0:55The first agenda item is approval of the minutes of the licenses and permits committee meeting of December 10th, 2025.
1:03And that's item uh 25 1862.

1:24The second item is a public hearing.
1:28Um it is ID 25-1702, referred for recommendation.
1:35New used car dealer, class two license, Union Square Auto Sales at 39 Webster Avenue.
1:4120 vehicles outside, Monday through Friday, 8 a.m.
1:44to 6 p.m., Saturday, 8 a.m.
1:47to 2 p.m., and Sunday closed.

2:08Uh good to see counselor Davis dressed for the weather.
2:11Um I'm Adam Dash, 48 Grove Street representing uh Union Square Auto Sales LLC.
2:17Also out there should be Chris Vigos of Union Square Auto Sales if he's needed.
2:21Um we're here to discuss the Union Square Auto Sales application for used code dealer license for 39 webs to have.
2:28The property was most recently used as a used car dealership and has been for some time.
2:32The applicant is just looking to do the same thing in the same place in the same manner as the prior dealer.
2:38They just need their own license, is all.
2:41So they're just gonna be a new operator basically in the same location, doing the same thing.
2:45The number of cars are the same as before.
2:48The hours of operation are the same as before.
2:50Um, Thatcher and Chris, Chris and his partner Thatcher Irvin have experience in Sumville operating a different used car dealership in a different location.
3:00So we are looking to um be approved here tonight, uh, or at least to be ref referred with a positive recommendation so the full city council could take it up, hopefully tomorrow night.
3:11Um, we're here for any questions.
3:18Um, do any of the committee members have any questions?
3:22Yes, Counselor Wheeler.
3:26Um, this being my first uh meeting with this committee, uh, I'm curious about the process.
3:33Uh I don't have any objections with this uh application.
3:37Uh I am curious, uh, though, I do note that um quite a few of the automotive-related uh applications that have come before the council just in in this month.
3:51Um I sort of do a little bit of looking up online.
3:55There is, you know, often uh, you know, as you're suggesting, um, other named businesses that have been doing similar uh similar operations in the same place recently.
4:09Uh, I know sometimes there's uh ambiguity or uh changes in the names of businesses uh in different places.
4:18And uh I'm just I just wanted to highlight that I'm curious about sort of making sure that we're tracking these uh these businesses and the people who are running these businesses um in a sensible way, so that in the rare times that there's somebody who is um is you know, maybe breaking a rule uh and then changing the name of their business or starting a new business and doing a similar application that we can notice that uh and therefore be helping the you know the well-intentioned and uh and good citizen players, so to speak.
4:56Um this attorney Adam Dash again.
4:59Yeah, I appreciate that.
5:00Uh Kelly, you know, this is a brand new business.
5:02Um they are doing the same thing as the prior operator at this location, but the prior operators left this location.
5:08But so we're stepping in as a brand new company doing a brand new thing, although it is the same thing, it is not related to the old operators whatsoever.
5:17Um, and as part of this process, I mean the city does have a lot of guardrails built in for these used car dealer licenses, posting a bond, getting two letters of recommendation, having criminal record checks done on the principles.
5:30Uh it's a one of the more rigorous licenses to obtain, to be honest, just filing the application takes a lot.
5:36Um so the fact that they've done that, and as I said, they've been approved by this council for a different location under they have a different company that does that other location, but it's the same people behind it.
5:47Um, and they've been through that all of that process and have been operating fine.
5:51So as I said, nothing's changing as far as the neighbors are going to see other than the sign.
5:57I don't think anything's going to change whatsoever.
5:59Um, because it's going to just be more of the same.
6:01However, just for your purposes, it's a completely different operator.
6:04That's why we need a new license to do the same thing.
6:07Otherwise, we would not.
6:08And then the licenses have to get renewed by you periodically, which is why they're coming.
6:11I'm assuming these other ones are coming up.
6:15I appreciate that context.
6:16That's all my questions.
6:20Dash, just to clarify the other business uh um operated by um these operators haven't had any complaints or um citations from the city.
6:32Uh not of which I'm aware.
6:35He could, if he wants to be able to unmute himself, Chris Vigos, he could probably uh verify that.
6:40But I'm I've certainly not aware of any.

