The May 20th, 2024 City of Vandalia Council meeting is now called to order.

0:06

We'll start with a moment of reflection, followed by the Pledge of Allegiance to the flag.

0:16

Please stand for the pledge.

0:26

And to the Republic for which it stands.

0:28

One nation under God, indivisible with liberty, justice for all.

0:39

You've had an opportunity to review the study session minutes and the meeting minutes of May 6, along with the council retreat minutes of May 8th.

0:47

Are there any comments or corrections?

0:51

Being none, they stand approved, and that brings us to communications petitions and award.

0:55

And we have a proclamation for our public works department.

0:59

So if you can join me at the podium.

1:42

See what I mean?

1:44

Whereas these infrastructures, facilities, and services could not be provided without dedicated efforts of public works professionals who are engineers, managers, and employees at all levels of government and of the private sector, who are responsible for rebuilding, improving and protecting our nation's transportation, water supply, water treatment, public buildings, and other structures and facilities essential to our citizens.

2:13

Whereas it is in the public's interest for the citizens, civic leaders, and children of Vandalia to gain knowledge of and maintain an ongoing interest and understanding of the importance of public works and public works programs in our community.

2:30

And whereas the year 2024 marks the 64th annual National Public Works Week sponsored by the American Public Works Association.

2:41

Now, therefore, I, Richard Herbst, by the authority vested in me as the mayor of the City of Vandalia, do hereby proclaim May 19th through the 25th, 2024 as National Public Works Week.

2:54

Congratulations.

3:19

Say hello, give a smile.

3:26

So if you happen to see out there doing their job, please thank them for their for their work and their service.

3:32

Thank you.

3:33

We certainly do appreciate them because I don't think there's any resident in the city of Vandalia.

3:36

Does that just drive by them in sub zero temperatures while they're trying to fix a water main break, thinking, oh my god, that's the last place I want to be right now.

3:44

So we do appreciate that.

3:45

Thanks.

3:58

You all try to read that.

4:04

All right, next we have.

4:06

Oops, sorry, let me turn my mic on.

4:08

Next we have the introduction of an assistant public works superintendent.

4:11

Ms.

4:12

Went.

4:12

Thank you very much, Your Honor.

4:14

If Mr.

4:14

J.R.

4:15

Fulton, if you just go ahead and stand up, I really appreciate you coming out tonight.

4:20

JR started with us on May 6th.

4:23

He took over as the assistant public works superintendent when Mr.

4:28

Hazlit was promoted after Mr.

4:31

Richie's retirement.

4:34

Mr.

4:34

Fulton, one of the things that sticks out from the first interview that I had with him, which was when he interviewed to be a public works technician some months back.

4:45

He he mentioned that in his entire career he's always been promoted.

4:50

That's correct.

5:17

He's been in operating and maintenance technician with Veolia, where at some point he had worked with Mr.

5:24

Hazlit, and Mr.

5:26

Hazelick got an idea of JR's work ethic.

5:29

He'd been a sales specialist at Lowe's uh cable technician and subcontractor with Direct TV and operations manager at Lowe's and a co-manager at 84 Lumber.

5:40

And so with all of that combined experience, it's easy to see that not only does he master different bodies of information, but also uh that also he he's pretty handy.

5:52

Another thing about Mr.

5:54

Fulton is that uh he's a Navy veteran and uh like many of some of our best employees uh served in the Navy, just like Mrs.

6:03

Swartz.

6:04

Um, and so he also uh is an electronics technician through Belmont Technical College, and so th those are some of his qualifications.

6:14

He's off to an excellent start um at the public works division, and so we just look forward to and are excited to have you on board.

6:22

So thank you for coming and welcome.

6:24

All right, welcome, J.R.

6:27

Glad to have you.

6:30

All right, next we have the introduction and oath of office for a firefighter paramedic inspector.

6:34

Yes, Mr.

6:35

Schneider, uh, and ask you to just to go ahead and stand up here.

6:38

And uh Joshua is a firefighter paramedic inspector.

6:42

He joined us uh full time on May 1st and has been with us for a couple of years, so he's a Vandalia resident.

6:51

We're excited to welcome him on board, and with that I'll invite uh Joshua and Captain Garver and the rest of the crew to come on up for his swear in the show session.

Vandalia City Council Meeting - May 20, 2024

The City of Vandalia Council met at 7:00 PM on May 20, 2024, to approve routine items, hear public comment on a proposed hotel and a golf course restaurant management plan, and vote on several resolutions and ordinances. Key actions included awarding a bid for the Art Park Amphitheater, authorizing ODOT agreements for road and bikeway projects, and approving note issuances for land acquisition and fire apparatus.

