All right, it's 620, so we're gonna go ahead and get started with the stuff this evening study session.

0:07

Um first item is there anything on this evening's council agenda that we will be discussing and voting on that any council member has any questions or concerns regarding.

0:18

All right.

0:19

Next we'll move on to item B.

0:20

We have a resolution for right-away acquisition.

0:23

Mr.

0:24

Cron.

0:32

Good evening.

0:33

Um, for those of you who haven't been here um for a while.

0:38

Um we are in a process of a project right now.

0:41

We're partnering with the Montgomery County Engineers Office on the Dayton International Airport Northeast Logistics Roadway Access Project.

0:50

Um basically that's going to be improvements to Northwoods Boulevard, Dixie Drive, Lightner Road, um, basically all the way from the flying J facility up to the Chewy facility on Lightner Road, and then also Dixie Drive down to Inverness.

1:04

Um we're doing roadway improvements, we're putting in a shared use path, um, making this roadway, the section of roadway more usable for trucks to access the the large buildings on the north and the west side of the airport.

1:16

So this is a joint project, a regional project.

1:19

Um, and as part of this project right now, we're in the design phase, the final design phase, and we have to do right-of-way acquisition.

1:26

Um, there are a total of 49 parcels that we have or different property owners we have to acquire parcels from for this roadway for easement or or temporary construction easements, and um seven six of the parcels are in Vandalia, and they are a couple are critical that we get done early because we have to do the clearing for the utility relocations.

1:47

Um one of the parcels um we're in negotiations.

1:51

We have a uh there's a right-of-way consultant that's doing negotiations with all of these um parcel owners, and we feel like one of them we may not get to a deal with.

2:01

Um, and in when that happens, we have to appropriate the property, which means we go to court and you basically take the property through eminent domain.

2:09

Um, so to be prepared for that, if it gets to that point, um, we have to do a resolution of intent to appropriate the property.

2:18

Um, so that's what I'm here to talk to you about tonight, and we will have this on our meeting tonight to approve the resolution for this so that the project can keep moving forward and we can stay on schedule.

2:28

Um there is the property, it's it's parcel seven on the plans.

2:32

I know that doesn't mean a lot to you.

2:33

It's one of the northern properties on Dixie Drive in Vandalia.

2:37

Um we have had an the property appraised through our consultant.

2:41

Um they've got a fair market value for the the amount of property we're gonna take for them, and that estimate is eleven thousand nine hundred and forty dollars.

2:49

Um they have verbally counteroffed with fifty thousand dollars is what they want for the property.

2:55

Um so I know they are still in negotiations, it's not final yet, but we have to be prepared um to be able to take the property through the courts if to keep the project moving forward.

3:04

So that's what we'll be approving tonight if you if you choose.

3:10

Any questions from council?

3:12

I have a question.

3:13

Just procedure-wise, if that has to be done through the courts, do they still get the fair market value or do we just take it by um well I I believe they go ahead.

3:22

We have an appraisal.

3:24

Um we deposit that with the court, and they can come and take that money immediately, and the only issue in the road take is the value of the property, and then they can get their own appraiser to come in and that's if the court awards them something more than I think it's 20% higher than what we did, then we also have to pay their attorney fee.

3:43

So there's some risks involved in there.

3:45

Okay.

3:48

Thank you.

3:48

Any other questions?

3:49

That's a good question.

3:51

All right, thank you.

3:52

All right, next we have an ordinance for uh dissolving the golf course advisory board.

3:56

Mr.

3:57

Althouse.

3:58

Thank you, Your Honor.

3:59

The Vin Day Golf Course Advisory Board was formed in 1977 when the city golf course was operated by a private company in the city desired additional oversight of the golf course operations.

4:10

As the golf course is no longer administered by a private company, is under the direction oversight of the city parks and recreation department.

4:17

The role of the golf course advisory board and its active membership has diminished over the years.

4:22

City Council's determined the golf course advisory board is no longer necessary, but desires to retain the expertise and experience of the few remaining golf course advisory board members and desires to admend the membership of the parks and recreation advisory board to include the existing public appointees of the golf advisory board as non-voting advisory members for a period of time equal to their remaining existing term on the golf course advisory board or their earlier resignation or removal.

4:51

Thank you.

4:52

All right, well, is there any questions on that?

4:54

We've discussed that a few times now.

4:56

All right.

5:01

First being a resolution for the water mean purchase, Mr.

5:04

Borton.

5:05

I got it out before you got up there to the microphone this time.

5:07

I know it's too far in the back this time.

5:11

Um with the um 2026 capital improvement budget, we have our final uh appropriations for water meter purchases so we can finish our citywide replacement.

5:27

Uh we have about 5200 installed of the 5800 or so.

