So good afternoon, Mayor and Council members.

My name is Mary Ann Smith, and I live on Jansen Road in the Mission Novago neighborhood.

Um I stand here today representing the voices of our community.

I have 66 white households that have signed our petition in opposition to this rezoning, along with 230 digital signatures and at least six property owners within 200 feet of the site.

That's 897 families, neighbors, and community members standing together in opposition.

We are not alone.

The neighborhood associations of Via Coronado, Hot Wells, Mission Reach, Representative Lujan, and the Southside ISD Board of Trustees have also voiced their opposition to this cemetery.

Each of us have our own reasons for saying no, but together we are reunited in one message.

We respectfully ask you to deny the proposed cemetery.

Um I will uh reserve most of my comments for the next meeting.

Um I will say though that um this uh cemetery rezoning request is really a disservice to our community.

Um city council members have probably never ever received a request from your constituents to put a cemetery in their district.

Cemeteries do not pay taxes under Texas Property Code 1117.

So our tax base is shrinking by rezoning land and classifying it as a cemetery, and so that burden of taxes is now being shift to the neighboring property owners.

This is nothing more than a redistribution of wealth from a an applicant who's publicly traded on the New York Stock Exchange, who will never pay taxes, but they'll be happy to sell plots of land to our community and take advantage of them, and they'll never get back.

No sales tax, no proper property taxes are ever paid on a cemetery.

And these people in this community in district three deserve better than this.

This community is finally starting to get the development that they need and that they deserve, and that hope and that progress is what these people deserve.

We cannot, as a community, we cannot stand here and underfund education for a community that needs it.

You know, most of these people that live on the south side, the conditions that they live in is not what you would find on the north side, and it's disappointing.

And as someone that lives on the north side and grew up on the north side, but I spent my entire 20 years of living in San Antonio going to the south side to visit our property that's adjacent to this to this track.

You know, and and these people are scraping by, and here we are taking property, very valuable property on a major art arteriary road, and we're taking it off the tax rolls for the benefit of a corporation at the expense of cutting funding to not it's not just the school district, it's the city itself.

The city stands to lose millions of dollars not only now but in the future.

And you know, when when I go to the budget meetings for my district and I listen to them, you know, our community members saying we need more police, we need better fire services, but what yet we don't have the money, and here we are taking a piece of property off the off the county tax rolls.

To me, it seems very hypocritical that we're at this junction and that this is even being considered, especially for a service that this community doesn't even need.

Yes, um, and just to clarify something, Madam Mayor, I'm speaking on certain items that have been continued, are being planning on being continued.

Uh few items I wish to bring to your attention that you're planning on continuing to a later date.

Uh I I'm gonna skip around here.

Item number 15 15.

Yes, um Ms.

Castillo, this is in your district.

It's about uh changing a duplex area to about to a four-plex area.

Uh that's starting to get pr pretty dense in that area, Ms.

Castillo.

Uh in fact, uh in the very induced notices that were sent out to within 200 feet, uh, you had at least three people oppose that.

Maybe be because they they themselves have thought it was starting to get pretty dense in their neighborhood.

Yeah.

Um maybe just maybe and this has already been continued from August 21st, sir.

So my suggestion, Ms.

Castillo, is just simply say no to it all together and and go from there.

Uh let the chips fall where they may.

Another item wish to bring your attention on the that you're planning on continuing is item number number three, and Mr.

White, this is in your district, it's about an alcohol variance.

It's about over on preparing bottle road, and it's about uh well, basically they want to sell alcohol within uh 300 feet of the uh well, what they call the School of Science and Technology, the uh a prepar a preparation high school.

Uh why not just simply say no to the idea of selling alcohol where where a bunch of high schoolers will walk to and fro to to the high school there.

So yeah, um I I think I mean unless you really want to allow the promotion of of uh alcohol to to two um key kids as they w walk in that area.

I I would not like it, and I think uh you you should say say no to it as well.

I mean, why not?

You know, uh let's see, just just checking here.

I think that's uh that's Madam Mayor, that that's about all I have to say.

