The Rules Committee of the San Francisco Board of Supervisors met on Monday, April 10, 2023, at 10:15 AM. Chair Matt Dorsey presided, joined by Vice Chair Shimon Walton and Committee Member Asha Safai. The committee considered three items: an ordinance revising duties of the Small Business Commission, an ordinance amending public works contracting procedures, and appointments to the Assessment Appeals Board No. 3. All items were advanced to the full Board with positive recommendations.

Item 1 (230135): Administrative Code - Small Business Commission Duties – Board President Aaron Peskin presented an ordinance to replace the Small Business Commission's duty to coordinate an application and selection process for honoring small businesses with a broader duty to coordinate activities encouraging public support for small businesses during Small Business Month. The change was made in coordination with Office of Small Business Director Katie Tang. The committee voted unanimously (3-0) to send the item to the full Board with a positive recommendation.

Item 2 (221268): Administrative Code - Public Works Contracting and Contractor Performance Evaluations – Supervisor Raphael Mandelman introduced an ordinance responding to two civil grand jury reports (June 2021 and April 2022). The original ordinance would: (1) remove the mandatory cost criterion in awarding construction manager/general contractor (CMGC) contracts, allowing departmental discretion to weigh cost and non-cost criteria case-by-case; and (2) require departments to consider contractor past performance evaluations when awarding construction contracts. After discussion, the committee agreed to separate the two provisions. They unanimously (3-0) duplicated the file, amended the duplicated version to remove the second provision (contractor performance database requirement), and forwarded the amended version to the full Board with a positive recommendation. The original file was continued to the call of the chair (unanimous). The committee expressed gratitude to the civil grand juries and city staff.

Item 3 (230243): Appointment, Assessment Appeals Board No. 3 – The committee heard from two applicants: Mark Dickau (applying for seat 5, term ending September 4, 2023) and John Sue (applying for seat 6, term ending September 4, 2025). Mr. Dickau is a San Francisco real estate broker and former president of the San Francisco Association of Realtors. Mr. Sue is a real estate broker and licensed insurance agent with a law degree, residing in Albany, California. Both expressed interest in serving to help property owners with assessment appeals. Supervisor Asha Safai was excused from this item due to a scheduling conflict (motion passed 2-0 with Safai excused). The committee then voted 2-0 (Safai excused) to recommend both appointments to the full Board with a positive recommendation.

Good morning, everyone, and welcome to the Monday, April 10th, 2023 meeting of the Rules Committee of the San Francisco Board of Supervisors. I'm Supervisor Matt Dorsey, Chair of this committee. I'm joined today by my colleagues, Vice Chair Shimon Walton and Committee Member Asha Safai. On behalf of my colleagues, I want to express our gratitude to our committee clerk, Mr. Victor Young. Uh thanks also to the team at SFGov TV for facilitating and broadcasting today's meeting, in particular our producer today, Ms. Jeanette Eganloff. Mr. Clerk, do you have any announcements? Yes, the Board of Supervisors and its committees are now convening hybrid meetings to allow in-person attendance and public comment while still providing remote access to and public comment via telephone. The board recognizes that equitable public access is essential and we'll be taking public comment as follows. First public comment will be taking on each item on this agenda. Those attending in-person will be allowed to speak first. And then we will take those who are waiting on the telephone line. For those watching either channel 26, 28, 78, or 99 and sfgovt.org. Item number one is an ordinance amending the administrative code to revise the duties of the small business commission by replacing the duty to coordinate an application and selection process to recognize outstanding contributions by small businesses during small business month with a duty to coordinate activities to encourage the general public to support San Francisco Small Business during small business month. Thank you, Mr. Clerk. Today we are joined by Board President Aaron Peskin as well as Katie Tang, the director of the Office of Small Business, who will be available to speak to this item. This is a relatively small change to section 2A point two four zero of the administrative code as it relates to the powers and duties of the small business commission. It is a rather pedestrian amendment that uh changes uh the overly prescriptive recipe that I think, but I may be wrong. Which provision uh prescribed that the small business commission would have to go through an application selection process for a public event honoring small business uh owners. Uh this broadens that uh requiring that during small business month uh the department coordinate activities to encourage the general public to support small businesses in the city and county of San Francisco. I have done this small change in coordination with Katie Tang, the director of the small business office, and we are here to answer any questions that you may have thank you, President Peskin.
