Rules Committee Meeting Summary - September 24, 2026

The Rules Committee of the San Leandro City Council met to discuss and provide direction on a proposal to add facilitated discussion mechanisms to the City Council handbook to help resolve disagreements among council members. The committee considered a framework presented by Councilmember Simon and provided specific direction to staff to expand the draft to include a multi-step process. No public comments were received.

Discussion Items

  • Item 2a (26-397): Discussion to Consider Facilitated Discussion Mechanisms to Help Resolve Disagreements for the City Council
    • Assistant City Manager Michael Ewan presented the item, noting that it had been previously discussed and that staff sought direction to update the council handbook.
    • Councilmember Simon presented a proposed framework for alternative dispute resolution, emphasizing it as a tool to help council members resolve issues efficiently.
    • Mayor González III proposed adding two preliminary steps: first, direct discussion between the council members involved; second, if unsuccessful or not feasible, a facilitated discussion with the chair (mayor), vice mayor, or senior council member. Documentation should record only the fact of the meeting (date, time, place), not the content.
    • City Attorney provided legal considerations: if more than three council members are involved, meetings would require public notice under the Brown Act; if there are allegations of illegal conduct, the matter should be reported to the city attorney and the full council would handle it without the involved members present to protect rights.
    • Councilmember Simon expressed concern that bypassing dialogue could escalate smaller issues, but agreed that allegations of illegal acts should bypass the informal process.
    • The committee agreed that the process should focus on decorum and relationship-building, not on conduct that rises to potential illegality.

Key Outcomes

  • The committee directed staff to:
    1. Expand the draft to include a step-wise process:
      • Step 1: Direct discussion between council members (documented as to occurrence or unwillingness).
      • Step 2: Facilitated discussion with mayor, vice mayor, or senior member (documented similarly).
      • Step 3: If unresolved, proceed to neutral third-party facilitator as outlined in Councilmember Simon's document.
    2. Ensure documentation only records the fact of the meeting (date, time, place), not the content.
    3. Include a notice that if a disagreement involves four or more council members, any informal meeting would require public notice and discussion.
    4. Clarify that allegations of illegal conduct will bypass the informal process and be handled according to legal protocol.
  • Staff will bring back an expanded draft for further committee review.
  • Councilmember Simon noted that the discipline policy needs revisiting in the future, but this was not part of current direction.
  • Meeting adjourned at 9:46 AM.