I am Maite Goodino, and I'm I'm here to say that I am opposed to the cemetery because they don't provide tax revenue.

As a homeowner and as a mother of two kids in elementary school, I really don't want my kids to grow up right next to a cemetery.

Um I have gone door to door, and I even have just um right now, like 30 minutes before coming to the meeting today, I got like five signatures from the commuting.

I've been collecting signatures against the cemetery of neighbors that they can attend to the meeting to the city council to the meeting at 2 p.m.

And I just have to say that um because of their responsibilities, they can't attend to the meeting.

I just have to ask respectfully the city council to vote no against the cemetery because there's so many other things that we do need, and actually, just in the district three, we already have like 20 cemeteries.

If you can like and that's it.

I am Teresa Cantu, and I am here to oppose the cemetery.

For those of you that don't know the area where it's going to be, La Via Coronao started in about 1954, because the city of San Antonio at that time used to throw out their delinquent kids, and they still had to go to school.

So this man built these two room houses with outdoor toilets.

In that time, uh Ms.

Dubner and uh another council lady started getting grants for La Via Coronao to get uh streets, not sidewalks, but just streets because they were dirt roads.

It has in that time, it has taken 70 years to get sidewalks on Roosevelt, like just one mile, 70 years.

I grew up in the neighborhood.

My parents bought there in 1940, so I know what it's like.

I graduated from nine in 1967 from South Side High School, and I know what we did without.

I'm here to tell you there are 250 cemeteries in Bear County.

There are 20 in District 3.

We don't need more.

What we need in this area is a library, a recreation center for our kids, some mentoring, because we have been redlined since 1954, and I oppose it because you all have not been to our neighborhoods.

You don't know what it's like there.

So I respectfully ask you not to vote for another cemetery.

They will not provide revenue of any kind.

District one through six already the cities council districts one through six already have cemeteries under the city.

So why one more?

Where is that revenue gonna come from?

Certainly not from the other districts.

Your districts, the revenue is not gonna come to the south side.

Yes, my name is Julian Cruz, I'm a real state agent.

And I oppose to the construction of the cemetery.

I was here last month.

This meetings and this voting keeps being postponed and postponed and postponed.

I have one of the neighbors from the within 200 uh feet uh here with me, Miss Angeles.

There was another lady that couldn't make it because she has uh eye surgery, but she's also opposing.

Um I was last night at the board meeting of trustees of the South Side Independent School District.

They voted against the construction of this cemetery because they understand that a cemetery is gonna provide it's not gonna provide any kind of uh property taxes or money coming into the district.

Um I will respectfully uh implore you.

If you can vote today, just say no.

I mean, it's the logical.

Everybody's opposing uh Mary Ann has over 600 signatures.

I have most of everybody that lives within 200 uh feet uh from the cemetery, which is not many neighbors, but I have the majority signing against it.

So why not voting today?

I mean, I know there was an extension request for another uh October 2nd, you know.

That day I have a doctor's appointment.

We'll see the other people can make it.

You know, everybody is has to uh Miss Ankeles has a business right next to the proposed cemetery.

She owns a beauty salon and she has to leave it unattended to be here, and then she had to wait and then possibly see if maybe she can do the same thing for next month.

Um I just don't think it's fair for them.

I don't think it's fair for any of those neighbors.

Let's vote.

Let's vote no.

And I mean it's it's you cannot go wrong with that, you know.

The South Side Independent School District needs the money from more homes from more businesses not coming from cemeteries because there's nothing there for them.

Um I'd mentioned the last time if you come down from Militai Drive going south.

That's about five miles.

You have San Jose Burial Park, a city cemetery that will stop uh getting revenues because and that's a city income for them.

You have a mission park, and then you have El Carmen Cemetery.

All those big cemeteries with lots of space still, you we don't need another cemetery in those five-mile, not even radius, you know, straight line on Roosevelt.

Let's vote no.

If we can do it today, let's do it today.

Why postponing it?

I don't think it's fair for anybody of the neighbors.

Yeah, um I was looking at the backup documents on this one, sir, and I noticed that uh they're planning on placing a battery storage area very close to the uh residences there.

