Good morning.

We're calling to order the planning director's hearing of June 3rd, 2026.

My name is John 2 and I'm the hearing officer for today's agenda and agenda on behalf and of delegated by the director of planning building and code enforcement, Christopher Byrne.

This meeting is being held via Zoom conference call.

Member of the public may participate by following the instructions listed on page two of the agenda.

You would like to provide public comment.

You have two methods to identify yourself to provide public comment.

For participants who join electronically have auto input available on your computer or smartphone, you can use the raise hand feature in Zoom or click star 9 on your phone if you dialed in to request a speak when your items being heard on the agenda.

Keep your raise hand feature on until staff identifies your turn to speak.

Also during the meeting, you can also call 408-535-3505 or email planning support staff at San Jos ACA.gov and identify your name that's listed on Zoom or phone number that you called in with Zoom.

And what item or items you would like to comment on.

All members of public will remain on mute until staff identifies your turn to speak and on and you are unmuted.

At that time, you'll be unmuted and provided comments during the allotted amount of time.

If you exceed the allotted time, you may be muted so we can move on to the next speaker.

Please note the following.

The hearing procedure and order input will be as followed.

I'll identify each project as described on the agenda for those items on the consent calendar.

I asked if anyone wishes to speak on the item.

If a separate discussion is warranted, I'll move the item to public hearing portion of the agenda.

If a separate discussion is not needed, the item will remain on the consent calendar for approval.

For those items listed at public hearing, I would ask that to provide a brief report.

The applicant or the representative who wishes to speak in the item will have up to five minutes to speak and should identify themselves for state by stating their name for the record.

After the applicant or representative has spoken, any man in the public who wishes to speak on the item may proceed to provide testimony up to two minutes per speaker, either for or against the project.

All members of the public should identify their name for the record.

Following the comments from the public, the applicant may make additional remarks for up to five minutes.

I would then close the public comment and I'll ask that to answer questions, respond to comments made by the applicant or the public or further discussing item.

I will then take action on the item.

If you challenge these land use decision court, you may be limited to raising only those issues or someone else's raised at the public hearing or in written correspondence delivered to City Hall at or prior to the public hearing.

The planning director's action on janks will be final when the public is signed and mailed unless the permit or environmental clearance determination is appealed.

The planning director's actions on permits are appealable in accordance with the requirements of the Title 20 of the Southern Code.

The planning director's action on environmental review for the permits under California Environmental Quality Act are separately appealed in accordance with requirements of Title 21 of Spouty Code.

For beginning, I want to remind staff of the public uh public to follow our code of conduct at the meeting.

This includes commenting on specific agenda items only.

Speakers will not engage in a conversation with the hearing officer or staff.

The hearing officer's staff and the public are expected to refrain from a beast of language.

Repeated failures to comply with the code of conduct, which will disturb, disrupt, or impede the ordered conduct meeting.

They result in the removal from the meeting.

This meeting of the directors will now come to order.

Looking on the agenda and the matter of deferral.

Any items scheduled for a hearing for this morning for which deferral for a feature meeting is being requested.

We will be moved to this portion of the agenda and consider on the matter of referral.

I'll identify any items be deferred and ask for comments from the audience.

Seeing there's no matter of deferral, the matter of deferral is now closed.

Moving on to the consent calendar.

There'll be no separate discussion of individual consent calendars as they are considered to be routine and be considered in one action unless an item is moved to the public hearing calendar for separate discussion by the hearing officer.

The public may comment on the entire consent calendar and any item removed from the consent calendar by the hearing officer.

Uh consent kind of item 3a, which is file number T21-012 and ER25-071.

Is a 10-minute extension to allow 24-month extension of a previously approved tentative map.

File number T21-012 on approximately 0.93 Gross Acre site located on the west side of South Winter's Boulevard, approximately 460 feet southernly of Williams Road.

Um at 1065 South Winchester Boulevard.

Stats recommendation is considered termination because the environmental impact report for the 1065 South Winchester Boulevard makes use project.

