Speaker 4

13:02

you, Mayor, and good evening, council.

13:04

Uh this is a background and summary of uh the proposed action this evening, knowing full well that what was published as a staff report has slightly changed, and uh I will describe those changes this evening.

13:18

Uh and when I say changes, it's because staff has been discuss in discussions with the registrar voters since last Friday and uh in including this today, uh this afternoon, this morning as well.

13:31

So uh we're working closely with the registrar of voters.

13:35

Uh on June 16th, 2025, the council adopted ordinance number 2025-009, and that changed the city's election method from a hybrid method

Unassigned speaker

13:45

where

Speaker 4

13:45

council members were nominated from a council district but elected at large to a district-based election method,

Unassigned speaker

13:51

in

Speaker 4

13:51

which the candidate must reside within an election district that is a divisible part of the city and is elected only by voters residing within that election district while the mayor is nominated and elected by all voters citywide.

14:03

And that ordinance, 2025-009, established the city charter amendment process for the city's transition to a district-based election system.

Unassigned speaker

14:30

So

Speaker 4

14:31

on February 2nd, 2026, the council adopted a resolution to call for a special municipal election for the city charter amendment ballot measure to convert to a district-based election method.

14:42

And that election was consolidated with the June 2nd, 2026 statewide primary election.

14:49

And of course, that election was conducted by the Alameda County Registrar of Voters.

Unassigned speaker

15:00

This was the ballot measure to amend the city charter to change the district-based election method, and Measure F passed overwhelmingly with 87.33% in favor to 12.67% opposed.

Speaker 4

15:13

That regist the registrar set up certified the June 2nd, 2026 election results on June 26th,

Unassigned speaker

15:19

and

Speaker 4

15:19

the City Council declared the results on July 6th by adopting resolution number 2026-00094.

15:27

Excuse me.

15:28

Measure F by its own terms went into effect on July 1st, which provided sufficient time for it to be in effect for this coming November 3rd, 2026 general election.

Unassigned speaker

15:38

It

Speaker 4

15:39

is clear now that the ballots for the November 3rd, 2026 election are for an at-large election.

15:44

And so to address this situation, the council is proposed to pass a resolution, and the resolution has been has changed.

15:52

San Leandro City Council Special Meeting – October 13, 2026

The San Leandro City Council held a special meeting on October 13, 2026, to address a ballot error by the Alameda County Registrar of Voters that threatened the implementation of district-based elections approved by Measure F. The sole action item was a resolution requesting the Registrar to tabulate and report election results by precinct for Council Districts 1, 2, 3, and 5 in the November 3, 2026 election. The resolution passed unanimously. Note: The agenda and transcript list the meeting as Monday, October 12, 2026 at 7:00 PM, while the meeting timestamp provided is 2026-10-13 15:00 UTC.

Public Comments & Testimony

  • Joseph Trujillo (District 3 candidate, 18-year resident): Expressed full support for transparency, accountability, and swift corrective action. He formally called on the City Council and City Clerk to work aggressively with Alameda County election officials to secure an immediate, transparent, and legally sound remedy, ensuring every eligible vote is counted and that final results accurately reflect the will of the districts.
  • James Mays (15-year resident): Expressed disappointment and concern about the incorrect ballots. He asked how the city would communicate the remedy to residents and what contingency plan exists if the county cannot correct the tabulation. He urged the council to take action quickly, including a remedied ballot or a back-end computer fix.
  • Lee Thomas: Emphasized the importance of open communication between the city, county, and candidates, especially those impacted, so that candidates can reassure voters. He said the city and county must keep lines of communication open and ensure a fair and transparent process.
  • Douglas Spaulding (online): Urged voters not to become cynical and to vote. He said the error undermines electoral integrity and has affected the District 3 campaign. He supported counting ballots in Districts 1, 2, and 5 on a district basis as well, and urged full embrace of district elections.
  • Robert Bulatao (online): Said he appreciates the city addressing the ballot issues, but asked where the breakdown in communication occurred—whether it was an administrative error by the county or a city failure. He urged establishing a permanent procedure for future elections and identifying safeguards so this does not happen again in 2028.
  • Alvaro Remos (online): Asked whether in-person ballots on Election Day would have the same error. He demanded transparency and clear instructions for voters, stating that the city and county are at fault for negligence in implementing district-based elections. He urged the city to take responsibility, fix the problem, and prevent recurrence.
  • Urban Res Life (online): Acknowledged Indigenous People’s Day and the Ohlone people. He concurred with previous speakers and asked whether the issue was caused by AI or a human error.

Discussion Items

  • City Attorney Rich Pierota provided background: On June 16, 2025, the council adopted Ordinance 2025-009 changing the election method from a hybrid system to district-based elections. A February 2, 2026 resolution called a special municipal election for the charter amendment, consolidated with the June 2, 2026 statewide primary. Measure F passed overwhelmingly with 87.33% in favor and 12.67% opposed. The Registrar certified the June 2, 2026 results on June 26, and the City Council declared them on July 6. Measure F took effect July 1, but the ballots for the November 3, 2026 election were printed using the old at-large system.
  • The proposed resolution was revised after discussions with the Registrar to request results by individual precincts within Districts 1, 2, 3, and 5, so results can be reported both by district and by precinct. Districts 1, 2, and 5 have unopposed candidates; District 3 has a contested race.
  • Mayor Gonzalez asked whether there was any AI connection to the miscommunication. The City Manager said no. The Mayor also asked about finger-pointing; the City Manager said county and city staff have been working collaboratively.
  • The Mayor asked whether ballots would be modified. The City Manager stated that the Registrar informed them the ballot will not be modified.
  • Councilmember Sue Bowen asked why a resolution was needed instead of an email. The City Attorney explained the resolution authorizes the City Manager to work with the Registrar and potentially negotiate an MOU, and it makes the council’s intent explicit. The resolution applies only to the November 2026 election.
  • Councilmember Bowen confirmed that residents should use the ballots they received, and that voting for a candidate outside one’s district will not disqualify the ballot. Only voters within the district will have their votes counted for that district’s race. She suggested public outreach via local newspapers, social media, and mailers, particularly to District 3.
  • The Vice Mayor asked about the communication plan. The City Manager said a splash page has been added on the city’s website, and a new page at sanleandro.org/districtelections will be updated. Multilingual outreach will be included. Asked about the cost of mailing physical letters, the City Manager said costs have not yet been estimated.

Key Outcomes

  • The council adopted the revised resolution (as shown on screen) unanimously on a 5-0 vote.
  • The resolution calls on the Alameda County Registrar of Voters to report precinct-level results for Council Districts 1, 2, 3, and 5 in the November 3, 2026 election, allowing district-based results consistent with Measure F.
  • It authorizes the City Manager to continue working with the Registrar and to negotiate an agreement or MOU for implementing the reporting.
  • The ballot will not be modified; residents should use the ballots they have received.
  • The city will update its district elections webpage and provide multilingual communications to inform residents about how votes will be counted.
