Welcome to the June 4th, 2025 meeting of the Budget and Finance Committee.

I am Supervisor Connie Chan, Chair of the Committee.

I'm joined by Vice Chair Supervisor Matt Dorsey and Member Supervisor Joan Guardio, our clerk, it's Brent Halipa.

And I would like to thank Colina Mendoza from EsseGov TV for broadcasting this meeting.

And before I call the items uh on the agenda today, uh, we just want to friendly reminding the public um that for all the items that has budget and legislative analyst report, we will go to department presentation and then the budget and legislative analyst report.

And then we'll have this body to uh present comments and questions, and then we'll go to public commons.

And so with that, um Mr.

Clark, please call item number one.

Yes, item number one is an ordinance amending the administrative code to create a pre procurement legislative analyst authority for the city administrator, revise or create threshold dollar amounts for application of various contact requirements tied to the statutory minimum competitive amount or statutory federal single audit standard, reorganized, standardized and narrow chapter 12 F relating to the McBride principles concerning Northern Ireland, including the sunset of the ordinance in 2035, repeal chapter 12J relating to the city b business with Burma, and narrow coverage of and reduced meeting requirements in Chapter 12L relating to nonprofit organizations receiving funds from the city and amending the labor and employment code to reorganize standardize, revise exemptions and waivers, narrowing coverage, create threshold dollar amount for application tied to statutorily based minimum competitive amount, and update Article 131 relating to non-discrimination under city contracts, including sunset of the of that ordinance in 2035, and repeal Article 132 relating to non-discrimination under city property contracts while incorporating some of its provisions under Article 131.

Reorganize, standardize, revised exemptions and waivers.

Uh narrowing coverage, create a threshold dollar amount for application tied to the statutorily based minimum competitive amount and update Article 151 relating to city procurement of sweat-free goods, including abolition of the sweat-free procurement advisory group and sunset of the of that ordinance in 2035, and repeal Article 141 relating to salary history in the hiring process of city contractors, Article 142 relating to criminal history in the hiring and employment process of city contractors, and Article 161 relating to earned income credit forms for employees of city contractors.

So I am a co-sponsor of this, and uh board president Raphael Mandelman is the sponsor and main author, and I did want to um give him just a kudos for his work on this.

I think uh both of us, many of us who have worked in city government for a long time, have had occasion to uh come up against some of the contracting uh processes that are onerous and in some cases uh really outdated.

Burma, for example, is a country that no longer exists and it's still in written into our administrative code.

So I just want to express my appreciation for Supervisor Mandelman's work on this to improve and update our contracting and procurement processes, and I'm happy to support this.

Um from what I do understand, uh, you know, Board President Mandelman wants to uh request for a continuance of this item to July 9th.

Um I also want to recognize the um uh the letter that submitted uh or sent to us from San Francisco Labor Council regarding this piece of legislation expressing specific concerns.

Um I, on the other hand, also actually have concerns about this uh legislation.

While I am in supportive of streamlining uh city contracting process and making sure that it it works uh and that it's uh making uh ourselves more cost effective and effective uh just in all across in general when it comes to contracting.

Uh I I do have concerns about the sweatshop-free um clause and in having it uh do away with the advisory group.

Um, but I think that there are ways to amend this legislation to make it work, and so I appreciate uh Board President Mendelman's uh request for continuance so that they can have some of these conversations.

Um I do want to suggest and propose on the floor today that you know I am interested to see uh should this legislation move forward that whether that you know we could add a clause uh to the existing um disbarment uh legis uh uh law that we have currently you know previously um that it was just for criminal conduct.

Uh the the board a couple years ago unanimously, which I which I sponsor um is to add it uh labor violation uh including wage theft.

Um but in this case I think that should anyone that uh uh obtain a city contract but found in violation uh in compliance, including a false affidavit uh about where they source their materials and as such uh could deem qualify for um potential disparment.

And so I I think that's something that uh I would like to have uh consideration and potential drafting um should this legislation move forward.

Um and so with that uh I think that we will um uh come back and move this to continuance to July 9th date of this um committee meeting, um, but we'll open this to public comments right now.

Yes, we now invite members of the public who wish to address this committee regarding this item number uh the continuance of this item number one.