7:02Um yeah, going off of what Adam said, uh, I don't believe I've seen anything as far as the prior operator having any trouble with the city or any of the residents around.
7:14Okay, just to clarify, I actually meant your other business uh in Somerville.
7:21Yes, no, we we haven't had any issues, no complaints.
7:24Um to be honest, and with you, we've been lucky enough to have a lot of happy customers, which is nice.

7:39Um I think to the NL I'd be happy if um attorney Dash has any concerns on this, then I certainly would be happy to hear them.
7:48Um forgive me if this if you know, if if so, but um I'm just thinking in terms of you know, I in terms of folks who might be uh you know, watching this and and and might want to weigh in.
8:01Um is there yeah, and and hopefully it's not like that would be the case, but is that is it um would you be willing to share the the name and location of the the US business for for that context since you're bringing it up?
8:12Oh, sure, absolutely on Adam Dash again.
8:15No, they're um operating the Assembly Square Auto Sales on Mystic Avenue, um under a different under Assembly Square Auto Sales LLC, and just they've compartmentalized them with different LLCs, but they're the same two individuals.
8:30Through you, Madam Chair, um to uh attorney dash.
8:32Yeah, totally understand.
8:33Um, not uncommon at all, in fact, quite common that folks would uh set up a different uh you know operating business uh name to hold different locations stuff.
8:41So nothing, no concerns there whatsoever.
8:43Just thought we'd since it was raised and use as a uh as an example, I thought it was appropriate to ask for that name.
8:48And you know, hypothetically, if anyone had any any thoughts, I suppose positive or otherwise, um, that they wanted uh folks would have an opportunity to weigh in prior to uh well, I guess tomorrow night, but um uh I I the only thing I want to clarify is just um for uh for anyone who's looking at the actual application, and there's a parenthetical that's is might be a little misleading.
9:10And and so um through you, Madam Chair, well I guess really since a clarification, you've you've already um dash and Mr.
9:18Z Vigos have already uh pretty clearly stated this, but um there's a there's an example is given uh such as the increase in number of automo automobile trips, hours of operation, um and so or change the address of the building.
9:32So none of those apply.
9:34That that condition um isn't uh none of those examples are conditions, it's simply the um the the change of ownership of the of the um the entity owning the license and operating the business.
9:45Greg, absolutely no other business changes.

9:51That if any of those things changed, uh ISD is saying you would need a special permit, but in fact we don't because we're just a continuation of uh pre-existing use.

10:56Um and this is something that was an item that was carried over from last year.
11:00It's ID 25-1754, ever source applying for a grant of location to install a total of 38 feet of conduit in Warwick Street from utility poll 357 over three to a point of pickup at 16 Warwick Street.
11:16Um is the applicant or representative of the applicant here?

11:34Sorry, I'm um covering for Jackie tonight.
11:40Um so I do understand there was just a question um from the last meeting of the spare like risers on the poll.
11:50So we were able to find out um we own two of the risers that are currently on the poll.
11:57One of them is for the primary line to the transformer, and the other one is a spare for that primary line in case anything goes wrong, there's a fault.
12:06So that one has to stay available um and open.
12:10So that's that's why we have to install another one for this.
12:17Um so you clarified that they are uh that two of them are ever sources.
12:26Do you know the third?
12:27I believe there's a third.
12:29Um there is a third.
12:30We we don't own it, so we don't have the option of doing anything with it.
12:36And the two um that are ever sources are both are necessary.
12:44Yeah, one is currently the primary line for the transformer.
12:48Um, and the other one is is a backup for that primary line, so it has to stay available in case there's any fault with the the primary line to the transformer.
13:01Um can I uh clerk potier, can I give some background um for anyone listening about this item?

13:24Um wondering why there would need to be an additional um conduit or riser, um, because there are already several.

14:12Um let me just so I I guess make sure I understand because you know, I uh at the last meeting I was looking at the the you know the street images of of this poll.
14:21Um and it looks like yeah, as you said, there's sort of there's two browsers coming up to a certain point, and then it looks like maybe one of them stops, and then there's another one coming up.
14:29Well, so uh through the chair to you, where is the transformer?
14:33Is it is this is it on where is the transformer that you're talking about?