5:33

Uh primarily the ones we have kind of have remaining are more the difficult ones that require scheduling or they're involve a business, so we have to do it, try and work around their schedule as best we can to not interfere with their operations.

5:47

Um we have in our budget uh three hundred thousand dollars split between the water and sewer funds.

Vandalia City Council Study Session - January 5, 2026

The Vandalia City Council held a study session on January 5, 2026 at 6:20 PM to review agenda items scheduled for the regular council meeting later that evening. Staff presented updates on right-of-way acquisition, an ordinance to dissolve the Golf Course Advisory Board, multiple equipment purchases, and a fire ATV replacement. The session concluded with a unanimous vote to enter executive session regarding real property and potential litigation.

Discussion Items

  • Right-of-Way Acquisition for DIA NE Logistics Access Project (Resolution): Mr. Cron reported on the joint project with Montgomery County Engineers to improve Northwoods Boulevard, Dixie Drive, and Lightner Road for truck access. Of 49 total parcels requiring easements or temporary construction easements, 7 are in Vandalia. The city’s appraisal for one critical parcel (parcel 7 on Dixie Drive) estimates a fair market value of $11,940, but the property owner has countered with $50,000. A resolution of intent to appropriate (eminent domain) will be presented at the regular council meeting to keep the project on schedule if negotiations fail. Council asked about court procedures; the city would deposit the appraised value, and the owner could challenge for a higher award.
  • Dissolving Golf Course Advisory Board (Ordinance): Mr. Althouse explained that the board, formed in 1977 when the golf course was privately operated, is no longer needed since the course is now under the Parks and Recreation Department. The ordinance dissolves the board and allows current public appointees to serve as non-voting advisory members of the Parks and Recreation Advisory Board for the remainder of their terms.
  • Water Meter Purchases (Resolution): Mr. Borton presented a resolution to purchase Badger E-Series ultrasonic meters from Buckeye State Pipe and Supply for $300,000 (split between water and sewer funds). Of the city’s approximately 5,800 meters, 5,200 have been installed; the remaining are mostly difficult-to-schedule indoor or business locations. Completion is targeted for fall 2026.
  • Front-End Loader for Public Works (Resolution): A new John Deere 544 wheel loader with smooth and clamshell buckets will replace the existing loader, purchased via waiver of formal bidding from Murphy Tractor and Equipment using Sourcewell contract. The total cost is $215,674 after trade-in, within the $255,000 budget for the 2026 capital improvements.
  • Single-Axle Dump Truck #22 – Cab & Chassis (Resolution): The city plans to replace an aging single-axle dump truck (five-yard capacity) used year-round for snow/ice, hauling, and general maintenance. The cabin chassis will be purchased from Palmer Trucks (Kenworth of Dayton) for $129,876 via Sourcewell contract, with delivery expected in early 2027 due to extended lead times. The fleet currently clears over 210 lane miles.
  • Single-Axle Dump Truck #22 – Upfit (Resolution): The dump bed and snow/ice equipment upfit will be done by KE Rose Company of Huber Heights for $177,372, using Sourcewell pricing. Combined with the cab & chassis, the total is $307,239, which is $9,761 under the $317,000 budget. Council discussed typical equipment lifespan (11–15 years) and the need to store equipment outside until a new maintenance building is completed in 2027.
  • Fire ATV (Under $50,000): Battalion Chief Jacobs presented plans to replace a 1994 Chevrolet pickup (shared with Butler Township) with a four-seater ATV skid unit. The ATV will serve dual purposes: brush fire response and EMS support for special events and parks. It will make the city less dependent on mutual aid. A council member noted the difficulty of maintaining a 1994 vehicle; the current truck was originally a staff vehicle repurposed for the skid unit. No formal council action is required as the item is under $50,000.
  • Fire Protective Clothing (Under $50,000): The fire division will purchase 10 sets of NFPA-compliant turnout gear (coat, pants, boots, gloves) as part of annual replacement to maintain compliance. Costs typically rise in February, so early procurement is preferred. No council vote required.
  • Boards & Commissions Appointment: Mr. Althouse noted that at the January 20 council meeting, the city will consider appointing John Wheeler as a regular full-time member of the Vandalia Property Maintenance Board, replacing his current alternate member status.
  • Legislative Calendar: Mayor Herbst asked about any upcoming agenda items for the next 30–60 days; no questions or concerns were raised by council.

Key Outcomes

  • Executive Session: The council voted unanimously (7–0) to enter executive session to consider the sale of real property and to confer with the city attorney concerning disputes involving imminent court action. The motion was made by Vice Mayor Follick and seconded by Councilwoman Dugan.
  • No votes were taken on the resolutions or ordinances discussed; they were scheduled for action at the regular council meeting later that evening.
  • The Fire ATV and Fire Protective Clothing items were informational and will not appear on a future agenda for a resolution vote.
