0:00We're still waiting for um some uh reports from uh uh fire marshal WPCA and TTP, correct?
0:13Manita Yes Okay, so um hopefully we will get those um before the next meeting and then we've got to hear from engineering and TTP on this on the uh materials we received today from the attorney for 77 plus the EPB for Bill's question.
0:40Yeah an EPB okay who's how is that question getting to EPV?
0:51I would talk to Bob tomorrow.
0:53Oh okay, good all right um and I assume also uh Mr.
1:01Rennes is you're you you're gonna not not you personally but when I say you I mean your firm is going to address the illegal issues that the uh Mr.
1:11Pierce brought up also the legal issues I will be deferring to my fellow volunteer Mr.
1:19Okay perfect okay so an interesting evening look forward to it okay um are we good uh if we continue this now anything else before we uh do that okay uh my only question Mr.
1:41Chairman uh since the application was opened and you afforded their attorney the right to speak you have to open it to the public okay um that's a good point right uh if there's anyone from the public who wishes to speak on this application um can you raise your hand please I don't see any hands we don't see any people either um all right application two two five dash four eight is continued until the next meeting of the zoning board which will be on February twenty third twenty twenty-six at six thirty on Zoom uh thank you uh all for uh participating in this and and thank you for the extra eighteen minutes a for you Rick it no problem okay um now let's see we're into the regular meeting and the first thing we have is the minutes from our last meeting on January twenty sixth um are there any um corrections comments additions on it motion to approve the minutes of january twenty sixth two thousand twenty six as presented second mr chairman okay any further discussion um all in favor say aye aye minutes are approved next um we have uh uh application two two five three seven five harbor point square LLC um general development plan site and architectural plans and our requested uses and coastal site plan review this is the um the bathhouse we do have um conditions for that so uh manita can you put those up please yes um bath how can you see my screen yep well I can go straight to the site specific conditions okay um it disappeared on my computer oh well it's on mine I have it oh huh huh okay it's back um it is okay
5:00Um it disappeared on my computer.
5:30I it is hung on my computer.
5:36So uh the first item we have is that the work will uh conform to the plans.
5:44Is that me or you that's her because it changed on my screen.
5:50Ah it's kind of nice, but uh watermark sorry.
5:56A little hard to read, but we could probably do it.
6:00I think it's my screen that is hung.
6:06Uh let me try it again.
6:16You guys just knew tomorrow is the day I had to get up early.
6:25If you didn't have to get up early, we would have been done by 10 o'clock.
6:31Dog's not getting his walk.
6:52Um look uh is uh general development plan.
7:00Um prior to building permit, applicant will record the approved GDP on the Stanford land records confirming 34,000 square feet of commercial develop.
7:15Oh sorry, it's jumping again.
7:24This is like a conspiracy to not let us finish.
7:30I'd like to not touch it too much.
7:32Uh 34,000 square feet of commercial development rights are transferred from block P7 to block S5, leaving a hundred and four thousand square feet of commercial development rights on P7.
7:52Um prior to building permit applicant will submit plans for the rooftop um open space.
8:02Including programming and planning, yes.
8:06I was just gonna say, can we um add the new landscaping into that same paragraph?
8:11Not just the rooftop.
8:14Well, let me let's go back a second.
8:16Vanita, did that new whatever showed that new um roof landscaping?
8:24Um the junipers, I guess.
8:26Is it has that been added to the list of uh documents in the record?
8:32So I had referenced the PowerPoint presentation from tonight with that with the date, so it's in there.
8:41Um but we have it on it.
8:45We have landscaping now along the parking on the um west.
8:51Oh on the west, yeah.
8:54That was in the plan.
8:56That was in the revised planting plan though.
8:59The planting on the west side of the building was in the new plan we received.
9:04Yeah, but it didn't list the plants and everything, did it?
9:12Uh okay, and then implementation of the plans will be completed prior to CO.
9:25Can we fix the numbering there?
9:28Um actually, I may not be able to fix the numbering because it's the web version.
9:33I usually have to download and fix the numbering.
9:43If you do it, one do it tomorrow.
9:45Um, so then the rooftop noise management, which was something we had talked about.
9:52Um it will be maintained at volumes to serve as ambient music for the pool area and not be amplified to spill over um outside the property boundaries in compliance with the Stanford Noise.
10:07Um it wasn't a Stanford noise ordinance issue, it was a noise issue.
10:15Um that even if it you know it if it went right up to the noise limits and didn't exceed them, you could still hear it outside.
10:26And they what they said is it would be kept in low volumes where you couldn't hear it.
