Welcome to the March 24th, 2025 regular meeting of the Land Use and Transportation Committee of the San Francisco Board of Supervisors.

I am Supervisor Mirna Melgar, Chair of the Committee joined by Vice Chair Supervisor Cheyenne Chen and Supervisor Bilal Mahmood.

The committee clerk today is Mr.

Agenda item number one is an ordinance amending the building and planning codes to correct typographical errors, update outdated cross-references, make non-substantive revisions to clarify or simplify code language, and make other minor substantive updates to various code provisions.

The ordinance directs the clerk of the Board of Supervisors to forward the ordinance to the California Development, sorry, California Department of Housing and Community Development upon final passage, and it affirms the appropriate findings throughout.

So colleagues, uh this legislation uh was duplicated and heard uh at a previous committee.

Um Supervisor Shimon Walton has taken over sponsorship of this duplicated file.

Um, and I understand that Supervisor Chen has amendments.

Thank you so much for working those out.

Uh and before we do that, I will ask um Aaron Stark to come up from the planning department and let us know what has gone on.

Uh sure.

Thank you, uh Chair Melgar and members of the committee.

Uh my name's Aaron Starr, plant manager of legislative affairs.

So um, yeah, this ordinance was regularly a code originally a code corrections ordinance.

Um, and the uh there was a request to add an amendment at the last minute at the planning commission hearing.

The planning commission was open to it, but did not make an official motion to add it, and instead left it up to you all.

Um so this amendment was added by the land use committee last year.

Um and now the amendments are ready and um ready to move through the legislative process.

So I was planning on reading the amendments into the record.

Okay.

Um so first of all, the planning commission originally heard this ordinance on September 19th of last year and recommended approval with modifications.

So the amendments uh start on page one.

Line three, it amends the long title to read the ordinance amending the planning code, so removing building code, um, and then it's adds the language to expand criteria for certain self-storage units in the PDR2 production, distribution, and repair zoning districts, and extend the sunset date for such uses.

And then it um deletes correcting typographical errors, update, update outdated cross-references, make non-substantive revisions to clarify or simplify the code language and other minor substantive updates to various code provisions, directing the clerk of the board to forward this ordinance to the California Department of Housing and Community Development upon final passage.

So that last part is deleted.

Then on page two, um, it deletes from line 11 to line 20, and then it adds the language starting on line 21.

The planning commission recommended an additional amendment to this ordinance that was not prepared in time to be adopted on December 9th, 2024, meeting of the land use and transportation committee.

The city attorney will prepare such amendments for consideration at all future land at a future land use and transportation committee meeting.

Then on page three, lines one, it makes uh some more uh just clerical amendments removing articles and code sections from the ordinance that no longer pertain, um, but does add section 210.3, which is the PDR um district controls.

Then further down on line 22, um it removes the words industrial agriculture automotive repair, catering and trade shop, um, and then adds language on 23 and 24 to so the sentence um reads provided that no less than 50 percent of the parcels parcel area consists of ground floor institutional community use, arts activity, and this is where the new language starts, or any other uses allowed in PDR2 zoning districts, including parcel delivery service and fleet charging.

Um it then makes some uh clerical amendments to line 25 on page three as well.

And then starting on page two, line it deletes from line 11 uh to line 20, which is um just some findings.

And then starting on line 21 on page two, going.

Oh, I'm sorry, I didn't flip over my mistake.

Um sorry, starting on page four, line six, it changes the section numbers.

Line eleven, it changes the section numbers.

And then on starting on line eighteen on page four, going all the way to line nine, it just adds some legislative history to the ordinance to clarify why this was done, as we already discussed, and then it deletes from line 11 to line 14.
