Um I represent the uh big SU food market and the owner.

Um there was previously scheduled a hearing with code enforcement regarding the denial of the certificate of use.

I contacted Rob Carpenter of City uh law department and requested an adjournment of that because I hadn't seen the incomplete file at that point.

I just was retained uh this past week, basically, not this week, the week before.

And Rob was cordial enough to uh uh to grant the adjournment request.

So there has not been a hearing on the issue of the denial of the certificate of use, and I'm requesting that uh the common council also uh table this uh public hearing or continue it uh to give me an opportunity to complete my review and to uh confer with uh attorney carpenter to see if there's some resolution that we could could offer that would be satisfactory to the city.

Uh just to briefly uh touch on uh Mr.

Um there there are a couple of different uh procedures uh going on here.

This one is uh a hearing request or a request that uh Zodiac Administrator Jake DeShaw submitted to the Common Council to revoke the property's special use permit.

His justifications for that is in a report that was submitted to the common council.

Uh as Mr.

Billinson pointed out, um the division of co-enforcement is also uh beginning procedures to deny um the store that operates there their certificate of use um application.

When the division of co-enforcement denies that application, they have to have a separate administrative proceeding uh hearing where the division presents their case for that, the uh business owner has an opportunity to present their case for why the denial is not justified, then a neutral hearing officer makes a determination on that.

Uh so they are two separate proceedings.

Um the store order will have an opportunity on the division uh determination on the certificate of use um separately.

Um I granted the request uh Mr.

Billinson's uh uh request for the certificate of use hearing uh so that he can have plenty of time to prepare for that.

Um I don't have the authority to grant an adjournment for the public hearing that obviously flows through the common council.

DeShaw's uh request for a revocation are I believe what well articulated in the report.

Um there was unlicensed cannabis sales occurring at the property, uh there was unlicensed tobacco sales occurring, and there was recently uh violation issued by the Ontonaga County uh health department for uh illegal flavored vapes.

Uh flavored vapes are vape products that are illegal in the state of New York.

Um, as outlined in uh Mr.

DeShaw's report, um all of those uh are violations of local licensing schemes.

That's a um violation of the sorry, forget me, I'll rebrief uh the special use permit that has been previously issued uh to the property.

DeShaw believes as uh articulated in his report that uh that has had a detrimental impact on the surrounding neighborhood.

Um and uh the Office of Zodiac Administration would ask that the um uh common council vote to revoke the special use permit.