Of course, you go and improve a tentative map extension.

Yes, my name's Lillian, and I'm an eleven district three, and I'm gonna comment once again on the 30 um trees and the 19 other trees.

Okay, so I'm commenting on the ordinance and non-ordinance trees uh considered with this particular item at 1065 South Winchester.

Um, and it's a total of 49 trees that will be removed.

So my question is how do this does the removal of the trees conform with CEQA?

When we have a climate adaptation and the climate system sustainability commission that um uh looks into the environmental impacts, and my question is as far as the environmental impact, when you remove 49 trees, and most of those are mature trees, and even though you may um plant box trees there or plant additional trees that may take 30 to 50 years to grow.

How does that conform with our current climate and and environmental adaptation um committees and sustainability commissions that in fact are looking into the fact that we are removing so many trees and developers are continuing to do this?

So that's 49 trees, and so how does that confirm or conform with the CEQA, even though SEQA says it's it's fine and it and it and it can, you know, there's no problem there.

I question that.

And do you have um a comment on that as far as the developer is if the developer is in fact online this morning?

Um given that we have a comment on this, I'm gonna move this to the public hearing and it did Laura.

Hi, good morning, hearing officer.

Uh this is Laura Miners, the project manager and supervisor for this project.

Um I had advise the the applicant to attend.

Uh I don't see him in the attendees.

Uh, but I can go ahead and give a quick staff report and address the issue about the trees.

The project is a tentative map extension um to allow a 24-month extension of a previously approved tentative map, as previously said.

Uh the tentative map that was previously approved, allowed up to 70 residential condominiums, up to nine commercial condominiums, and one common area on an approximately 0.93 gross acre site in association with the special use permit sp 21-006 as amended.

Um, and it's sp 21-006 that the member of the public commented on about the removal of the trees.

It is not this tentative map extension.

Um, just wanted to make that clear.

Uh the project is located west of South Winchester Boulevard, approximately 460 feet south southerly uh Williams Road on 1065 South Winchester Boulevard.

Um, and since it's a tentative map extension, uh there are no changes to the general plan conformance zoning conformance or any other policy, code, or requirement.

Uh conformance uh meets all the findings still.

Um, to address the the member of the public's comment about the trees.

Uh when sp 21-006 was approved, uh, there was a total number of uh 30 ordinance-sized trees and 19 non-ordinate sized trees proposed to be removed to facilitate the project.

Um the number of replacement trees required is 106 trees at 15 gallon size or 53 trees at 24 inch box size.

Um, so we are replacing the trees at the um at the ratio required.

Um and I have previously there are no there's no sequel staff present at this hearing today, but I previously discussed this with sequel staff, and the reason why it doesn't trigger anything for sequa, um, is because uh tree removals um generally don't have uh uh that much of an environmental impact when uh there are replacement trees sufficiently planted.

Um and if you would like any additional information, we can put you in touch with the sequel staff.

Um sorry, the public hearing portion of it, the public comments have been closed.

Uh to the speaker who I've heard multiple times at previous hearings, I acknowledge that you know there is something the city has to waive for ordinance-sized tree removals as the city overall has multiple goals, including promoting additional development as well as preservation.

There are other policies such as uh urban growth boundaries to limit kind of the growth within the infill development.

This is an infill specific site.

Um while acknowledged Sequoia is to look at the impact to the environmental.

We've disclosed to the original EIR that went associated with the Senate map to city council, the number of trees being remote removed as well as the replacement ratio as guided by council and in itself, um, to at least try to replace to the extent possible uh the trees that are on site, although it's not always ideal.

There's a lot of other wing as well as a move development to move forward as a result, but as staff has indicated in the specific project preview in front of us is an extension of the tentative map associated with that project.

So there's much not much that we can do that's already been approved for the tree removal.

So therefore, as a result of the information provided today, as well as the purview of what is here before is the tenant map extension.

I'm going to approve this item item 3A for T21-012.

Um with that specific item.