Yeah, this is I repeat this is over on on Marbach Road.

Maybe if you looked at the map on that, sir, it's uh it's one thing to have a uh a battery storage area, but it's another thing to place it just across the street, essentially across the street from all those uh single family residences there.

Uh they're the ones who have to live right next to well, the uh the traffic, the uh the potential for for chemical uh contamination from solar batteries and so forth.

Um I don't see much of a buffer there, sir, and maybe you'd want to place an amendment saying that uh if the before they place it there, there's got to be much more of a buffer than a mere uh street.

So yeah, uh and also uh for elsewhere on this portion of the agenda, uh I wish to bring your attention very items one and two are alcohol variances.

Same uh same routine as I mentioned a few minutes ago to Mr.

White about uh the alcohol being sold within 300 feet of some schools.

Yes.

And uh item number one is in uh miss uh Ms.

Via Grant that that's in your district, it's over on Pleasanton Road, and they're planning on selling alcohol within 300 feet of the Carroll Bell Education Center.

Yeah, um why you would want to allow that to happen, I don't know.

Uh but I would encourage you not to allow them to sell alcohol right next to where the school kids travel.

Um item number two is once again in Mr.

Mr.

White's district.

I don't know, he's not sitting in his chair at this time, so uh I don't know who's going to carry the water there, but I would appreciate if someone would tell Mr.

White that uh the uh if you're planning on they want to sell alcohol within the within 300 feet of the Greater Hearts Great Hearts Northern Oaks School, a public charter education institution right there on Bulverdi Road.

I wish somebody would say no to that when it's thank you, sir.

Yeah, um, I was looking at the documents on this one, madam, and uh well, there are many red flags on this one that not only you but every member of this council should be concerned about.

Uh one of the but of course one interesting note here is that this thing has already been continued from a previous city council meeting.

The idea is why why are we still dealing with this when it should have been denied weeks ago?

Yeah, uh the idea is that they want to put an oversized stored vehicle storage unit here.

And the both the zoning staff and the zoning commission thought these were very bad ideas.

Why?

Well, they stay in their very own documents, and maybe you I'm sure you've read them.

It says that the start talks about it it uh, but it's right next to the residences there.

No, bad idea but placing it right next to where single family residents live.

Also, the commercial encroachment, commercial encroachment.

The idea of letting commercial establishments and establish themselves right in the communities, and uh it adds to the a bad example whereby it becomes easier for more commercialism to establish itself right next to uh single family residences.

And and also they the other things they noted were the uh the increased noise and traffic and other nuisances there.

Well I also noticed that the uh one of your neighborhoods there, the McCullum Harlandale McCullum Neighborhood Association opposed it.

They may have cited the very same reasons that I have when the zoning commission met there.

So maybe just maybe Ms.

Via Grand, you'll want to say no to this one instead of doing anything else with it.

Yeah, it's about a uh changing designation that is non-alcoholic in sales to well, something that allows alcohol to be sold.

Um it's a it's in a non-alcoholic corridor, and that was established with I I add to the support of the neighborhood.

And this was years ago.

That's that's where it came from.

That's why the zoning staff thinks it's a bad idea to go ahead with this.

So where is it?

Well, it's over on historic old highway 90.

So uh why not just say uh no to uh to this and uh not pile up the neighbors who with a councilwoman who wants to allow more alcohol sales at in an area where they don't really need it anymore.

The neighborhood association cited that this was one of the best presentations that they've received from an applicant, and they want the presentation uh from the applicant to serve as a model for future rezonings in the neighborhood.

Uh the Los Haradines Neighborhood Association is in uh support, and the members within uh that were present for the presentation were supportive of the item.

Staff, Planning Commission, and Zoning Commission recommend approval.

Staff mailed 41 notices, one was received in favor, eight were received opposed.

There was no response from the Collins Garden Neighborhood Association outside of the 200-foot notification boundary.

Three notices were returned in opposition.

This case does require a supermajority to approve as 21.51 percent of the noticed area wrote back opposed to the request.