16:05So the poll, the transformers right at the top of the polls the b the big the big gray box at the top of the poll.

16:17Um so maybe it I assume what looks like a transformer on on the next poll.
16:24Um asuming I'm looking at the right ones here.
16:27This is 33 or across from, yeah.
16:31Um anyway, I I mean I guess it's uh let me ask a different question.
16:36Um is is the for the granulocation that you're asking here, is the line um is the line gonna go will it also run at the poll or will it just go will what i is there an additional um riser, additional uh anything required to be added to the pole that other than what's already there?
16:58Uh no, but anything that's that that would be added to the poll is already accounted for on the plan.
17:07I'm not sure how to parse that.
17:10Um the pole that we're talking about is across from looks like 15 17.
17:21Um and so the the I'm trying to try to do justice to the constituent who or or the you know the the remember of the public that uh that raised the issue before that there we in the in our last discussion, uh my understanding is we were talking about a poll in front of 17, which is the um the pole that is appears to be one pole down from where the transformer sits.
17:44Is that sound right?

17:52And the yeah, the the plan on screen seems to seem to confirm that so that's what I'm seeing on the street view.
18:25If that's that's the poll, but I again this is this is the street view.
18:28It's not like it's not a a picture of the poll that I've been sent, you know, by our engineering department.
18:35So I I can't I can't say for sure that we're looking at the right poll on the street view.
18:39Um yeah, I mean on the street view, it's pretty I yeah, uh what I'm looking at is pretty clearly right, the one that's directly in uh in the front corner of number 17 Warwick, which is as shown on the screen is the poll you're talking about.
18:51There are two risers that go up it, but there's no transformer at the top.
18:54Uh and now again, this is a couple years old.
18:56So are it is it is it is your information that there now actually is a transformer on the top of that pole, despite this older picture maybe maybe not showing that.
19:04So I I my information is that two of the risers go to a transformer.
19:10Um so end of the day, the the two the all of the gear that's there on that pole, those two risers and whatever goes above it, um, is is necessary, the one's a redundancy, and but you're not adding anything additional to it.
19:27It would be you would be able to I I assume you're bringing a line down the pole and then going across underneath the street.
19:34Uh yeah, so the the conduit is being run underground.
19:38But is there is there anything additional being added to the pole to get the line down, or are you able to use the existing conduit, the existing no, no?
19:45So we the two risers that are currently on there um that were discussed at the last meeting, they're they're both needed for for the primary line that feeds the transformer.
20:00So we we can't use one of them for the new conduit that we're running under the street because those both need to be available for the primary line.
20:09Okay so so there will be a a new conduit added to the poll in addition to the two that are there already and then you'll go under the street.
20:19And there's what what you're being told is there's there's there's no way to avoid that is it possible I mean I guess I mean looking at the poll here there it I won't make any judgment as to the uh you know the workmanship but it it it appears to be let's say less tidy than perhaps it might be is it possible to maybe I just I'm trying to do try to do justice to to uh you know the community member here that that was that was here last time and that was willing to uh um you know we just want to sort of understand what was going on um and I I could certainly understand that there's a lot going on on that poll already and I can see where someone might you know um at least want to understand it so can can I just make the request that to to whatever extent you know what's there can be can be cleaned up it looks like there may well be some abandoned lines I see uh again this is a 2004 picture so it may not be accurate or it may not be up to date but um can I can I make that request that that be you know tidied up to the fullest extent reasonably possible as as this work's being done yeah so I mean so anything that's on the poll that we own is is needed for the primary line.
21:33I can't speak to anything that's potentially been abandoned by any other and any other companies but the the risers that we have on there are being used for primary.
21:43Okay so again we get to the problem of not my problem somebody else's problem and we all stand around a circle pointing fingers at each other and I this is no knock on you personally but if you can understand the frustration this comes from I've got a constituent who's got a poll that which frankly looks like a kind of a mess um we have these all over the all over the city and no one wants to kind of no one wants to take responsibility for cleaning them up and and there's always a good there's always a good argument there's already good always good legal explanation that well we don't know who's this isn't it's not ours we don't know you know at the end of the day basically the buck stops nowhere so you know I I guess I I'd like some confirmation that this can be cleaned up a bit you know I I know I'm kind of nitpicking here but um I I agree with this constituent that it's a lot there's a big construction project that was that you know uh a few at least a few years ago was happening down the end of the road which by the way does appear where the where the transformer actually is or was back in 2024 uh maybe it's been moved up the street um but you know it doesn't seem to me unreasonable to if we're gonna if we're gonna you know grant the the approval to uh to go under the street here um to uh uh to access whatever's happening across the street that um we you know condition that on this poll being tidied up uh to the fullest extent possible so um i um madam chair through you to the clerk is that uh a condition we can add to the uh approval in some way without getting ourselves in hot water uh through the chair i it seems like it would be a condition based on uh whatever ever source itself directly controls um to the extent that it's not ever source property i don't uh I don't believe that we would be able to condition that license on this and and remember this is a uh this is for underground um conduit not for any additional uh work to be done on the pole is my understanding through you madam chair yeah uh thank you for that uh miss clerk yeah I mean I I understand that but the the you know the the very directly related point is that the line needs to come down this pole and um and then go across the street and this constituent who will have construction happening in front of their house and a and a trench dug in a patch across our street is asking if the pole can be tidied up so you know I guess I'd like to make that that that request to the to the you know to the extent that we are able to that that be part of it um and if you know if if we need to circle back on that to get the right right wording before tomorrow night I'm happy to have a conversation tomorrow.

