside those two hundred feet.

Um so I don't know how strong their opposition would you consider that.

Um I've spoken to people along a street called Loreno Choa that kind of is directly in front in front of the what the proposed cemetery will be in the mission de Lago and few neighbors from within the 200 feet.

Those within are opposing.

Six families maybe and they're all opposing.

And um, so doing a quick research right now, you have mission burial park, San Jose Burial Park, six miles from this proposed cemetery.

Going south, you have El Carmen Cemetery, 4.5 miles from the proposed cemetery.

South side is not growing because it's dead.

North Side, you go all the way past 1604 with businesses flourishing.

South side stops at 410.

Not even then.

If you go down Roosevelt, you'll probably see a KFC, a Starbucks probably along four ten on that area.

So you can submit your comments for the record if you'd like.

Mayor Ortiz Jones, other members of the council, once again, my name is Jack Finger, and uh one item I do wish to bring your attention regarding this proposal to cont for continuance is item number sixteen.

And uh Miss uh Via Grant, I believe this is in uh just your district number three.

Ms.

Ria Grant, this one has so many red flags on it, and for for those of you on the rest of the council, I say the same thing.

What uh prayer do the uh citizens living near there have for a decent living situation?

Both the staff and the zoning commission said they this what is it uh an oversized vehicle storage location is just is not worth it.

The uh they talk that they talk about the commercial encroachment.

They talk to talk about the higher traffic, the noise pollution and other nuisances that are going to take place if this this thing goes through.

You also have the Harlandale McCullum Neighborhood Association opposing it.

Do you need any more reasons as to why you shouldn't just oppose the thing outright instead of kicking the can down the road again?

Uh maybe if anyone else would like to say something intelligent in that regard, why not speak up as well?

I uh appreciate if y'all would at least consider that.

Mungia for following your district.

I uh this thing has a, I don't know if you read some of the backup documents on this particular case, sir, but uh I I I don't think I don't see any reason why you need to continue this at all, because well, let me explain something to you.

Normally when there's a downsizing, I I'm normally in favor of such a thing, you know, from commercial to residential, but uh uh not unless unless there is a situation right like you have right here.

And the proposer wants to put ri residential units into our actually, I say residential, multifamily apartments right next to this commercial business here, and that's why uh uh the staff zoning staff thought it was thought it was a bad idea.

Uh residential uses right next to the commercial uses, but also another big thing that caught my eye is this, sir.

I don't know if you saw it, but they stated that the developer has not met the agreed upon obligations in the development agreement.

In other words, you got a trust issue here, sir.

Um why not uh say say no to this one?

This is right there on uh state highway 16 on the south side there, sir.

I I think you should say instead of continuing, say say no to it right now.

Uh my name is once again is Jack Finger, and uh I wish to speak to you about a couple items on the consent agenda that you're about to allow to sail through.

One of them is item number six, and this is in uh Ms.

Msukar.

This is in your your district there.

You know, um I was on the committee that uh dealt with this very issue, and uh it was a pretty pretty tough case.

Uh uh the uh eventually decided that that it was worth allowing the proposer to uh go ahead with this, but uh uh there was still still quite some discussion and uh uh about it.

The concerns the fact that four units being uh shoehorned into this little area here is is going to make it very dense, excessively dense, and that you really shouldn't have any more than two units there.

Quite frankly, I think uh I wish you would uh offer an amendment to change it from two from from four down to two so that uh all of us living around the area don't have to deal with the problems that excessive density causes for the neighborhood there.

So yes, right there on on West French Street there.

Um I was looking at this particular one.

And the reason the uh zoning staff thought this was a bad idea is because the uh the as they say the oversized vehicle service and storage that's going to take place on this the street.

Normally that would be okay if you had a bigger uh street, a boulevard, main artery or something, but this is on a tiny but residential street, little little heartline drive here, and they see the problems of it congesting the uh the that street with no buffers for the residents, meaning uh you have a big uh business dealing with oversized trucks get going in and out, and the people who have to live next to it have to suffer with all of that there uh needlessly.

So uh, I think uh I think you do well if for all the residents in that area and for the rest of your district if you just simply say uh we're not gonna go ahead with this uh travesty here.

Are or yeah, our applicant, the longtime property owner is making an effort to reconcile their property zoning to achieve zoning uniformity.

They've also amended their original site plan to include concessions in consideration of their residential neighbors as well as documenting their support.

Not much of a buffer.

They have to live right next to this industrial use.

Why not uh at the very least you could continue this and see if the the if the residents really enjoy living next to an industrial use there?

But you really uh I don't think you should just go ahead and willy-nilly, as they say, go ahead and and just approve it because there are people who are going to not only live there but may want to live there in the future, and uh they have to live next to a very inappropriate uh uh company.

So uh I appreciate if you would change your mind, sir, and so say no to this one.
