0:07

Ms.

0:07

McDonald, would you please explain to the audience the nature of the meeting tonight?

0:11

This is a special meeting, which means it doesn't follow the same rules as a regular meeting where we do the pledge and all those other things.

0:19

It is for only the purpose that it was called, which is for going uh to discuss uh litig potential litigation.

0:26

Um, as you know, we have the referendum, and as you probably know, there's two different points of view on the referendum, and we have been threatened with litigation from one side, and there's the potential of litigation on the other side.

0:39

So we're gonna go back today and um I'm going to advise council of what is transpired, where we are, where we stand, those types of things.

0:49

Then we will be coming back out and adjourning the meeting.

0:53

There will be no action taken at this meeting.

0:55

There was none advertised.

0:57

So this is simply an informational type of thing.

1:00

Um I know a lot of you would say, well, why don't you do it out here?

1:03

Um, because as I talk about one side, the other side will be taking notes, saying, Oh, here's their weakness, here's their strengths, and vice versa.

1:11

So it just does not make sense to talk about litigation, litigation strategy options at an open meeting.

1:17

And so that is why we're going into executive session.

1:19

And there will be no public comment tonight.

1:22

No.

1:23

Okay.

1:23

We're simply going to have a motion, go into an executive session, have the discussion.

1:28

Uh no decisions will be made in executive session.

1:31

Um back out, adjourn the meeting, and that will be it.

1:35

All right.

1:36

All right.

1:37

It is recommended that council enter into executive session to discuss with the city attorney pending or imminent litigation.

1:45

So motion by councilman Falek and a second by Councilmember Lewis to go in executive session.

1:53

Please call the roll.

1:56

Councilmember Dugan.

1:58

Yes.

1:58

1:59

Vandalia Special Council Meeting – Executive Session on Pending Litigation (June 2, 2025)

The Vandalia City Council held a special meeting on Monday, June 2, 2025, at 5:00 PM per the agenda in the Council Chambers of the Vandalia Municipal Building. The sole advertised purpose was to discuss pending or imminent court action with the City Attorney. Because the city faces threatened litigation from one side of a referendum dispute and potential litigation from the other, the council voted unanimously to enter executive session. No action was taken, no public comment was received, and the meeting was adjourned immediately after returning from executive session.

Executive Session Discussion

  • Officials explained that this was a special meeting, meaning it did not follow the regular meeting format (no pledge) and was limited to the purpose for which it was called.
  • The presiding officer and Ms. McDonald explained that the city “has been threatened with litigation from one side, and there’s the potential of litigation on the other side” related to the referendum.
  • The discussion with the City Attorney covered what has transpired and the city’s standing; the session was held behind closed doors to avoid exposing litigation strategy and weaknesses or strengths to either side.
  • It was emphasized that the meeting was informational only, with no decisions to be made in executive session.

Key Outcomes

  • Motion by Councilman Falek, seconded by Councilmember Lewis, to enter executive session to discuss with the City Attorney pending or imminent litigation.
  • Roll-call vote: Councilmember Dugan (yes), Councilmember Lewis (yes), Councilmember Fallett (yes), Councilmember Farst (yes), Councilmember Avalodis Weaver (yes), and Vice Mayor Blixley (yes) — 6 to 0 in favor of entering executive session.
  • No decision was made during executive session; officials stated more information would be released the following morning (Tuesday, June 3, 2025).
  • The meeting was then adjourned without further action.

Note on transcription discrepancy: The transcript spells the motion maker’s name as “Councilman Falek” when making the motion and as “Councilmember Fallett” during the roll call; these appear to refer to the same council member.
