And so with that, we have um two items today.

Uh and so let's go to please item number one, Mr.

Clark.

Uh item number one is an ordinance amending the health and business hand tax regulations codes to revise the definition of a mobile food facility permit, had definitions for compact mobile food operations, mobile support unit, and permitted auxiliary conveyance permits to reflect recent amendments to the California Retail Food Code, revise existing definitions of various other terms to reflect state law definitions in that code, and expand the definition of stadium concession to include food facilities and stadiums with a seating capacity of 5,000 or more.

Establish annual permit and plan check fees for auxiliary conveyance, compact mobile food operation and mobile support unit permits, and wave license and permit fees for compact mobile food operations, uh amending the public works code to include a definition for compact mobile food operations and to expand the Department of Public Works uh street vending authority to include regulation of compact mobile food operations and to require that department to consult with the Department of Public Health and the Fire Department when issuing rules and regulations that regulate street vendors.

And um Supervisor Jackie Fielder has uh requested for continuance to next week, and I just want to express my gratitude to Supervisor Fielder and the Department of Public Health for continuing that conversation uh to ensure no vendors are being left behind or penalized uh by this legislation.

Uh so I really appreciate their effort.

Yes, item number two is a resolution approving the Fourth Amendment to a contract, armed and unarmed security services agreement between the city and county, acting by and through the municipal transportation agency and Universal Protection Service LP, doing business as allied Universal Security Services to extend the term by one year from March 31st, 2026 for a total term of April 1st, 2020 through March 31st, 2027, to increase the amount by approximately 5.9 million for a total not to exceed amount of approximately 64.9 million.

And to authorize the MTA to enter into any amendments or modifications to the agreement that do not materially increase the obligations nor liabilities to the city and are necessary to effectuate the purposes of the agreement or this resolution.

And today we have SFMTA here.

Good morning.

Thank you, Madam Chair, and uh thank you for having me, board members of the committee.

I am Kimberly Burris, the Chief Security Officer with SFMTA, and I come before you today uh seeking an approval for an extension of our security contract.

Um just wanted to give uh some background of our security program.

The the actual security contract is is only one element of our overarching security program.

We also have as a part of our security program our MOU with SFPD.

We we have our non our uniform non-sworn um staff through our fare inspectors as well as our MTAP ambassadors.

Uh we work very closely with TSA to ensure that our critical infrastructure is secured properly.

Um and then we also have uh our contract uh security that uh I'm gonna go over with you today.

Uh-oh.

How do I get that off?

Okay, gotcha.

Okay, so though through this um contract with um Allied Security Universal, um this contract actually supports the SFMTA by providing services uh at over 24 25 of our transit locations, including our transit division, our subway, um our and revenue locations.

Lied universal security actually oversees a network of three subcontracted security companies and coordinates all security services for um MTA citywide.

Um at some of our critical sites, we have 24-7 coverage.

Uh we have coverage that includes system-wide surveillance, and it provides armed guard protection reserved only for revenue collection.

We do not use armed guards at anywhere else in the system.

Our unarmed and armed guard service is essential because it serves as the first line of defense for inappropriate activity and it helps to ensure the safety of our staff and of the public.

It guards against vandalism, uh breach of our non-public facilities that can of course lead to bodily um injury and property damage, and it acts as a visible deterrent for our revenue operations at our various sites throughout San Francisco.

Guards also protect in our subway stations at open and closing.

They assist our station agents and monitoring passengers and asset risk, and guards respond to um incidents to assist and run interference if needed.

They provide situational awareness, and through our security operations center, we are able to centralize and manage our operations remotely.

And because we've improved our communications and capabilities, um, we have improved our response in our reporting.

To give you an overview of the contract itself.

The existing contract went through a competitive bidding process, and the contract was awarded through the an MTA board resolution and the Board of Supervisors resolution in December of 2019.

Um the contract started in April 1st of 2020.

It was a three-year term with three one-year options.

We have exercised our options, and we are currently in the third option right now that is set to expire on March 31st, 2026.

Spending has some flexibility in our contract because our contract is based on actual cost and expenses are not standard or fixed.

And so monthly invoices reflect our actual service provided.

And then go back.

The ask of the board today is to extend the term by one year.

Um actually fund the extended term with contract revisions and modifications, and increase the contract amount by a net of 5.9 million for a not-to-exceed amount of 64 million.

The MTA negotiated a reduction in management fees by 10% for the extended term.

We increase uh service levels due to additional guard patrol requirements at central subway platforms, and then there's an elimination of contract cost escalations for the remaining term and the use of the contract contingency, and we use the contract contingency to offset the authority of the contract extension.

So our projected expenditure for the extension year is 10.9 million.

That is the 10.5 million to fund the additional year or service with an additional 431k due to increase service levels due to the central subway.

MTA and Lied agreed to apply most of the existing contingency amount to uh to the to offset the cost associated with this extension while the remaining uh 800,000 in contingency for the extended is going to be used for the extended term.

We were very conscious of our we are very conscious of our financial outlook, and we are being very intentional in stabilizing contract costs and in such uncertain times.

And so staff is conducting a comprehensive reassessment of our armed and unarmed guard security structure as a part of an agency-wide initiative to identify some additional cost savings in response to our our severe budget constraints.

One of the things that we're doing is we we looked at we made an RFI request, a request from information uh to the actual industry and hoping to use that information to evaluate and to actually redraft it in RFP that we plan to um submit this spring into the summer.

Um, and we're also taking on a site hardening project that will eventually help us reduce um guard fixed guard costs so that we can reduce the cost of the contract overall.

This is the timeline, and so if we extend the contract beyond the March 26th and extend it to March of 2027, um that will have to be done through our MTA board as well as uh the Board of Supervisors.

We are going to review our RFI and make changes to the RFP, and then in 2027, we will finalize a new agreement uh and and at the end of the requested extension.

Um we will be ready to uh go into a new contract.

Good morning, Madam Chair, Supervisor Dorsey, Christina Malamut from the budget and legislative analyst office.

The proposed resolution would approve an amendment to an existing agreement for security guard services between the SFMTA and Allied Universal Security Services to extend the term by one year through March 2027 and to increase the not-to-exceed amount by an estimated 5.9 million for a total of approximately 64.9 million.

The agreement is for armed and unarmed security guards at SFMTA transit locations and facilities.

The proposed amendment reflects an increase in unarmed security guard staffing for the central subway and maintains that staffing in the extension year.

And so you're anticipating that in 2027, which is prior to March 2027, that you will have a new vendor and new agreement.