10:32Sh um this is not so should I just stop here after yes, after yeah.
10:45Yes, yeah, and also didn't they say, unless I'm confused that that they were doing they were going to do a test?
10:51They were doing a test, yes.
10:52That was a part of the condition, wasn't it?
10:54Well, it doesn't say yet.
10:55Does anything offered to do um yeah, a test a nice test?
11:07I mean we have to figure out when, like, you know.
11:12Well, what would that seem?
11:14What would the purpose of the test be to see whether sound is not going over to the property?
11:20I thought we were doing a prior to uh CL.
11:26You want to just start a new make a new paragraph under that one, keep it under rooftop noise, just make it a separate paragraph prior prior to issuance of the CO applicant shell.
12:08It's you know, mine does that too.
12:11I don't understand it.
12:12Yeah, I I don't know, maybe because I'm shit.
12:15It's not doesn't always happen.
12:17Usually it's pretty good.
12:20Um I don't know, maybe I close all the windows that I have.
12:26Is that a period after CO?
12:34I have to, yeah, I'm just waiting for it to respond to me.
12:41Shall what conduct a noise test or test?
12:49Noise test to um, well, it's it's to ensure that the um noise levels from the rooftop um cannot be heard outside the property boundaries.
13:31Yeah, that's pretty much it.
14:05Uh next we have vehicle parking.
14:09Um they will uh maintain sixty-eight parking spaces, which includes fifteen EV spaces.
14:22Um they have additional spaces in excess of the sixty-eight.
14:31I think it was a hundred and forty some odd.
14:36The additional spaces uh will be available at no charge to residents and guests of Harbor Point.
14:43Um they didn't want to do it overnight, so this is uh the language the highlighted language there um is what's being proposed.
14:57Any thoughts on this?
15:01It's reasonable to me.
15:04I mean it is their property, so right.
15:07It's currently used by guests.
15:10Um it I think they'd offer to let that continue.
15:18And there's the parking management plan.
15:22We all know what that says.
15:25Um the transportation demand management plan.
15:31Uh this, which is the same as we always have.
15:40They'll provide 24 class B.
15:44I guess the class A were below the uh minimum number and allowed them to convert them to class B.
15:53Um, and they agreed to put in four e-bike spaces with charging facilities on the property.
16:03Um there's our bike bicycle parking performance regulations, which are the same as uh they always are bicycle parking maintenance agreement.
16:25I'm still waiting for and uh they have to put notes on their plans showing uh that the class B spaces um comply with the requirements of the reds whenever you're able to.
16:54I'm sorry, this is really bad timing for the computer to kind of act up.
17:03Time to tell the city you need a new one.
17:10First thing we're going to do tomorrow morning.
17:21Maybe I should download this.
17:24Um you um I mean how many more it is the same document, David, that you have.
17:33How many more site specific conditions now?
17:36Can you can it scroll up any more?
17:39Is that as far as it'll go?
17:41As far as that'll go right now.
17:43So signage has to be approved by staff.
17:46They will comply with TTP comments.
17:50They'll comply with EPB comments.
17:57Can you just tell us what the rest of the uh just read it to us?
18:01Yeah, you know, I can't see it either.
18:05David, you have yours, can you read it?
18:15Uh we need us as on the SharePoint.
18:18It is, it is on SharePoint.
18:19It's under draft motions under certificates of decision.
18:25Let me see if I can get it.
18:28When would you sent that?
18:31Last week sometime, right?
18:39Would it have been you and not um Courney?
19:22What we were on um TTP.
19:25Um, next we have Engineering Bureau comments complying with uh um Willetta Capels comments.
19:36Next is fire marshal complying with the comments from the fire marshal dated October 28th.
19:42WPCA comments, uh complying with those dated October 31st.
20:00With uh um Willetta Capels comments next is fire marshal complying with the comments from the fire marshal dated October 28th WPCA comments uh complying with those dated October 31st um easements uh prior to CO applicant will submit and record on the land records and easement map showing um all easements on the property and the easement agreement um and map depicting where the public sidewalks are located on the applicant's property um street trees uh prior to CO applicant will provide and plant not less than 21 street trees uh conforming uh with our regulations and submit a bond of a thousand dollars per tree for a total of 21,000.
20:32Um applicant will modify the landscape plan to swap a small tree for a large tree.
20:40Um and color in the entire public sidewalk, including portions outside the property boundaries.
20:47Um David actually this um they did act end up doing that, so we can um okay, so that's not included.
20:58Um they showed that they had the additional large tree good.