Consent Calendar

  • Approval of Council Study Session Minutes (May 6, 2024), Council Meeting Minutes (May 6, 2024), and Council Retreat Minutes (May 8, 2024) — approved without comment.

Public Comments & Testimony

  • Eric Kirker (address not stated) spoke at length in opposition to a proposed Everhome Suites hotel on Miller Lane. He argued that Jerry Smith, a realtor from Apex who spoke at the previous meeting, was paid to advocate for the project and does not work for Choice Hotels. Kirker stated that the property is owned by Ministry Partners Investment Company, not yet purchased by Choice Hotels. He claimed that the EPA Phase II study cited by Smith was incomplete, with no remediation done. He raised concerns about crime, human trafficking, and noise from nearby businesses (Lewisburg Container, Sunbelt Rental, Progressive Printers), stating that those businesses oppose the hotel. He provided examples of trespassing and theft on his property and noted 108 lawsuits in five counties involving Choice Hotels brands. He questioned the city’s zoning protections and called on council to reject the project.
  • Steve Panchek (418 Woodland Meadows Drive) questioned the proposed management agreement for a restaurant under the city’s liquor license at Cassel Hills Golf Course. He asked about liability for alcohol-related incidents, whether local restaurants were approached, and the city’s financial gain. He expressed concern that the restaurant would compete with existing local establishments. City Manager Dan Wendt responded that the city holds the liquor license but would not be liable, and that the trial period would run through December 31, 2024. The lease is for $1. Panchek also noted the decline of restaurants in the area.
  • Donnie Donathan (515 Damien Street) requested that council research a food truck operating in a residential zone. He also questioned why the city did not put the golf course restaurant opportunity out for bid, suggesting it could generate revenue via a competitive process.

Discussion Items

  • Proclamation – Public Works Week: Mayor Herbst presented a proclamation declaring May 19–25, 2024 as National Public Works Week, thanking public works employees.
  • Introduction of JR Fulton: City Manager Wendt introduced JR Fulton as the new Assistant Public Works Superintendent, a Navy veteran with a background in operations and management.
  • Oath of Office – Joshua Schneider: Firefighter/Paramedic/Inspector Joshua Schneider was sworn in; he began full-time employment on May 1, 2024.
  • City Manager’s Report: Wendt noted that city offices will be closed May 27 for Memorial Day; a special council meeting will be held June 3 at 5:15 PM, and summer schedule will include one meeting per month in July and August. He also reported on neighborhood beautification day (June 8), recruitment for Recreation Superintendent and HR Manager, and his participation in the Dayton Development Coalition fly-in where he met with congressional staff.
  • Resolution 24-R-35 – Art Park Amphitheater: Awarded the bid to Outdoor Enterprises (Troy, OH) at $490,500. Three bids were received; the engineer’s estimate was $588,000. Funding includes a $300,000 state grant.
  • Resolution 24-R-36 – ODOT LPA Agreement for Poe/Wyse/Miller Resurfacing: Authorizes the city manager to enter into an agreement for federal funds ($843,334) for a project estimated at $1,228,560.
  • Resolution 24-R-37 – Management Agreement for Cassel Hills Golf Course Restaurant: Authorizes a $1 lease through Dec 31, 2024 for interim operation under the city’s liquor license. Council discussed removing a provision for a $50,000 loan through the Vandalia Development Corporation (VDC). The city manager clarified that Version 2 of the resolution (without the loan) was preferred. Mayor Herbst noted that pre-existing bookings would be stipulated in the final agreement.
  • Resolution 24-R-38 – Vandalia Bikeway Connector Additional Cooperation: Authorizes additional funding due to higher-than-expected bids. Total project cost rose to $5,037,126 with the local share (shared with Five Rivers Metro Parks) increasing by $533,930. Councilmember Dugan expressed concern that a 12% cost increase was known in February but not communicated to council. Assistant City Manager Cron explained that the earlier 12% was ODOT’s estimate over the consultant’s, and the actual bid increase was only known after May 9. The city will use funds from the street fund capital account and a payment in 2025 from Five Rivers.
  • Ordinance 24-10 – Land Acquisition Notes: First reading of an ordinance to issue $1,399,000 in notes to retire outstanding land acquisition notes (Stone Quarry Crossing) maturing July 2024.
  • Ordinance 24-11 – Various Purpose Notes: First reading of an ordinance to issue $1,053,000 in notes to retire notes for a fire engine and ladder truck, with scheduled paydowns in 2026 and 2031.
