All right.

The Monday, November 17th, 2025 meeting, Council meeting will now come to order.

0:07

The first item on the our agenda is moment for reflection, followed by the Pledge of Allegiance.

0:19

And at this time, I'd like to have Liam come forth.

0:22

0:25

He's going to lead us into the pledge.

0:27

If everyone will rise and we'll go on your mark.

0:30

I pledge an allegiance to the flag of the United States of America.

0:35

And to the public for which it stands one nation under God, individual liberty and justice for all.

0:44

Thank you, Liam.

0:50

All right.

0:51

1:51

Anyone?

1:54

Okay.

1:56

Excuse me.

1:56

Robert Shanahan, 7733 South Brown School Road.

2:02

After the special meeting last week, we now have three versions of the infamous traffic impact study amendment to ordinance 25-02.

2:10

The version that was actually voted on, the version that was actually recorded and published, and the version that was somewhat agreed upon last week.

2:18

You can argue all you want about intent or meaning, but the fact remains that the council created and voted on an amendment with specific wording and a specific meaning in the English language at the March 3rd council meeting.

2:31

When the referendum package was submitted in the spring, the committee fully intended and meant for the package to be complete and correct.

2:37

Yet it was denied because it did not meet the exact wording and meaning of the ordinance as written.

2:43

Who gets to choose when the law needs to be followed exactly word for word or when it's okay to use a loose loose interpretation of the language?

2:51

Why did both of these instances go against the local taxpayers and for the out-of-town developers?

2:57

If I get blind stinking drunk and blow through a red light at twice the legal speed limit, killing a family of four, I don't get a walk by telling the judge, hey, I didn't mean for that to happen.

3:07

I intended to make it home safe.

3:14

Yeah, that's how long we've been talking about this.

3:16

And every one of them is gone, almost everyone, in favor of the developers.

3:21

That doesn't seem to be a coincidence to me.

3:28

All right, thank you.

3:30

Anyone else?

3:35

All right.

3:40

All right, seeing none, we'll continue on with the city manager's report.

  • Bills and Expenses: The October 2025 bill listing ($5,413,988.90), monthly expenses over $25,000, and monthly purchasing card detail ($23,017.97) were noted and approved without discussion.

Public Comments & Testimony

  • Robert Shanahan (7733 South Brown School Road) addressed council regarding the traffic impact study amendment to Ordinance 25-02. He stated there are now three versions of the amendment and criticized the council for applying inconsistent standards—exact wording when rejecting a citizen referendum but loose interpretation when voting on the amendment itself. He expressed frustration that council decisions consistently favored out-of-town developers over local taxpayers.

Discussion Items

  • Resolution 25-R-52 (General Services Pay Plan 2026): The city manager recommended a 3.5% increase to the top and bottom of pay ranges for all full-time positions, with a merit-based component ranging from 0% to 4% based on performance evaluations. A minor title change (Fire Captain to Fire Battalion Chief) was included. The resolution passed 6-0.
  • Resolution 25-R-53 (Part-Time Pay Plan 2026): A 3.5% increase was recommended for all part-time positions, except tipped employees whose wages will follow the State of Ohio Department of Commerce (2026 rate not yet released). The resolution passed 6-0.
  • Resolution 25-R-54 (Law Director Contract Amendment): The city’s contract with Pickrel, Schaeffer & Ebeling (PSE) was amended to increase attorney rates to $195/hour effective January 1, 2026, and to $215/hour effective January 1, 2027. The 2026 budget had already accounted for a rate change. The resolution passed 6-0.
  • Ordinance 25-29 (Riverdale Subdivision Final Plan – First Reading): Addison Properties proposes 58 single-family lots on 21.84 acres (with 3.519 acres dedicated as public right-of-way). The Planning Commission recommended approval 4-1 on October 28, 2025. This first reading was a procedural step to move the ordinance to a second reading; it passed 6-0.
  • Ordinance 25-27 (2026 Appropriations – Emergency): The 2026 budget was presented with three changes after the second budget workshop: removal of $310,000 for Art Park solar pathway lighting, reduction of street surfacing costs by $1 million (2026-2030), and a $1 million increase for street resurfacing in the police/fire/street CIP fund. A public hearing was opened and closed with no comments. The ordinance passed as an emergency 6-0.
  • Ordinance 25-28 ($18 Million Notes for Public Works Complex – Emergency): The city will issue up to $18 million in notes (interest rate not exceeding 6%) to fund a public works complex. The one-year renewal note provides flexibility to monitor interest rates and potentially use grant funds. A public hearing was held with no comments. The ordinance passed as an emergency 6-0.

Key Outcomes

  • All three resolutions and all three ordinances (including the two emergency ordinances) passed by a vote of 6-0.
  • Councilmember Avalotis Weaver made a motion to excuse Mayor Herbst from the meeting; the motion passed 6-0.
  • Councilmember Follick suggested reviving an appreciation event for board and commission volunteers in spring or summer 2026.
  • The meeting adjourned after council comments, which included birthday wishes to the deputy clerk and Councilmember Lewis, and Thanksgiving wishes.