21:06Uh any modification to the street scape plan leading to a reduction in the number of trees being planted will be subject to a fee in lieu.
21:16Um and last is security cameras.
21:20Uh 16 security cameras shown on the building and site plans shall cover the entire perimeter of the property and be monitored in real time during the hours when the bathhouse is open.
21:35I'm I'm assuming that this draft is more or less current.
21:44Yeah, the only update was that I'd taken out that streetscape, the the street tree um comment.
21:54So um that's that's the uh all of the uh conditions.
22:01Uh is there any discussion on them?
22:05Can we get a motion to approve application 225-37 with the uh conditions as presented tonight?
22:18Okay, any further discussion.
22:20All in favor say aye.
22:24Okay, it's unanimous.
22:27Um, and that brings us to the conclusion of tonight's meeting.
22:34Um next week, uh, there are a few things on our next meeting.
22:41Um hopefully we can vote on um Lockwood.
22:47Um that'll just mean um Benita you can um put some conditions out.
22:56And um is there anything new on?
23:03I mean anything it yes, anything new on for next meeting?
23:07We have the text amendment for the CG district.
23:13That's you think we might be able to vote on St.
23:20We do have I don't see why not.
23:32I'll I'll talk to you tomorrow, Vinita, about that.
23:36What what anything that's outstanding that we can drop in as a condition.
23:42Um, but yeah, there's no reason why we can't vote next time.
23:48Um yeah, with that and lockwood, and that'll clear some uh things off.
24:03Which could take months.
24:05Well, I mean, honestly, uh based on what we heard tonight, I would be surprised if all these dueling uh engineers and attorneys are gonna come to agreement by our next meeting.
24:20Oh, that's what do you think?
24:22They'll get it together.
24:27Do you think the two sides will get together?
24:31I mean, um we also need that's that's why we that's why we send it out to um oh folks.
24:41So we have three opinions.
24:46Because you folks subsidy and dude, they're gonna wait until these the two dueling uh engineers come to some sort of an agreement, and before they even look at it, I would assume.
25:00I would hope they would look at it when they get a chance, so they can get a chance to do it and and not wait.
25:10I mean, I send it to them today.
25:12Um, and I mean the the uh the the task uh that I gave them was really to um basically check if the arguments that we we got today from uh the folks from um Palmer Hill, uh if there's something to them or or which ones are are valid and which ones are not valid.
25:45I mean the other problem is that there's so many uh balls in the air at the moment with with uh like Edge Hill uh and the the talks to Edge Hill that also obviously complicates the the situation a little bit, but we'll see what what we get by the next meeting.
26:07It makes it I mean what is it that we would approve if these balls are still in the air.
26:15Um that is a very good question.
26:19I guess we would approve something uh that is based on uh the the current situation, and they would come back with once the um they they have an agreement with Edge Hill.
26:35Um would come back for an for an amendment of yeah uh that project.
26:42I mean, we cannot approve something that is hypothetical dependent on if they get a piece of property or not.
26:49Um that makes sense, okay and at the same time I just feel terrible that all the little kids from that cove area now.
27:02I have to go all the way across town.
27:04I just it's really too bad there wasn't yeah, I mean I know it's less expensive to run it with the current program.
27:14But yeah, at the same time, they they need well, they need to move forward with financing, which um I don't think requires our approval, but they say it makes it easier to get the financing if we've approved it.
27:33Um we do we we need input from traffic and engineering and some others, okay.
27:49How could I forget EPP?
27:51Do we know what the city's gonna do with um old Rogers School once it comes down?
28:01You mean where CLC is now, yeah.
28:05I think it's a new school.
28:07It's a millionaire school, yeah.
28:09Oh so they're tearing it down and then building a new school.
28:12Yeah, there will be um both Katie Murphy and uh Rogers are coming down, and it'll be some sort of split school, like one part of the school will be at the Katie Murphy side, and the other one will be at the Lockwood side.
28:37Okay, I mean the the problem is that the city doesn't really have any land, and acquiring land in Stanford is obviously very expensive, yeah.
28:52So uh that's that's basically the struggle.
28:57So they'll have to build up.
29:01We can have like a eight-story school.
29:05Yeah, it's um beautiful.
29:09We have a beautiful building at CTE down off of uh South Pacific Street that could repurpose.
29:18Oh yeah, I think they looked into that, but it's too small.
29:34Um there's nothing else.
29:38Uh anyone want to adjourn?
29:49I mean good evening.
29:53At least it's give me double.
29:56We'll give you double of what you're making.