25:38Uh yes, there's a lot of background that I am picking up in bits and pieces uh about some of these terms.
25:46Um I appreciate the conversation so far.
25:49Uh something that uh that I'm understanding from this conversation is that in order to supply power or you know, to supply power in the desired way to 16 Warwick, uh, as um Ms.
26:04Cooper and Counselor Davis were just discussing, um, EverSource would like to run power in a new riser uh added to the poll down the pole from the transformer to the ground, then also dig a trench across, lay that wire across and and refill it.
26:26And uh I am also hearing it, I I was at the meeting where that a butter um was concerned, although I didn't understand exactly what the concerns were at the time.
26:36Uh I'm surmising that some of the concerns are about the disruption and about the resulting state.
26:42So I appreciate uh Clerk Potir, um you're pointing out that the condition of leaving the work site clean uh could be attached.
26:53Um I'm not quite sure if that addresses the concern.
26:57Uh I think there could be say an additional bulky riser added uh that the butter might find you know incrementally reduces the view or is unsightly in addition to the you know possibly already unsightly uh hodgepodge uh riser that may or may not be current um that I have also seen uh on this street view image.
27:27Um so I uh I'm just wondering if instead of just adding uh a condition of the work site being clean, um if it's either possible to add a condition that the um the risers be um it it be insured that all of the risers are um are up to current standards.
27:56Um I'm trying to search for other wording that might um might you know lead us to a reasonable place of saying, hey, um if this is if things are already in good shape, we're not saying tear them down and redo them as they are.
28:14But um, but if the state is this kind of hodgepodge that I'm seeing of one pipe um ending and another pipe that's not quite aligned with the beginning, um is it possible in the course of work like this to, you know, I I've seen different kinds of risers on polls to do one that could envelop and include the existing uh existing riser wiring and this new riser wiring.

