They say that uh the C2 designation was purposefully zoned for development along Potique Jordenton Highway to provide goods and services to the commercial the the commerce there and and act as a buffer between the residents and the industry.

That's why this thing has at least two two big red flags from the from the uh the planning staff and the uh the zoning staff.

Also, they say that uh it will impact the the residents nearby and but but here's uh one thing I notice that kind of buried down in there, maybe you know this.

The developer says, and the developer has not I repeat not met the agreed upon obligations in the uh in the agreement there, and you so I mean with all those things there.

The only reason they give you the local governing authority to give variances to this is because they think you may happen to have some inside information as to why alcohol should be sold.

But for God's sake, I uh I the public do not know why you want to go ahead and allow alcohol to be sold within it's not even a tenth of a mile.

The proposal is for a 12-unit complex.

It would be a mixed use for downstairs units, would be primarily used for assisted living units.

The eight upstairs would be leased to medical professionals such as traveling nurses and medical students.

We are located 1.5 miles from the university health systems on the 701 Zarzamora, which is a teaching medical facility.

Our units would be great, great benefit and interest to these uh young young interns and doctors.

The the location is also important to the elderly residents which will be living there.

The property is adjacent to Vidaro Park, which will be an excellent place for the residents to exercise and walk.

Uh for residents if they choose to volunteer within two blocks.

There's a St.

Timothy's uh Catholic Church and the Gateway Fellowship Church.

We all know to the elderly folks, the worship is very important.

It's within walking distance.

Neighborhood support.

We've met with the uh El Charlo Neighborhood Association and have received a letter of endorsement uh on this project.

We've spoken to several of the neighbors uh in the immediate area, all in favor.

Unfortunately, older folks don't like to put things in writing, so they just say we have no problem with it, you know.

Um please take note there are no objections uh to this project and the community to the community, uh, even though two public notices have been sent out.

Uh economic benefits, uh, there'll be economic benefits to the neighborhood.

We will enlist small businesses from the neighborhoods uh to work on this project during construction and after.

For landscaping, there are six west side landscaping companies in the immediate area, handyman services.

There are ten west side handyman services that are in the immediate area.

Plumbers, there are eight west side plumbers in the immediate area.

We can use all of these people uh in order to build and to sustain uh this project.

Uh I could name several others, but um uh just just kind of kind of reiterating uh regarding the the MF designation.

There are several other properties in the area that are zoned, multifamily 25 and 33.

This will not be a standalone multifamily uh zoning.

In conclusion, we believe the assisted living facility will be a valuable addition to this west side community.

It'll provide safe, comfortable, and supportive environment for the residents while promoting an active and engaging lifestyle.

The big red flags that I've seen on this one is the fact that the staff thought it was a bad idea.

Well, they say that it will allow potential high-rise commercial building encroachment, encroachment within the residential neighborhood.

Now many of you have seen residential, have seen commercial encroachment throughout your own neighborhoods.

And you know that how how destructive this is to the residents living nearby.

It doesn't even meet the setback requirements.

Yeah, the setback requirements, even after the applicant offered it an alternate alternative.

200 feet is what it should be away from the borders there.

I'm the property owner of a 603 Pruitt.

Um I-35 is right next to it.

It's surrounded by commercial uh easy pond there.

It's it's it's my grandfather grew up there.

It's a and he basically started a commercial uh piano business called Docker Music Next Door.

And that's how kind of a unique uh mix of the residents and the commercial came about next to each other.

And he actually bought that property before I-35 was built, and I-35 was actually built right along that residential property.

Um so uh I'll leave I'll yield to my time to Mr.

Hubinger to uh talk about the um the advantages to the community about this and how this applies, but I think it's a perfect location being the unique residential uh zoning and everything kind of growing around it.

Um Leon's a property owner, and I'll go through this real briefly.

Um previously to the submittal, we met with the Collins Garden Neighborhood Association, had a great meeting with them.

Uh we talked about their coverage issues and stuff like that.

So they they appreciate us trying to get better coverage for 911 and safety reasons.

Uh the location is in a triangle.

You can see the zoning map on the top right, all that red commercial and then Leon's track is still that R-4.

Um, we took about a year to try to find a commercial site that worked with 200 feet.

Did not find anything.

This is the only site that would allow close to 200 feet as possible.

And Leon has agreed uh and we're helping him to demo the existing house on it.

So it'll be 196.5.

Uh the rezoning part is because of the uh community planning area.

They they they designate that residential mixed use.

So we had to at least do some cleanup work there and request our M5 for something like a duplex or whatever, if he does agree to, or if he does decide to go forward with something.

But yeah, it's a minor waiver.

It is 196.5 from the outside of the the monopole to the structure.

We provided staff with a value study showing something that I did within my neighborhood, uh tower that's 800 feet away from my house and watch those those uh values go for the last 15 years.

It will have first net capabilities, and it's built for up to three carriers.

Um I'm gonna skip over the part that Logan was talking about anyway.

You can vary the 200 feet by this council only, and again, it's a minor um minor deviation from the code.

You can see we're pushing it as far back as possible, and the rezone to R M5 helps us with a 10 foot setback, so we're going all the way to the back there.

Again, the code the the house on that site will be demoed.

Um most important maps is the coverage maps.

Uh yellow is in vehicle coverage.

So you see some areas that they don't have covered.

Um it's really important for 911 safety reason to get GPS locating you because over 70 percent of the 911 calls are on mobile phones as well.