28:56Um so I would be I would be happy to to bring up any of these concerns or or send them over to to Jackie to have her address with um the engineering and construction department um and address if if any of these concerns are a possibility or um get more clarity on what we can potentially do to assuage the um the concerns about the risers on the poll, like I'd be happy to forward those over.
29:36And and and just for context, also echoing what uh counselor Davis said, I am also not seeking to nitpick, but I do know that when there's a a need to do particular work, that often is an opportunity to say, hey, can we can we take this chance to give a little extra attention to what the state of this poll is?
30:09Or you know what whatever combination of of owners these polls have.
30:13And I know that's complicated.
30:16It'll only be trickier uh when there's not this this plan or this need.
30:29I would love to hear uh excuse me.
30:33Clerk HoT or could you um state again what you think the um condition could be and if counselor wheeler's concerns could be incorporated.
30:49Through the chair the condition that I have seen is related to um you know work site conditions um to the extent that there is a change to the construction plans themselves um those might need to be redrawn and resubmitted to engineering for review to the extent that the request being made here does fundamentally alter what was previously submitted and approved by city staff.
31:17So I would just be careful of that that what we have approved by staff is what we're showing you on the screen.
31:24And so if that needs to be changed I would uh then that would likely require a new submission of uh plans and a cover letter okay thank you um did you have okay go ahead counselor Wheeler thanks um I just want to to suggest uh this could be something as well where uh uh a further discussion with the abutter explaining what we've learned um could lead to their saying they're okay with it uh my my sense from uh some of what the abutter said uh in December at the city council meeting um was that a lot of the concern came from confusion and not being quite sure what this work might involve.
32:16So it it may be that um you know short we could uh find a path forward short of saying you know this work needs to be resubmitted or redone to say um maybe it could make sense to uh to hold off on approving this um long enough to at least give us a chance to speak to the abutter and um and see if the understanding that we've gotten addresses their concerns and I I don't know what the context is of you know if this is a power conduit that's necessary for someone to move in you know I I want to make sure we're balancing things I'm not trying to introduce onerous um delays absolutely my understanding from the last meeting is that it's to an accessory dwelling unit and that the work would not be able to be completed right now in the winter um that it would be a project uh that ever source would carry out in April um so it uh miss cooper please correct me if if that's mistaken um but that was my understanding that there's no immediate time pressure um um I'm not uh if that's what was discussed in the last meeting and and Jackie had that information I'm confident that she had the correct information okay thank you um clerk bautier and would it be possible to keep it in committee and reach out to the abutter who spoke uh through the chair that would be a possibility um I would only say that if that might change the overall outcome um that would be the reason that you would keep this in committee if there's a chance that what that abutter said might change your mind otherwise to keep this in committee would require keeping it on the agenda and asking every source to come back to another meeting um which is of course well within your discretion I just wanted to raise those two um options uh for the committee okay thank you that's helpful um yes counselor davis um madam chair so that thank you for that discussion and for those questions and and thank you to the clerk for uh for those for that clarification I I didn't want to put throw out another option I mean what the the council meeting question is tomorrow night so we don't have our usual you know well it's a week it's a few days people we can circle back um but uh another possible avenue would be to um recommend this out of committee uh to send it uh out of committee voted out of committee without a recommendation um that way it would be before the council if um you know someone's able to reach the uh the abutter tomorrow and kind of talk through it and say hey we can we can always send it then send it back to committee wouldn't delay it
35:00I mean the the council meeting question is tomorrow night.
35:02So we don't have our usual, you know, well, it's a week, it's a few days, people we can circle back.
35:07Um but uh another possible avenue would be to um recommend this out of committee uh to send it uh out of committee, vote or out of committee without a recommendation.
35:18Um that way it would be before the council if um you know someone's able to reach the uh the abutter tomorrow and kind of talk through it and say, hey, we can we could always send it, then send it back to committee, wouldn't delay it in any you know any way at all because it would be back for our next license permits meeting.
35:34But if we were all ship shape, then the council could, if they if it was the will of the body, um, you know, vote to approve it tomorrow, and or add conditions or what or whatever else, that would give us the the most flexibility.
35:45If we didn't do that, then technically we we couldn't pull it out of a committee because we we would have needed to um well actually we we may be beyond the uh there may be a time that maybe a little wrinkle on that role, but let's let's let's set the complexities aside for the moment because the general best practices if we think we might want to take something up at the council level um or at least have the option to we then we the best thing to do would be to to um uh to vote it out of committee without a recommendation.
36:11And I and I I I I have a I have a good sense that the president of the council might be perfectly willing to have a conversation about it.
36:18Um I I'll put a good word in on that.
36:20I think we'll be able to excellent, excellent.

36:47Um, if it wasn't if it wasn't implicit, I I you know uh uh I I will consider my having said so moved earlier on an amendment as being a uh offer uh uh a request for discussion on it uh rather than an actual motion.
37:01So um uh we'll we'll um you would be correct in you would be perfectly uh okay in in uh interpreting that as not having been a formal motion by me.
